      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi there,

 

I just joined this group yesterday and have been reading up on all the info. I must have been charged thousands by the YB over the last 6 years and have always been infuriated when it has been their charges that have put me overdrawn, which then entitles them to charge me another £8 per day for the privilige until I can afford to get the account back into the black, which gets more difficult with each day and each additonal £8!

 

I am keen to get my own claim underway and will start with the SAR request, but one thing I am concerned about: I do have a poor credit rating and would probably struggle to get another bank account easily - I don't even have a debit card with the YB, just a cashcard (although didn't they send a letter out earlier this year saying all cashacrds are being withdrawn and being replaced by debit cards?). So I am just a bit worried that if I go down this route, I could end up with no bank account at all if they close my account. Has anyone been threatened with this or have they done this to anyone?

Its a risk you have to take.

Im sure theres people with worse credit history than you.....you have managed to open another.

Welcome Caz.

I am claiming over £2k back from YB at the moment, and have just opened a new bank account with The Co-operative Bank.

I have an absolutely appaling credit record, lots and lots of debt and am not allowed any credit.

The Co-op Cashminder account is a basic bank account with no overdraft facility and comes with an electron card. I try to just draw out cash once a week and only use that, but for those times when you need a card (internet shopping, phone etc....) I have a pre-paid mastercard (cashplus prepaid MasterCard®: Introducing the cashplus prepaid Mastercard®). It works just like a credit card but you have to top it up with money at the Post Office so you can only spend what's on it. It does cost £4.95 a month though, or £1 per transaction. Until I learned about it I was kind of panicking at only having an account with a cash card.

The Co-op Bank Account can be opened over the phone (Redirecting to Production Site), I believe, if you don't have a branch nearby, and you can pay in and withdraw money at the Post Office.

PayPlan (Free Debt Management company | Payplan) has a list of basic bank accounts which are available to people with poor credit ratings.

 

Don't let it deter you from claiming back the money that is rightfully yours! I shall take great satisfaction in getting my money back from the Yorkshire Bank, clearing the overdraft with it, and taking the remaining £1000 to my new bank!

 

It's the savings account I never knew I had!

Good information.

 

Talking about cards........the Post Office have recently started a visa electron card which you can load up (I think the minimum is 50 quid) but you can do it with euros/dollars/or sterling.......handy for abroad.

 

In addition easy jet owner starios (think thats his name ) has also got a card running for people who dont want to use the banks own.

Tjink its called easymoney.com but not too sure a search would prob find it.

Hmm, just looking at one of my statements for my easyMoney card and it says 'Issuing Bank: Lloyds TSB Bank plc' :o so doesn't appear to be particularly seperate from the banks!!

First Direct: Settled after LBA - £687.50

Bank of Scotland: LBA sent (too busy to deal with my request!)

MBNA: SAR sent

Morgan Stanley: SAR sent
