    • as with some of your threads in the past. you are not reading things carefully and understanding things properly by going off on assumptions. not sure where you are getting your driving licence is being revoked from? nowhere do they use that word. nothing to do with it. vehicle excise licence. (Road Tax), a VEL cannot be revoked only voided. you are also wrong and nowhere does the DVLA state they cancelled the DD.  the court summons clearly states in the DVLA statement: it was your cancelling/reclaim of the DD on 15-02-2024 that caused this, NOTHING to do with the DVLA, they did not revoke the VEL. as they received no payment, on 02.05.2024 the VEL was Voided. it appears you have got the new DD setup wrong to the wrong DVLA account/ref number/VEL number. they have not received the payments to the correct VEL. i would be ringing DVLA and finding out where these payments are on their system and get them attributed to the correct VEL. that should solve the problem.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Yes it happens many times offer, which is why you must rise above, not give up and keep fighting eventually they will see you are not a push over and comply with the law.

Hi All

 

Okay - i Know have a stack of hundreds of pieces of paper - any advice on where to start?

 

I am still waiting on 4 years worth of credit card statements that have not been provided - have submitted a non compliance letter - is there a time limit that banks keep records for. The missing data is from 2000 to 2004 - should they still have this info?

 

I figured I could start calculating figures whilst I wait for the missing data, but no idea how to work it out!

Have a look at a Barclaycard thread by Emmtay - PF explains how to work it out. People usually ask him what the end date is, it is the date you make the claim/send the letter.

 

I'm in some boat as you as regards statements. Haven't decided what to do yet, am thinking about working out last 6 years and then averaging the rest out. Haven't got anyone elses opinion on that yet though. might be a non-starter!

Thanks for that - I am a bit the same - I have 9 years of credit card statements to work through, so once I know what/how to do it, I will start.

 

I am having fun and games with the bank as rather kindly they keep asking for my husbands signature also on letters as it is/was a joint bank account. Only problem being, my husband died last year in combat and they dont seem to have got the message yet!!!

How stupid and thoughtless of them. Make sure you tell Ombudsman if you end up going that route as people are saying you can ask for compensation as well now and if that isn't a good reason for compensation for stress caused I don't know what is. make them pay - its the only way they'll learn the lesson.

I sent the second letter to Lloyds two weeks ago, over the outstanding credit card statements I have requested. I know it has been received but not heard anything.

 

Any advice on what steps I should take next?

 

Do I make a complaint or write again?

Have you complained to Information Commissioner yet? You can do although its quite a wait for a reply.

 

Have a search for a thread by Brocolli_Greens. I noticed people were advising her on same thing yesterday. Just stick Brocolli in the search box above and look for Barclaycard thread. Sorry, I don't know how to do links!

Thanks Jan - to be honest I am at a bit of standstill... I have got a lot of info from them, but missing 4 years, sent a second letter two weeks ago, got nothing back.

 

I guess the next step is the Information Commissioner.

 

I am going to start work on the years info that I do have, have you got any pointers? Do I just total up the entire years worth of PPI?

 

Sorry for all the questions, this is a whole new ball game for me, all this sort of stuff my husband used to deal with..... :Cry:

You are doing better than me! I haven't even got around to sending them a letter chasing the stuff left out on my SAR yet. Keep meaning to get around to it. I can't decide whether to do that (Information Commissioner takes months) or whether to work out averages from what I've got and bang a claim in and then go straight to Ombudsman when they say No.

 

Anyway, I subscribed to a thread by Emmtay on Barclaycard PPI where PF explains how to work out credit card PPI. You have to add the interest as well as the amount paid. But have a look at the thread, he explains better. Just search Emmtay.

 

Oh and I've noticed a lot of people asking him what the end date is - it is the date of claim, or today's date - later the date the better cos you'll get more interest.

Ah thats a good idea, to average it out. Will maybe try that approach. Rather funnily after the initial stuff they sent, I sent the second SAR on failure to comply and they rang to say they didnt have anybody who dealt with that. Until I gave them the name, address and reference of the original letter they sent back with the information..!

 

Will search for that thread, thanks for the pointers. Am I right in thinking there is a letter format somewhere to use when putting in the claim?

 

It's not easy is it?!!

Ah thats a good idea, to average it out. Will maybe try that approach.

 

That approach is completely my idea and hasn't been tried before as far as I know. I've decided to go that route because my claim is with Barclaycard who are known for not supplying info. It is an attempt to cut out the wait for the Information Commissioner. I know Barclaycard will refuse, then I will go straight to Ombudsman (which also takes months!).

 

I'm not sure if your bank are as bad as Barclaycard or if you are better off waiting for info from them before claiming. It is up to you!

 

If I come across a good letter in the next few days I'll post it if someone hasn't already supplied one. I know AA had a good one. But you'll have plenty to keep you busy working out the statements .... I think it takes ages but isn't that difficult once you get your head down. That's why I've been putting it off, plus I've been dealing with a Northern Rock one which I've just won.
