I was just wondering whether this was a legal claim on my deposit:

 

Our landlord is claiming our full deposit in order to recarpet the entire house due to a few spot stains on the carpet. Bearing in ming that this was a white carpet and is present in the whole property and we were living in the property for 1 1/2 years!

First they can only claim what is reasonable; were all the carpets new at the time you moved in; can they be cleaned professionally; usually life of carpets in rented accommo. is 3/4 years depending on expexted use and type of occupation ( students/ family etc. ) so replacement cost would have to be pro-rata as a percentage.

 

Is the deposit protected, if so he will have to substantiate his claim and you can either accept it or dispute the figures. He cannot withold deposit as he should not have it. If it is not protected then that is illegal and you can sue him for that at 3x eposit value. that may make him think twice about the cost of the carpets.

I'd consider raising a dispute, as on the face of it it sounds excessive.

 

What evidence does the landlord have? Has he given you anything in writing - reasons, receipts etc.?

 

How much is the deposit, and how much does it cost to recarpet?
