40 days have come and gone- I am sending the letter in the template library giving them another 7 days by recorded delivery.

 

If I still hear nothing what do I do next - do I estimate the charges and if so what happens if I over/under estimate and then Cobblers ask for a breakdown of charges????????

 

Knew mine wouldn't be straightforward.

Just telephoned Data Protection bods again who said they sent my statements upon receipt of my request - i.e. around 9 August!!!!!

 

I haven't got them so who wknows where they sent them......anyhoo they are re-dordering so hopefully this time next week I can make a start.

29-06-06 - Claim served (Acknowledged 30-06-06)

27-07-06 - NW's Deadline - received 27-07-06

24-08-06 - AQ received and returned - Deadline 08-09-06 - Both returned

20-09-06 - 1st Offer - £850.00 with confidentiality REJECTED

05-10-06 - 2nd Offer - £1456.80 with confidentiality ACCEPTED

Right I've now had my standard get lost letter from the infamous Mr Higley. This arrived 6 days after I sent the prelim letter. Do I have to wait til day 14 to send the LBA? Sorry I just want clarification - I've read the 1,2,3 approach but it isn't clear (to me) whether I must wait or can I go now????

I have now received the Notice of Issue from Northampton County Court and NatWest have until 8 November to respond. I would like to think they will "forget" to do so but I know they won't!

As I filled in the MCOL should I send a schedule of charges/interest to Northampton Co. Court with the Claim Number as a reference so that they have all the info?

Also Northampton County Court is MILES away from me - should I get the claim moved to a more local court or will it not matter (assuming I don't have to go I don't suppose it will).

 

Any help is, as always very gratefully received.

Hi Trudianne,

 

Yes you need to send a schedule to the court. All claims completed by MCOL go to Northhampton. Once Natwest issue their defence it will be allocated to your local court and then all correspondence will go through them and you will not be able to to do anything on MCOL. It is, however, unlikely to go to a hearing.

Can some one (and I am sure they can) help me.... I have completed MCOL and GnatWest entered a defence giving them 28 days etc...HOWEVER they have managed to wrangle another £400 out of my account since my claim. Can I/how do I add this to my claim?????

Thanks for that - I will look into it but as you say it may complicate matters and we can all do without complications!!!

 

I'm just annoyed that there were charges incurred - you know how it all escalates......

Just had the defence from Cobbets - along with request for further info.

 

I shall be sending the templated letter in response and sit wait for the next missive.

 

This is all going (too???) smoothly!

Letter from Cobbetts this morning offering half of amount claimed in full and final blah blah.....my challenge would fail in Court (yeah right so why have they never put their money where their mouth is and proved this).

 

Letter on it's way back saying thanks but no thanks. All or nothing - hope it's not nothing!!!!!!

 

I also hope this letter means things are going to plan!

Thanks guys - it does seem to take an age but hey as long as we get there in the end - and yes Si, before the New Year would be great - let's hope Cobbetts are in Christmas Party mood and the season of goodwill will mean they may pull their finger out!

OK bit scared now - have a Court date of 26 Feb - am I going to be The One??

I think it's not unusual to get this far but can someone please reassure me.

Husband is sure I will lose and it will end up costing me.

It is not unusual, tell the other half to lighten up, and that you will spend all the proceeds on yourself.
