Hiya

 

Sent my DPA letter on March 7th. On 14th March I got a letter saying that I did not have to request this info under DPA (i used the standard letter from Library), that is was readily available to me whenever I wanted it and that they have requested my file from archive (its a closed mortgage account) and will send me the info shortly.

 

Today I received a statement of the account from start to finish which shows all the payments, charges etc. They also sent me copies of letters sent regarding the charges / failed DD etc. They have been really nice so far!

 

Have just written the next letter asking for a total of £230.82 back. Do I send this to the data protection department, who I have been dealing with or to the main abbie address??

 

I bet my next letter from them is not so nice!!

 

 

EDIT - jsut a quick note.... I didnt send them any money... all this has been received with no £10 payment being made.

that's a really quick response from abbey! they received my DPA letter on 13th and said exactly the same i didnt need to make a dpa request but i'm still waiting for the statements :roll:

 

Edit: actually i just think i'm being to impatient :oops:

Abbey-received DPA letter on 13/03, received some breakdown till 2004 waiting for the more recent ones(where most charges occurred)

sent reminder email on 17/4/06

called abbey on 19/04/06 to remind them:rolleyes:

sent another email on 26/04/06:mad:

Approx charges £2500

received £500 refund in dec 06

sent LBA

Capital one- sent DPA letter 17/03

Sent prim letter for charges of £260 14/04

Received a refund £109 awaiting further refund of £151

Settled IN FULL

Barclay card- Sent DPA letter 17/03 sent reminder 14/04

received info claiming £120

settled in FULL

Hi all

 

Received a letter from Abbey today stating that they have investigated my complaint and found that their charges are fair etc etc.

 

So have just filed a court claim online...... wish me luck!

 

 

PS - the whole claim is only for £244.32, its not worth their solicitors fees to argue it!

After Abbey received the court papers, they replied to the courts saying they were going to defend..... I was soooooo excited!

 

However I then got a letter enclosing a cheque for the amount of my claim plus costs on a 'without prejudice basis and entirely without any admission of liability'.

 

Well at least I still won!

Believe me mate, they wont be nice for long. The letter i recived with my statments was friendly enough but the one later, rejecting my request for a refund, i found realy patronising. It started off "Thankyou for your un signed letter". (I have a photo-copy to prove otherwise)! "We dont accept that abbeys charges are unfair. Its a well known fact that banks make charges". They then might as well have said they didn't want my business; "You freely agreed to the terms and conditions and the charges when you opened the account. You weren't under any obligation to do so and could have gone to another bank if you didn't agree to our charges". Cheeky buggers!

I'm claiming for £545, not an amount thats going to put them out of business, so dont expect them to stay friendly for long!

They stayed ok with me.... I got my money so I'm happy!

Yes - sent it to the head office - got the address from the thread at the top of the Abbey board.

To the poster who said that they get patronising:

 

Yes, they do.

 

But doesn't that make it all that much sweeter when you get your money back? ;-)

 

When we've won this and the banks cannot charge any more - I'm going to phone Abbey and let them know that if they hadn't charged me that final £120 one month - that this site wouldn't have started. The woman on the phone when I requested that they don't take it almost laughed at me and said, "there's nothing we can do, SIR!".

 

Well, there was sure as hell something I could do about it - I sued them, got my money back, refused their confidentiality rubbish and set this site up.

 

Tw*ts!!!!!

 

It's making me laugh thinking about it!
