Hi Everyone,

 

Just a quick note to say hello & that I came to the site specifically to claim back from the Yorkshire bank but thought while I was at it I may as well tackle the Abbey too for myself & my hubby. Not huge claims but I'm all fired up against the injustice of it all now so no way I'm letting them off the hook.

 

DPA's gone in the postbox today :D

I stand corrected, I've just totted up from the transactions available online. Dec 05 to present day comes to £331.22, I had no idea how the odd thing here & there could mount up :shock:

Thats exactly what i thought, i added up 5 months of statements from last year and it came to £750 just waiting to add up the rest! :roll:

Abbey-received DPA letter on 13/03, received some breakdown till 2004 waiting for the more recent ones(where most charges occurred)

sent reminder email on 17/4/06

called abbey on 19/04/06 to remind them:rolleyes:

sent another email on 26/04/06:mad:

Approx charges £2500

received £500 refund in dec 06

sent LBA

Capital one- sent DPA letter 17/03

Sent prim letter for charges of £260 14/04

Received a refund £109 awaiting further refund of £151

Settled IN FULL

Barclay card- Sent DPA letter 17/03 sent reminder 14/04

received info claiming £120

settled in FULL

Hubby & I both received letters this morning saying that our requests had been received & had been passed onto the admin dept for action as our statements had been archived & that they’ll send them to us “shortly".

It is far too gentle.

I suggest that you remind them of their duty under the DPA and that failure to comply amounts also to a breach of contract and this may be included in any future claim against them.

Thank you for your kind letter informing me of what is happening to my request & I have every faith that you'll get the info to me well within the 40 day limit (which incidentally began on Mon 13th Mar & your failure to comply would be a breach of contract which I would act upon expediently).

Just a quick note to say I phoned Abbey on Tue to ask how much longer my DPA request would take to process & was told they are taking the full 40 days at the moment...... I guess they must be very busy. I hope all the DPA requests turn into claims :D

Recieved what now seems to be a standard response from Abbey stating that some of the records we requested have been archived & need to be specially retrieved.

Abbey twighlight zone alert! After receiving the letter about needing more time yesterday the info (in full) has arrived today. I don't think they have a clue what's happening.

Got info through for 2 years but pre 2 years ago would take another 40 days.

 

As I'd been a very good & organised girl before the start of last year I've only gone backthe 2 years & have sent off my request for refund for £547.

 

Have to say the amount really surprised me. Genuinely expected it to be less.

BTW - They've closed my hubbys account!

Did they give you the necessary notice period, if no back to court ;)

 

No notice period at all Rich, just a letter saying send your cards, cheque book etc back. He hasn't had any money going into or out of that account for months now so that'll be why they're getting shirty.

Doesnt matter they still cant just demand all your stuff back and close the account in that way sounds like retaliation for the action to me might be worth a complaint to the OFT

Exhausted all correspondence & rasoning with Abbey. Will begin moneyclaim process on Tue. Abbey have now, without warning, taken away my £100 overdraft. I'm VERY annoyed with them.
