      Because of the tsunami of cases we are having for this scam site, over the weekend I had a look at MET cases we have here stretching back to June 2014.  Yes, ten years. MET have not once had the guts to put a case in front of a judge. In about 5% of cases they have issued court papers in the hope that the motorist will be terrified of going to court and will give in.  However, when the motorist defended, it was MET who bottled it.  Every time.

      Hi everyone, Thanks for the responses. Just a few follow up questions in light of what's been said:   If I dont appeal to PPM, who can I appeal to?   Why should the PCN been attached to the windscreen? Is this written in law?   I assumed the document I had received was the NTK, if this is not the case, what does a NTK look like?   Regarding the compliance with the Protection of Freedoms Act, could the "period" of parking not be argued either way? The legislation doesnt state it must have a start/end time of parking, which I assumed an ANPR camera would pick up if it had one. Is 4 minutes not technically enough to show the vehicle was parked?    Thanks !

      You will probably get a couple more reminders followed by further demands fro unregulated debt collectors with even increasing amounts to pay. They are all designed to scare you into paying.  Don't. It's a scam site and they do not know who was driving and they know the keeper is not liable to pay the PCN. Also the shop was closed so they have no legitimate interest in keeping the car park clear. So to charge £100 is a penalty as there is no legitimate interest which means that the case would be thrown out if it went to Court.  Keep your money in your wallet and be prepared to ignore all their letters and threats. Doubtful they would go to Court since a lot more people would not pay when they heard  MET lost in Court. However they may just send you a Letter of Claim to test your resolve.  If yoy get one of those, come back to us and we will advise a snotty letter to send them.  You probably already have, but take a look through some of our past Met PCNs to see how they are doing.

      Hello,

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

      We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

If they really wanted there customers to stay with them they would have refunded the charges long before this got to the supreme court.

Here's the reply from the BBC on my request that Democracy Live cover the Charges decision live and in full. (I hope this means the BBC News website will cover the full works and not just the first 10 minutes.):

 

 

Thanks for your email. I understand the BBC news website will be carrying the bank charges announcement live tomorrow morning and will, no doubt, attract a sizeable audience.

More generally, it has been decided that the Supreme Court's proceedings will not be contained within Democracy Live. This is based on the fact that the court is now totally separate from government and the Houses of Parliament, whose proceedings are at the centre of the site's remit.

I stopped reading here (10. All of the banks who don't happen to have shares owned directly by the taxpayer should be directed to pay up too, because they wouldn't be here without the system itself, within which they fortunately survived, being bailed out. )

As far as the banks that we are responsible for at this moment are concerned—Northern Rock, HBOS Lloyds and RBS—we have asked them to review their overdraft charges over the past few weeks in order to be fairer to their customers, and they have done so. Under the Financial Services Bill, which is now before the House, a damages fund will have to be set up by banks to deal with complaints by customers of overcharging. There is now the possibility for class actions to be taken in court, which could not happen before, so that a group of customers can take banks to court. There is now power given to the Financial Services Authority, for the first time, to impose settlements on banks to repay customers they have overcharged. The proposed legislation will strengthen the rights of customers, as we have sought to do over the past two years, so that they get a fairer deal from the banking system, as they should, in this country.

this is so shocking. I've been away from this site due to an injury for a couple of months, and when i come back all hell's broke loose! Gotta be able to read up on all this now....

 

I do tend to get a little paranoid that's because I actually am paranoid.

I am not taking it out on the site when I actually am.

 

If that makes sense.

 

Its hard not to belive some of the things the bank say because I used to work for a one. And this thing has taken so long to get this far its unbelievable.

 

I don't understand how some people can exercise restraint.

 

My objection recently to the way things have been played are that the bank had a waiver on and we should of attacked that but its pointless getting uptight about it now.

 

I went to Lloyds TSb and lost my case because I did not do my claim right because I couldn't handle the pressure so I am using a solicitor and reading this site so I don't sound totally stupid when I meet her.

 

Any way I've read the thread Bank Fodder posted and it came in useful talking to my Key worker on the Ward today. And it may help me explain things to the consultant psychiatrist tomorrow before he allows me to proceed.

Dear Denis Murphy,

 

I am writing to you in you're capacity as Minister of Parliament regarding the unfair inhuman degrading bank service charges regime.

When applied as an implied breach of contract.

 

I and many others agree that if a settlement in the current test case is reached and the banks are allowed to charge for an overdraft, this would be a fundamental breach of our Human Rights.

 

This would eventually take power away from the consumer and this would not be the policy of the Labour Party.

 

The supremacy of law, means that the law is above everyone and it applies to everyone. Whether governor or governed, rulers or ruled, no one is above the law, no one is exempted from the law, and no one can grant exemption to the application of the law. If this is not taken into account your constituents including myself may suffer financial hardship and further Mental Health issues.

 

Article 3 of the European Convention on Human Rights prohibits torture, and "inhuman or degrading treatment or punishment". There are no exceptions or limitations on this right.

The Court have emphasised the fundamental nature of Article 3 in holding that the prohibition is made in "absolute terms ...

irrespective of a victim's conduct."

 

I write asking you're support in this situation and my fight against these charges and look forward to a prompt and full response.
