    • just to be clear here..... the DVLA do not send letters if a drivers licence address differs from any car's V5C that shows the same driver as it's registered keeper.
    • sorry she is a private individual, the cars are parking on her land. she can clamp the cars. only firms were outlawed from doing it bazza. thats what the victims of people dumping cars on their drives near airports did and they didn't not get prosecuted.    
    • The DVLA keeps two records of you. One as a driver and one for your car. If they differ you might find out in around a month when they will send you a reminder as well as to your other half for their car. If you receive nothing then you can be fairly sure that you were tailgating though wouldn't explain why they didn't pick up your car on one of drive past their cameras. However even if you do get a PCN later then your situation will not change. The current PCN does not comply with the Protection of Freedoms Act 2012 Schedule 4 which is the main law that covers private parking. It doesn't comply for two reasons. 1. Section 9 [2][a] states  (2)The notice must— (a)specify the vehicle, the relevant land on which it was parked and the period of parking to which the notice relates; The PCN states 47 minutes which are the arrival and departure times not the time you were actually parked. if you subtract the time you took to drive from the entrance. look for a parking place  park in it perhaps having to manoeuvre a couple of times to fit within the lines and unload the children reloading the children getting seat belts on  driving to the exit stopping for cars pedestrians on the way you may well find that the actual time you were parked was quite likely to be around ten minutes over the required time.  Motorists are allowed a MINIMUM of ten minutes Grace period [something that the rogues in the parking industry conveniently forget-the word minimum] . So it could be that you did not overstay. 2] Sectio9 [2][f]  (ii)the creditor does not know both the name of the driver and a current address for service for the driver, the creditor will (if all the applicable conditions under this Schedule are met) have the right to recover from the keeper so much of that amount as remains unpaid; Your PCN does not include the words in brackets and in 2a the Act included the word "must". Another fail. What those failures mean is that MET cannot transfer the liability to pay the charge from the driver to the keeper. Only the driver is now liable which is why we recommend our members not to appeal. It is so easy to reveal who was driving by saying "when I parked the car" than "when the driver parked the car".  As long as they don't know who was driving they have little chance of winning in court. This is partly because Courts do not accept that the driver and the keeper are the same person. And because anyone with a valid motor insurance policy is able to drive your cars. It is a shame that you are too far away to get photos of the car park signage. It is often poor and quite often the parking rogues lose in Court on their poor signage alone. I hope hat you can now relax and not panic about the PCN. You will receive many letters from Met, their unregulated debt collectors and sixth rate solicitors threatening you with ever higher amounts of money. The poor dears have never read the Act which states quite clearly that the maximum sum that can be charged is the amount on the signs. The Act has only been in force for 12 years so it may take a  few more years for the penny to drop.  You can safely ignore everything they send you unless or until they send you a Letter of Claim. Just come back to us if they do send one of those love letters to you and we will advise on a snotty letter to send them. In the meantime go on and enjoy your life.     • Hopefully the ANPR cameras didn't pick up the two vehicles, but I don't think you're out of the woods just yet. MET's "work" consists of sending out hundreds of these invoices every week so yours might be a few days behind your partner's. There is also the matter of Royal Mail.  I once sold two second-hand books to someone on eBay.  Weirdly the cost of sending them separately was less than the cost of sending them in one parcel.  So to save a few bob I sent them seperately.  One turned up the next day.  One arrived after four days.  They were  sent from the same post office at the same time! But let's hope I'm being too pessimistic. Please update us of any developments.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

:p I've got my tin hat on but i have read these forums for a few years and now when i am at work i am dying to tell people about this site but i need to work and as you can imagine that would be a big no no for my bosses :(

 

I'm trying to put myself in your position here. There must be times when either you feel extremely sorry for somebody who is quite clearly being given a hard time when they don't deserve it, or quite angry when you can see that somebody is simply trying to evade their responsiblities. Does this make your job more difficult?

Do you use BT? If so, they have a service which you can sign up to for a few quid a month which allows you to divert your 'phone to a different number. You can then sign up to a free 0700 number with somebody like dmclub.co.uk and divert your number to that. This way, you have a log of all the calls made and you get instant notification of any messages that are left - again this will help to prove harassment.

 

Also, if you are with BT, you can get an additional number at no extra cost that works with your broadband. I did this and gave this number to family and friends. I still kept the old number but I can switch it through to my voicemail number if I start getting a lot of calls from DCAs, which to be honest, I don't any longer.

Hi Teldave!!

 

Please try not to worry!!! I know this sounds nonsensical but the main aim of these companies is to try to get payment from you before anybody else in the queue. This is why the pressure on and more so recently. They are using really heavy-handed tactics nowadays for one late payment not to mention 3+months...

 

I am now seeing these companies phone my workplace, phone home and send all sorts of threats in the post. I dread the post and I dread calls.

