    • Yes of course. That's why it says cc:: BIg Motoring World at the bottom. Don't imagine that this solves the issue. It doesn't. He not have to force the finance company and big motoring world to accept the rejection to give your money back. I suggest that you get the letter off tomorrow. And let us know what you hear but on Friday you should then send a threat to the finance company.   Have a look what I have said here about your options and read the whole thread as well.  
    • Been perusing the actual figures on the polls above wondering where the '16% claimed for deform comes from? I understand that there are 'weighted' end results based on secret calculations ...   Probably going to repeat this later, but remember that the ukip/brexit/reform/deform party has ALWAYS had poll speculation FAR better than their actual  performance at elections - by large margins. SO: The labor and Tory votes come largely from simply the people who say they will vote for them - sorted Lab 43% Tory 20%, with maybe another small 1-2% coming from the weightings of the 'not sures' Greens largely get what is declared from 'other' , although with another declared green bit from the 'pressed' question   So as the share of the voting displayed in 'other' granted to reform/deform is around 11%, where does the '16% too often being reported come from? Seems that reform has been granted as beneficiary of effectively ALL the don't knows and wont says, who when pressed didn't actually declare for someone else ... effectively adding 40%+ to their reported polling % - rather strange given their consistent under-performance compared to polling - or perhaps that is the cause of the higher rating eh?   Now I admit the possibility (probability?) of wingers being ashamed of declaring their support for the yuckey lemon end of the spectrum ... but surely  that should affect the 'Torys as well? Maybe the statisticians have simply weighted in that deform wingers are simply more likely to lie?   But - without 'weightings' and assumptions that faragits will get everything that isnt declared as a definite and unequivocal 'not that Piers Morgan' - reform is on around 11% it seems.   Add to that the history of polling a lot less than the hype - and the simple fact that faragit wingers seem to be spread across the country (presumably skulking in their moms spare room despite being 45+) and greens and lib dems seem to be community minded - I think two seats will be an epic result for farage. Hardly the opposition - far more raving wingnut party.   and importantly - Has farage got a home in clacton yet?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Can't rep you again yet ?!!! It really does work, am dealing with 5 others too, this is just my MBNA thread. Have taken on the telephone speech to a T !!!! It works and sometimes I actually feel sorry for those foreign callers, after all, they are doing one of the lousiest jobs anybody could do, probably underpaid as well, so I do try and remain polite, short, to the point, and it doesn't do any harm !!!! Best thing is when they get really chatty and you can then remind them that they are in breach of the Data Protection Act by continuing to discuss your account details before clarifying the security questions, ha ha, I'm loving it! If I get sent down for all this :(, remember me LOL :)

A little update, 3 credit cards taken over by MBNA :

 

23 September - 1st Class - Recorded Delivery letters sent:

 

Harrassment Letter - phone calls nearly all stopped

CCA Letter - deadline Monday 13th October for response

Copy Hardship Letter + Income & Expenditure Form of 08 Sep

 

It's gone eerily quiet out there - yeah !

The Postman however delivered another MBNA CC Statement this morning. This one has a never-before seen additional page which I shall endeavour to upload.

 

What does it mean? If, anything??:?

What was on the other 2 pages (it says 3 of 3) ?

 

I think what they are doing is showing the amount you are in default, advising you that they arent allowed to charge interest on the default sum for 28 days (presumably this is to allow you time to pay it) but will resume after 28 days at a different interest rate. Of course I could be totally wrong. Perhaps someone like Scarlet Pimpernel would be able to advise better.

Pages 1 & 2 are the normal statement pages showing balance, late default sum plus overlimit default sum plus interested charged plus a new enhanced balance......

 

Just suspicious why for the first time have now received page 3 with this gumpf on, don't even understand it :?

Today we have received 3 digital voice machine calls from MBNA, telling us 'it' wants to speak to AA99 and to push any key to continue. I just can't help hanging up, grrrrrrrrrrrrr:-D

Have had 3 more telephone machine calls every day since, tonight I machine-answered that I was not the person they wanted and waited for ages to be put through........ when a 'human' (?) came on the line, I told her we didn't want to speak to anybody on the telephone and that I was waiting for a reply to my letter, :eek:

keep the record going, if anything ive learnt from this madness is that talking on the telephone does not get you anywhere, id rather spend a 1.00 to send another letter, telling them they are to contact only in writing, mind you i see a lovely letter the other day that someone had set up a 0871 number line and then given that as the telephone contact number so you get paid when they call you,,,,imagine what fun i could have with that!! going into overdrive here,,,lol

 

however serious,,,there was a letter i seen the other day cant remember if ive kept the link but saying its for personal use only and not business therefor misusing the telephone line , quoting some telecom act etc you read my drift, - i might even go for that as my next letter,,,and remember all part of your harrassment case buildup so you can use in court as a counter claim or whatever it is, not learnt that bit yet,,,,swotting already though lol

Hey AA99 - I'm so pleased you're happy to tell them to pi** off! If you do speak to them though, try and get both their name and the name of the manager or person who told them to call/gave them their call list so you can log that too. You need to do this before you say you're not going to talk to them obviously. I've found that giving them the idea I might go through security if I know these things helps. Of course I'm not in a million years suggesting that you fib to them about your intentions...:p

 

I've seen that too with the use of premium numbers maz:D. The one I saw though used a £1.50 a minute one:D

Final day today for return of CCA's 12 + 2. No response from MBNA. Please confirm if the following letter, topped and tailed accordingly, is now the one to send.....

 

Thats similar to the one I sent off on the 8th, received on the 10th, so they now have until the 25th to reply If i am correct in thinking

 

Re the CCA - Well they actually got it to me on the morning of the 8th, but Where was the actual copy of the agreement, it was not there at all, and the agreement sent with the terms on, was the updated on as it was showing the charges of £12 etc

 

So basically, I received nothing from them, apart from another letter today dated the 8th, saying they are chasing it, but I have ignored that as they wouldnt of got the last letter which you have refferred to.

 

MBNA are dragging their feet, is it the Credit crunch, will they think we drag our feet and we will go away - I dont think so

The SAr is pretty comprehensive. It just wories me tha the things you really want may get lost in the detail. Personally, I would limit it to what you actualy want: all statements (?) and records of all communications, including any recordings made for quality of training purposes and any transcripts.

Thanks people. The lengthy detailed lSAR etter was recommended by BRW in another thread, suggesting go the whole hog with the requests, so I may just do that.:) Anyway, will print off and run to the PO now with them, ok to just scribble initials as a signature, yeah ?:???:

CCA is 12 working days + 2 allowed for postal service.

 

SAR is 40 calendar days. So if you posted today, you should expect a reply by at the very latest, 22 November:D
