    • Well, we live on the same road so it should be the same postcode. When I spoke to dpd and asked why were my neighbours' address not on the list and she said maybe they're not of the same postcode and I checked and they definitely were.
    • again a quick google search states Appeal a DVLA fine - GOV.UK (www.gov.uk) i would not be appealing mind. it's only a summary charge which they rarely do court on and pass out the powerless DCA's whom are not bailiffs they have 6mts. see where they go. as you've sorn'd it will probably be nulled. dx

    • all DYL's are subject to a TRO. looking at this newish, ever increasing as old ind units have gotten removed, estate, there are only lines on one side, on the other there is a parking lane with traffic calming through which you mention. i seriously doubt your mate has any clue what he is talking about.!! its not a private housing assoc estate. so its a public council owned road. no construction co can just decide to draw their graffiti on a road. the DYLs are certainly there pre 2016 even before his home was built. now ive had a quick look to see if the main access to royal park road has signs. there is no royle park road even on your map but there is a royal barn road which leads to where you are parked royal road has a restriction sign on the pole by the fence of the electric substation jnc with gipsy lane there does not appear to be one leading in from the other end - tesco petrol station

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hope u r solved with ur problem by now and relaxed, could u please let me know how did it end.

 

cos I was also caught using my friends student oyster card on 14th oct 2009, i am also a student and my student card was going 2 expire on the same day i was caught,

 

when i was caught i told i couldnt buy 1 week discount fare as my card was going to expire so i used my friends card and had applied for new student card.

 

i enquire with my friends they are telling its an Identity fraud and will cost 1000 pounds and alos this would be registered as an offence under my name and details.

 

please any 1 let me know is true?

 

I am worried a lot and lot, cant think of arranging 1000 pounds.

 

Pls any 1 let me know wat happened to u rosa

I am still waiting to solve my problem. It takes a while!

Your situation is not as bad as mine as I was caught using a freedom pass!!!

Wait until you receive any correspondence from London Underground.

They will give you a chance to reply to their letter and explain what happened.

re £1000 I think you don't have to worry about this if it is your first offence. if you are not successful and you are prosecuted you will end up with a criminal record.

There are a lot of threads about this if you want to have a look.

 

Wait until you receive the letter, believe me there is nothing you can do until you receive it! when and if you receive the letter you can start worrying about it.

Many thanks for your sugesstions, now I am bit relaxed but still i cant think of 1000 with criminal record, nothing can be done now, just I am hoping and praying that everything goes fine in both of our cases. waiting for the letter, once received i will inform you

Hi everyone.

 

I was caught today using my mothers freedom pass.

 

I should not have done it and tried to explain that it was a mistake but in all honesty the inspector did not believe me and it was my mistake.

 

I did not admit my guilt to the inspector and I fear that is going to make this situation worse.

 

I am absolutley petrified of the repuccersions and am very confused as to what to do.

 

1. Should I wait for the summons letter (which i am 100% sure i am going to get) or should I try and get hold of someone before that in the prosecutors office?

2. If i should contact someone before hand who would that be?

 

If I write a grovelling apology and accept all responsibility is there any chance it will not end in a criminal conviction?

 

I really appreciate any advice anyone may have for me.

I also got stopped for using my dad's freedom pass. I had my own PAYG oyster card with me but by mistake used my dad's. I admit it was my fault for not checking which card I was using. I did not look before I used it. I have written to TFL explaining I am sorry for what I have done and that I want to settle out of court ( I don't want a criminal record ). Not heard back. Can anyone advise what I should do next.

Yes, the advice you have been given so far is as good as anyone can give you. Wait for a response to your letter.

 

On the subject of the retained Freedom Pass & Oyster, in reporting an incident the inspector will retain all items that are considered to be evidence that is relevant to the charge being reported.

If you read this thread from the start, that will give you some idea. Did they retain the pass of you? If your mother gave you permission to use it she may well loose it herself!

Well since you havn't mentioned any details of the train company ect, how would I know? Did you not get handed anything from the inspector with those details on? As for your mom getting her card back; this will depend on how they view her involvement. If she was completely unaware that you were using it then there is a chance she may do.

it was at hendon central tube station- and no the inspector did not hand me any information at all. She only said that I would be hearing from them via a letter. Only when I asked about the freedom pass did she say she was keeping it as evidence.
