hi all

due in court in the morning, heard nothing from the court, I did get a letter from 1st crud a week ago, saying they had asked their client for the credit agreement.

They also said once it was sent to me that I should call their office with immediate payment.

Do I need to take anything with me tomorrow.

thanks in advance

mike

Hi Mike,

Have all relevant documents, letters, etc sorted so you can find anything quickly if required.

As no Credit Agreement has been produced, and assuming they don't turn up with one tomorrow, you'll be asking for the SD to be set aside in accordance with your submission on form 6.5.

Present a reasonable schedule outlining your expenses, lost wages for attending court and time spent in preparing your defence, and ask the court to make an Order for Costs in your favour on the basis that the SD should never have been issued without the Credit Agreement.

Let us know how you get on. :)

We could do with some help from you

  • 4 months later...

Talking of my thread

I got a signed credit agreement in the post today and some accompanying files showing dates of transactions and payments. Also a request to respond in by paying in full within 7 Days

I thought they had only 7 days for this stuff not 7/8 months.

What should I do, should I respond or not?

Thanks

Mike
