    • The finance company has a 50% stake (legal Owner) in the deal so I would certainly involve them. As for the outstanding £3635 bill thats owing to Mercedes in Croydon I wouldn't be in a rush to settle that just yet and keep it in abeyance as leverage.  Where are you at with Doves in Horsham ?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Please can someone help me, I have just read in the National debt line book that if you take out a credit card on the internet then the rules on asking to see the CCA and the chances of claiming for enforceable agreement is not good. I was about to send my request to egg but i filled in the application on the internet and everything is internet based on the account. I am paying nearly 300 a month and interest is around 170 but as i am selfemployed my income is now dropping and i am struggling to pay my debts. I really dont know what to do and finding myself not sleeping and worrying all the time. At the moment i have not missed any payments to creditors but things are getting hard now. hope someone can help.

If you are up to date with the payments it may be worth taking out PPI - that way if you cease trading you will be able to claim unemployment. Just pay the minimum at present to keep the account in order.

 

I'm not sure about the online application aspect - hopefully someone will be along shortly.

Just because you applied for an account over the internet doesnt mean that the CCA does not apply.

 

They still have to send you copies of the relevant documentation and they still have to comply with all the legislation.

 

While i respect poppy's opinion, I am not sure that you could get PPI even if you wanted to, or if adding another payment to your already stretched budget would be possible.

 

The part about paying the minimum is good advice, and make sure that you dont miss payments altogether - once you miss a payment then charges start accruing and CC companies are brutal.

I think what you are referring to is the Electronic Order of 2004 which came into force on 31st December 2004.

 

The Consumer Credit Act 1974 (Electronic Communications) Order 2004

 

I think this means that ticking the box on line is effectively the same as signing a Credit Agreement. i.e.

 

(2) In section 61 (signing of the agreement), in paragraph (b) of subsection (2) (unexecuted agreement to be sent to debtor or hirer by post for signature), for "by post" substitute "by an appropriate method".

 

I'm sure someone will correct me if I'm wrong.

thank you so much for the replys, I dont think the PPI would be any good as i am self employed and i have had friends who didnt get paid out because they insurance said that by being self employed then they had affectively made themselves unemployed , if you can believe that. As for ticking the box, does this mean they can produce the documentation so i would be stumped. I have posted another thread about my old accounts with MBNA which now barclaycard have taken over, all i new was when i received new cards in the post, i never signed anything requesting new cards in barclays name so if i transfered my balance from egg to these old accounts which were applied for in writing years ago then i could stand a chance. maybe. just hoping.

MBNA's PPI is through St Andrew's - they do pay out self-employed folk for self employment ending if you can demonstrate that you have ceased trading (ie by notifying the tax office and getting confirmation in writing/final accounts).

 

I suspect it depends on the t&cs of each company,
