    • hi dx, thanks for helping just re-reading everything this morning and I must have missed this one from uncle in his thread "What you should not do, is not contact the Banks and simply default on payments. "  are you in disagreement with this based on your last sentence?
    • Thanks for the reply and clarification, that might just explain why in my case contact has pretty much ceased. Though with such companies it doesn't mean they won't ever threaten to return to court as a tool to force one's hand if they feel they are not self informed on their chances etc.  But concerning how last year they tried to use the CCJ to get a charging order and the court granted an intirum order on our mortgage using the CCJ that would have been a good 2-3 months beyond the 6 years, should the court not have checked the age of the CCJ in the first case or would they always grant an interim order simply off the back of a CCJ being produced without even checking the age of it?.  Had I not defended that action at the time they may well have got a default using a CCJ older than 6 years which could be a concern going forwards. At the time when I contacted the court to question the paperwork for a final order application the clerk suggested people don't get informed when companies apply for interim charging orders, they are automatic if a claimant has a CCJ and people only get contacted once a date for a final order application goes through. kind of begs the question if such companies can continue a seemingly backdoor method to attempt default action if un-defended if the initial application doesn't need to check the age of a CCJ?.
    • Hello!  Wondering if someone can help with this.  I suspect not but worth a go.  I appreciate the "contract is with the seller" line, which is what Evri has fed me but wanted to see if someone with experience in these things could suggest anything else I could do here.  I appreciate there are many topics about lost parcels - My parcels weren't lost, until the driver walked up to my door with them and then decided to make them lost/stolen... I'll summarise what has happened.  Wednesday of last week - Evri delivery driver stole / walked off with 3 of my parcels.  -  Arrived outside my properly, took photos (3 separate photos as its 3 separate deliveries) of the tops of the parcels (pointlessly zoomed in on just the labels, couldn't see anything else, other than a small piece of the pavement and a little weed, which doubly confirms it was outside my door as I can see the same plant), marked the order as delivered and walked off with them.  He's marked on the Evri GPS marked that he was outside.   -  3 different deliveries, from the same company (same boxes etc.), but 3 separate tracking numbers. -  Went through the Evri bot which opened a case on each tracking number.  I then phoned them and left a voicemail explaining what had happened. -  24 hours later had a canned response asking me if the packages had turned up and to check around etc..  I responded explaining again what happened and that they've definitely been taken. -  4 days later,  this morning, I get a response telling me to ask the merchant to refund me. I've responded to this message with a long email, repeating what I said, that I believe the driver has stolen these packages and that he took those suspicious top down shots of the packages, marked them as delivered without ringing or knocking etc.  I've said that I expect them to investigate further, but I gather they won't. In my several messages to them initially and later, I told them I don't care about a refund and wanted the parcels.  They contain some sentimental stuff, nothing of high monetary value, hence me going to this trouble.  I only paid £25 for the contents. I did contact the merchant when this first happened and they asked me to wait a few days.  They ended up refunding me despite me asking them not to and that I wanted them to escalate it with Evri because this appears to be a case of theft.  They didn't seem bothered - Refunded me and told me to go back to Evri and escalate it with them? So - Is there any way to compel Evri to conduct a proper investigation with this driver?  Search for my parcels? I have quite a lot of deliveries handled by Evri (not out of choice) - They used to have a fantastic chap and I rarely had any issues.  He has been replaced by a new guy and I believe the route is handled by this same guy who I believe has taken my packages.  Naturally, I fear this is going to happen again in the future if no investigation occurs. Appreciate any assistance - Thanks for reading. Al.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

In reply to your letter dated 11th August, I am willing to accept the offer, but not as a full and final settlement. I would accept it as part settlement and would be pursuing the rest of the money through the courts.

 

If the offer of £500 were a gesture of good will, as you claim, then I feel the process would have been resolved more speedily. Additionally, your offer was less than pragmatic. The legal advice which I have sought has confirmed I will be entitled to the entirety of my claim of £1025 (£945 + £80 court costs). Consequently, I am unwilling to accept an offer of less than half of this, with an agreement to not disclose to any third party, as a full and final settlement.

Na, just like every single letter I ever sent to my branch....was ignored! Including once, when they didn’t bother paying a direct debit, despite me having the money in my account. This cost me £100. To get this back I ended up sending about 10 letters by recorded post, 5 faxes, and countless phone calls….all ignored!

 

Think my branch was incapable of outward communication!

The thing that REALLY GETS ME, is that my branch was really REALLY good when I first opened my account. I have only been in the UK for 2 years and RBOS was the ONLY high st bank to offer me a current account right away.. I feel loyal to them in a way.. but all it took was wages paying in late by 2 days to spiral into 750 quids worth of charges... For them to not even respond to my letters really irks me.

