Vanquis CCA Non Compliance

Hi Guys,

 

Cracking site...

 

On 10th September 2008, I sent a CCA request to Vanquis. I received no reply so on 20th October 2008, I sent them a non-compliance letter (both by recorded delivery)

 

To date, I have received nothing at all from Vanquis, they have tried calling me but I either ignore them or if I fancy an argument I speak to them and ask where my CCA is? (They really are snotty blighters)

 

Now what do I do...it is clear that they are ignoring my requests

 

Any advice??

The crucial question is whether or not you have proof that your letters were delivered.

 

If you do, then the facts are simple. They remain in default of your legitimate CCA request, the account is in dispute, and they are acting unlawfully by harassing you.

 

You can handle this by firing off complaints to the relevant bodies, who are totally useless and will do absolutely nothing, or you can just continue to ignore the threats.

 

Personally I would ignore anything and everything unless it was a court claim or a valid enforceable CCA agreement.

 

Keep evidence, and the time may well come in the future where you will be able to use it.

I had same problems,although they did supply statements,There was something wrong,in that the figures did not add up.Despite lengthly studying I was unable to find what was wrong,so sent them another letter to say they had not fully complied.

Heard nothing for a while and then got a letter saying they were looking into it.

Next I heard was that they had sold the debt to Cabot.

 

In your case I suggest sending the temp letter in the library for non SAR compliance.

In conjunction send also a complaint to the Information Commissioner.Keep copies and send recorded.

Personally I would be very careful in dealing with Vanquis, they are very used to dealing in this sector of lending and imagine a CCA is going to be risky for the reasons mentioned in the sticky on CCA's. There is a good chance they will come up with the goods if the debt is less than 2 years old.

 

They are agressive and will pass your debt around like a joint, to more and more pond life.

 

A SAR request should def. be sent and will certainly uncover very big unfair charges, especially from a company that charges 60% APR or whatever it is they charge these days.

 

So bottom line don't be bullied by them but do a expect an enforceable agreement if its recent.

We live in an unmoderated country why should the net be any different?

Still not heard anything from Vanquis and their time is well and truly up. I have today reported them to the FOS (what use that will be) you never know they might get their finger out of their arse!!!

 

I have basically said, either send me my CCA or remove all charges, interest and information they hold about me.

Vanquis have still not supplied a CCA and its been 7 months now. They have made me an offer via the FOS of £80 + £9.81 interest

Very frustrating especially as it will take FOS 2 - 4 months to investigate the complaint further.

 

At the end of the day, I will pay what I owe, but there are inconsistancies with there APR, I want to see a CCA that I have signed.
