Hi

Great site and I have used lots of the information available at times.

 

Mys sister (and ex BF) has an unsecured loan with Abbey for £17K and has been paying £10 per month since 2002. Robinson Way are now persuing and are at present accepting this ongoing arrangement. She has just obtained copy of the original CCA and it only has her signature on it and not her ex boyfriend. Everything else on it looks OK.

 

Is this likely to be enforceable?

I don't have the document and unlikely to be able to get hold of (sis very nervous about anything to do with on line forums). It took weeks to get her to send the CCA. I have read the various threads on what is required for enforceability but can't find anything relating to a missing signature.

 

I think she would happily pay her £10 per month but I have suggested RW will be after more sooner or later. She is currently single with two kids on working tax credits.

 

Any hints?

Then the person who hasn't signed will not be liable at all.

 

As to the person who has signed would need to see the agreement.
