I read with sadness about your accident, I hope you are well. However, please can you tell me if you ever promised to make payments and didn't keep to this?

 

Zoot, it has very little to do with me. However, I speak from experience here. I had difficulties with my mortgage repayments with KMC, and I had time after time agreed to maintain payments. The end result was I lost my home, and ended up on the repossession register.

I also took KM to court for charges and also ERC, paid upon repossession of my property. I lost this, and also lost my appeal.

In total I have lost more than I ever could have imagined, and what I do know is that certain judges take a very very dim view of claims, whereby, the customer is then making a claim for damages, when they failed to make mortgage repayments ime after time.

I just feel people need to be aware.

I get the feeling I upset you Zoot, and I am sorry if this was the case.

You've not upset me, I'm just looking out to see that people don't upset other users. Given your user name and your previous post it appeared that you were an insider for the mortgage companies.

Hi all

Sorry for the delay in replying but havn't been too well with my spine problems. However, yes I did promise to make payments and not stick to them this was the only way Kensington would stay off of our backs. We had a Possession Order against us but managed to sell before repossession. However, we were penalised by ERC and ended up paying back over £17,000 more than we originally loaned. £7200 was the amount of the ERC and charges for non payment of direct debits etc of £2500. However we have not issued claim for the ERC but are about to for the the charges. I was disabled and Kensington could not have cared less that I was ill all they were interested in was issuing us ultimatums to pay ridiculous amounts which we could not or lose the house.

SPML - issued MCOL on 21.11.06!

Kensington - statements received letter requesting £2455.55 refund of charges issuing MCOL for ERC

MBNA - refund £341 offered-sent letter requesting refund of £3846.59 charges!!!!!!

Capital One-going to issue MCOL for £1243!

My you've really been put through the ringer. Good to see you're keeping up the battle. It must be very difficult for to carry on. Have you thought of taking up your complaint through the Financial Ombudman. It could take a lot of the stress and hassle from you. Its free and it won't cost you anything if you lose. It will also guarantee that Kensington and Gmac are answerable for their actions. The more people that complain the greater chance that the Regulators will clamp down on their horrific and immoral practices.

Sorry for the delay in replying have been away from home.

Yes I did take Kensington to the Financial Ombudsman but they said that although their methods were underhand there was nothing they could actually do about it! Did not take GMAC though, perhaps I will give it a try its only the cost of writing a letter and posting it and at least the more complaints we make the more it will help our cause to get these things changed so that other people do not fall prey to these vultures as we have done.