 

This has been going on for months, It would be easier and less stressful if it wasn't for my partner who is not aware of what's going on and so I'm ending up lying to him. None of my debts are linked to him but with all the companies phoning up saying who they are it causes much stress and pressure onto relationship - as domy attempts to organise my finance / hide my files or check cag... without him knowing. I even take my main 'debt' files to work so he doesn't find them when he's alone in the house and I unplug the phone most times saying it 'fell out' or stopped working. I have become very adapt at the white lie to protect 'us'. ... he would freak if he knew the truth.

 

I have become less of a shrivelling wreck (but I still have my moments!) because of cag and things have go better over last 6 months as I've acquired more information from cag'ers. It's the not knowing the facts that gets me stressed big time as does the fear of him finding out.

 

It's all going to be a bit confusing for you trying to get everything tight in your head and to grasp the information you will get from here (there will be lots!!) but remember we are all here for you. Many people in similar situation unfortunately and many more got through it all. If you can put up with us we're all here and usually at all times to help you get through the worst of this. There are so may experienced people on here but the site is egtting busier and busier so do not panic if any of your threads do not get immediate reply.

 

First thing to do is to start different threads - this is once you're ready to start the fight-back... - don;t do it all in one go or you'll get confused!! Start threads on the more urgent cased. Decide if you want to put the thread in the actual bank forum (down there somewhere!) or in general debt or (more urgently usually) the debt collector section.... then post away particulars of that issue.

 

HFC / Marbles have defaulted me and were phoning and phoning each day until I complained. They were quite good and stopped amazingly. Now they are selling debt to god knows who else and charging a fortune in interest. Some tactics:

 

1. Start a file - dividers with correspondence from all of these lowlife into sections - will help you later. I am guessing you haven't opened many? For now open and file. Read them maybe in a day or two??

 

2. Many people will say for you to get a copy of your CCA (credit card agreement) and although this does 'assist' in the end game it does not stop these companies sending letters and selling debt onto DCA (debt collection agencies).. although they are not supposed to without a valid cca. IT can only be decided upon in court whether the CCA is unenforceable and not many banks / dca's take you to court because they will lose... so they use all their nasty powers to harrass. Ask on here how to do (different thread)

 

3.. You could try to see if you have any illegal penalty charges on your accounts? This could give you a big chunk of money back but could take some time.. then again if a bank, rather than credit card company, it will be much longer due to this court case (court deciding if they are illegal or not it seems). Ask on here how to do (different thread).

 

4. Go to post office and gte a few (five+) postal orders for 1 pound each (cost you more to buy!) ready for an emergency CCA request to any nasty lowlife who may have bought your alleged debt. Start new thread on here on how to do all this CCA request stuff - remember to track letter and postal order.

 

5. Send letter regarding phone call harassment to all companies.. (ask on another new thread for this if you cannot find letter!)

 

6. Be ready with a letter stating 'I do not accept doorstep visits' etc.

 

7. If you get telephone calls and know the number try to see if you can complain here:

8. This is a handy website for finding who called.

 

Phone Call Comments remember to leave out spaces.

 

 

 

 

I have just has the Financial Ombudsman Service find in my favour regarding Capital One phone calls but it took 12 months. Cap One are way worse for phone calls than HFC / Marbles. The Co-operative kept saying they would stop calls but didn't so I phoned executive office and they stopped. The nasty automated letters have not stopped though. RBS have also promised many times to stop and haven't. I am now preparing complaints against them but know it will take months. My phone line is disconnected. I have had to change my mobile phone number.

 

I do agree you need to first of all contact the national debt line for immediate advice and peace of mind. Do NOT panic. Most of these letters are meant to intimidate and it is very very wrong.

 

Unplug the phone for your sanity!!! Leave it unplugged. Get a new mobile number etc!!

 

We are all here for you!! Take a deep breath and realise that this IS your low point and things will get better from here on.

Hi willtheywontthey, I know this is not your thread, but please take it from me that you MUST tell your partner. He will find out eventually - it is impossible to hide for ever and the stress of dealing with it the way you are doing is absolutely unbearable - you probably appreciate that already. Pick a suitable moment and TELL HIM.

 

You have to ask yourself what you are worried about. Will he leave you if he finds out? Well he will find out and frankly, he's more likely to do that if he thinks you didn't trust him enough in the first place. Take it from someone who knows exactly what you're going through. My marriage very nearly broke up because of debts - not because of the debts themselves but because my wife was so upset that I didn't tell her about it. Tell him, get him on your side, then you can start to deal with this properly and without anywhere near as much stress.

thanks Mr Ton this is all new to me a born worrier that is my problem I have to say my employer is lovely they have always bent over backwards for time off maybe I just as you say realise that not everyone judges you because you have financial problems there are so many people out there worse then me I have to start counting my blessings but when you are low it makes it hard to do this thanks again for your support I need a kick up the !!!!!

 

Hi Teldave, it helps to have something realistic to say to people if this happens. You could tell them that you are in dispute with your bank because of charges and that you've fallen out with them. It's entirely believable - nearly everyone has been stung at some time or another.