 

I am addicted to these threads! BC you are about a month ahead of me so always keen to see how you are progressing..good luck everyone!!!!! :) :)

my branch are absolute jack asses!... completely incompetent!... every1 I know who had same branch has swapped (about 5 ppl)… took me over a year to get that £100 back, and why the hell didn’t they pay the thing in the first place? They’d ignore my letters, faxes etc even though I knew they’d received them. Sometimes they’d say they hadn’t received them, when they’d done something like change my address, which I requested at the end of the letter they never received. They’d never phone me back when said they would. The person who finally dealt with it promised compensation for my time, effort and frustration…. Of course this was not acknowledged in the end!

 

This is in addition to the numerous charges, like £70 for going over my overdraft limit by less than a fiver, again for card misuse for one of those, less than 50p card, verification things for pay pall and other times when going over limit, then not paying direct debit for my rbs credit card, so another charge, then charge for credit card direct debit not being paid by credit card, then late payment charge, then exceeding limit on credit card so another charge.... so total of 5 separate charges of about 30 to 35 each for basically one transaction!...

 

 

 

Hate rbs with an absolute vengeance!... hope all these Cobbetts fees and refunds (eventually) give them a little taste of how it feels!

 

 

also missm, if you've got contract saying you will be paid on certain day each month, if your not paid on that date then itd be your employer who's liable therefore has to pay any charges incurred....speaking from experience

I started off with the main branch in Manchester and they just proved too big, when I left Uni I joined my 'local' branch that looked after my old man's account and seemed to have real (and decent) people running the Branch, but that was 10 years ago, things have changed drastically since then and the Managers are so hamstrung by red tape. I do feel a degree of loyalty to the branch because they have helped me out of a few holes in the past, but I'm not up against the branch anymore, I'm up against the corporate rule makers who are only interested in profit and loss and don't really care who they make their customers feel.

1. What is the timescale of them submitting defence is everyone experiencing this on the 28th day ?

 

2. How soon after this to they send their defence to you (most examples show this as being within1 or 2 days )

 

3. How soon after this does the allocation questionaire land ?

 

4. What is the time allowed for return of the AQ (DOES IT SPECIFY 14 DAYS ?)

 

5. what sort of period of inactivity are we talking after returning the AQ before something else happens ?

 

 

I am interested as this will assist current and future claimants.

yep!... acknowledged on 14/6, defence filed with court on 11/7

yeah got it shortly after, got defence from cobbetts first, then got copy shortly after from court

 

3. How soon after this does the allocation questionaire land ?

 

mine came after defence from cobbetts, few days after, with copy of defence from the court

 

4. What is the time allowed for return of the AQ (DOES IT SPECIFY 14 DAYS ?)

 

its about 14 days, it gives a "last date for filing with the court office" on the AQ

 

5. what sort of period of inactivity are we talking after returning the AQ before something else happens ?

 

it was about 5-6 weeks till they sent me an offer....from what i gather its a very similar timescale to stacey mason....im a few days ahead of her in the process

started MCOL at the beginning of June...it takes a long long time!...Cobbetts drag everything out as long as possible!...ive got my court date now, so expecting them to drag out the different offers (had 50%, so expecting my 90% and then 100%) spread out up untill Nov

I think if you go back to the poster original set off times you will see.

 

It can be anything from 2 to 3 months

Furthermore, following a recent conversation with my friend who is the student president at Manchester University, he has asked me to give him information regarding my experiences with RBS. He is preparing an article to publish in the student magazine for new students on people’s experiences with their banks and was very interested in my story.

I haven't had the pleasure of dealing with cobbetts's YET but i say go for it might just be the kick up the ar*e they need lol

Hi David! I had a similar idea when claiming against the RBOS of adding to the LBA that I was providing the story to a student magazine. It sounds good and will be interesting to see if it makes any difference! Only downside is it seems lat ein th eday to mention it, ie they may wonder why you have left it thi slong to mention!

yeah i know...also... it is actualy true...apart from the fact i brought it up and suggested it to him, rather that it just cropped up in a conversation....

 

think RBS' student market is vast!...have 3 branches within 5 min walk of all 3 (now 2) main unis in manchester....

I'm not sure how they will view this, it may be regarded as inflammatory and we should be careful of anything that could be construed as slanderous. I'm not saying don't do it but just be very careful what is said and what is printed. It may be worth going down the line of recapping MSE's show and advice against all banks and have your 'story' as an anonymous experience. Be interesting to put some other experiences out too. Or get your man to do an article on MSE and CAG.

my timescales are very similar to Davidhannams, not had the AQ returned yet, but Cobblers are 11th hour experts and seemingly very predictable with the defence letters too.

hey, na, no more contact....think they're gonna drag it right out untill just before the court date before giving the full offer.....dont they realise if they offered it sooner, without being as awkward as they possibly can people would be so much happier with them and theyd retain their business....just looked at ur thread, seems like ur just a little behind the well troden route lynsey bourgoyne sets out for us!
