    • Hi, I have found this group very helpful hence I am here seeking help and advice.   I got myself into a situation where I have now more than £50k in unsecured debts (personal loans & credit cards) and things are now getting out of control as I am struggling to make payments. This is purely my own created situation and I am taking 100% responsibility for it. I am keen to get out of this situation as soon as possible hence I would appreciate any help and advice in this process. I am employed at the moment and don’t want to risk going into IVA or bankruptcy as this would risk losing my job. Being sole bread earner of my family, I cannot afford to lose my job. I have been trying to keep up with the payments so far and had few missed payments instances until 3/4 months ago but got caught up with missed payments somehow using my savings. All my debts are still with original lenders. However I know I am getting into same situation again shortly and won’t be able to get out of it again. I have started exploring Debt Management Plan (DMP) option through StepChange but haven’t submitted it yet. Based on budgeting, I have around £820 available to make payments to all lenders after taking care of all other essential expenses. This is definitely lot more affordable than what I am currently paying to different lenders. 1. Is DMP right option for me in current situation? 2. what are the negative consequences of availing DMP? 3. is there something else that I can do to get out of this situation? I’m determined to clear out all my debts but need bit of breathing space and time. Let me know please if you need any additional information. Thanks in advance for all your help and guidance. MM

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

In reply to your question, sadly yes.

 

Citizens advice stated that 1st crudit will go for CCJ, then Charging Order then Inforcement order. Nice people at CAB.

Ok OK what with Von Greenbach telling me to keep sending nominal payments and the wife wanting to put food on the table only the 1st Credit CCA's have gone off. Yes I promise the Barclaycard & BOS/Halifax will go within the next couple of days, promise!

I know you mean good but my wife doesn't understand or believe in the power of the CCA, I blame the CAB for that.

Thank you for your advice as I do need the occasion kick.

Hi Fred, Thank you for your encouragement, today I've got all the P/O's for a few other DCA's, I have 12 or so to deal with over time. Have to start somewhere. Clock is ticking on 1st Credit. Just looking at getting a scanner so I can post their replys here less personal info. Slowly life returns to the undead, quite empowering!!!

OK that doesn't seem too difficult. Its going to be a a while so be back in about a week or two. BTW Being stalked by a pair of old folk, last weekend and again this week. 1st Credit are info hunting I guess so they can make threats against perticular assets as to scare us into paying up xxxxx. Just hope the 1st Credit/Halifax can't produce a CCA from 8-10 years ago.

Thanks babybear39, Yes your right, its been explained to me the CC Judges cannot set precedent and that this is reserved for the higher powers. The verdict is flawed and should be referred to the High Court. I think its becoming increasingly clear that some of these dodgy verdicts may not have come about if the plaintiff had representation at court. I wish the legal aid system could be changed to include civil matters otherwise we remain at the mercy of DCA's and suspect Judges. Its a lottery just like the NHS.

Received letter where they agree to accept nominal payments by D/D and I quote 'Please note we may be able to offer you a discount for a full & final payment'.

 

The letter is dated before they signed for the Recorded del. of our CCA request??

 

Are they giving up before the fight??? comments please.

Hi babybear39, Thank you for your reply. I didn't like the sound of paying by D/D either. If I continue to pay its by P/O only, however they have since signed for my CCA request so I guess their offer will be withdrawn and another threatogram will follow shortly. I'll keep you posted.
