  3. Something similar just happened to me. Moving house and gave the new landlord a cheque for £1300 that was dated for the 25th of April. He put it through this week and it has taken me way over my overdraft. Called the Abbey as I though they were not supposed to put it through till the date on it – yet they say they don’t recognize post dated cheques. Yet another bank charge coming my way because someone I gave a cheque to didn’t follow my simple instructuions.

  5. About to accept a great offer for my charges. How have other people got on who are having the same allocation hearing?
  6. I've had a voicemail off James Arrandale at Abbey about my claim. Intrigues to hear what he has to say. If he makes an offer, how do I accept? And do I still go to Kingston tomorrow, as it says on the form if I don't turn up then the case may be thrown out.
  7. Anyone know the contact details or person in Abbey to approach about trying to settle my claim? I’ve tried calling the number on the top of the defence letter they sent but it just rings and rings. I have the same court date at Kingston and want to try and get an early settlement. Cheers in advance.
  8. I received the court date on Saturday and likewise haven't heard a peep from Scabbey. Also, in the same boat with regards to the questions - will be first time I've been anyway near a court so unsure of what I should say. Gonna take all the letters and the list of charges.

  12. Hi, I have now received the defence through from Abbey and had the court changed to Kingston (closest to where I live). One other question I have is, since I put the claim through I've had at least an extra £300 taken out of my account in charges. Do I have to wait till this claim is through before I lodge another or can I somehow add these charges to the existing claim? Also, do I now just wait until a court date is set or is there some way of hurrying the process along? Any answers would be fantastic. Anthony
  13. It was a straight offer of £840 and didn't mention any specific charges. I sent a letter back accepting the offer but letting them know I would pursue a claim for the rest of the money. The money then "magically" appeared in my bank account about 4 weeks later. Have I done anything wrong?
  14. Urgent help needed: Am about to enter my claim online. I've already had £840 refunded and am seeking the outstanding £2300. On the spreadsheet I have entered a line that removes this amount from the final total, but I need to know if I need to adjust the interest? Quick answer would be great. Thanks
  15. OK, sent letter aksing for £3177 back in charges and interest. Just about to send second letter threatening action when I get a letter from Abbey. They think there charges are correct but are willing to offer me £860 as a goodwill gesture. I've been given the telephone number for a Angela Stewart. What do I do know? Reject their offer and tell them I'll press on for the full amount. Or accept the offer but tell them I will still press on for the rest?
  16. Sent them a similar letter to the one in the Abbey thread, basically informing them the 40 day period has run out and giving them 7 days before I start legal action. Let's see what happens!

  18. The 40 days have passed and still no statements. I've received 2 letters from Abbey: 1) Arrived about 2 weeks after sending the DPA request letter saying they were looking into my claim 2) One today saying that they are still looking into the claim, it is taking longer than they thought and that they need an additional 40 days. Gonna send my Letter Before Action, using a calculation based on the charges they have taken off me for the period that I have statements. Abbey, I'm coming to get you!
  19. Hi, The time for them sending me my statements had lapsed, what do I do now? How do I apply to the Information Commissioner for them to send me the statements? Any help would be great? Is this my next course of action: Under the Data Protection Act - the Data Controller has only 40 days to provide this information. If they refuse, or do not furnish you with the full information within 40 days, report them to the information commissioner - ICO – Information Commissioner's Office - for a breach of the Data Protection Act. We also have templated letters to force compliance through the courts - see the Templates Library.
  20. Instead of starting a new thread I thought I would continue my old one, (right thing to do mods as I have restarted my claim?). Last time I had to stop the process due to family illness but this tme I'm back and I'm gonna kick Abbey's moneyfat ass. I sent off my dpa request about 25 days ago now. Had the usual microfiche argument thru from the abbey, so I replied with the template letter on the site. Since then I have had a "we're sorry you are not happy, we have appointed someone to look into your case" letter. They still have 7 more days to send me my statements. BRING IT ON!
  21. Ok, so its been almost 28 days since I sent my request for action. The other day I received the usual "our charges are fair" letter from the HSBC. This is before I got any of the statements through or even asked for them to refund any charges. They stated on the letter that this "represents our final response on this matter". Is this normal? Seems like a pre-emptive strike by them. They still have about 7 days to send me my statements before I make further claims to get them.
  22. Hey people, Wanted to start a thread for my claim. Sent the DPA letter on the 1st Aug. Although I closed my Abbey bank account about 2 years ago I still reckon I have £1000+ to claim for. Fingers crossed I get a quick response. Anthony
  23. Natwest are continually calling and trying to move me up from my Step account. They are talking about savings accounts, cheque books and overdrafts. Poor souls, it's only an account in case the Scabbey close my other account. I'll keep them calling, I actually enjoy having a bank chase me for business, fully knowing I'm never going to upgrade the account.
