      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I like to confuse them.....

When they ask me my surname

I ask them which one do they want

Maiden, Married, Divorced, Bigamist,

Or living in sin (Do you want his surname)

 

It only works for females I think

But Im sure one of you blokes can come up with something better

I am a bit angry though

I had a run in with Bryan Carters and was rude to the upstart who put the phone down on me ... Not one phone call since

 

I also had an abusive voice-mail from Abbey (MBNA) saying the matter was no longer in their hands and they will not ring me again

... Miserable sods....Why not....

My Credit Card was taken out eons ago with National & Provincial (It even had a photo of me on it)

Do you think they will have a CCA... I think not... Why dont they ring me

 

I am very disappointed... You peeps have given me courage... I even bought a printer ... And no-one hassles me any more :?

Here's a fun letter I had from Frederickson International recently.

Not seen one like this before.

I love the way they have listed places near to me, so I can pay them easily. :lol: I'm going to write back and complain as one place is a shop and not a post office. And the other post office closed down 2 years ago and is now a private house.

 

According to Frederickson's I have failed. :rolleyes:

DCA's - 0 Fuzzybobble - 34 doesn't sound like much of a failure to me. Frederickson's are soon about to be DCA number 35 that fell at the first fence. :D

 

I've been ignoring them for almost 2 months now. So this one is letter number 3. I suppose I'd better give them a call and once again fail to make an acceptable repayment proposal. :p

I'll be recording this one, as I have now sorted out how to do it. I noticed on their letter that they have nice little graphics of all the card types they accept as payment. What's the betting they don't accept my card? ;) I have a feeling they won't want to talk about bumble bees either.

 

If any DCA scumbags are reading this....Don't bother scanning the barcode, as I took the precaution of fuzzybobbling the barcode. :D

 

 

 

Ive got one of those letters in my HSBC file Fuzzie

I got quiet excited as I thought they had send me some sort of new-fangled payment card

I got the card punched out of the letter and had it laminated

Filled my trolley full of goodies in the supermarket

Gave my card to the cashier to pay with it and she would not accept it as I didnt have a PIN number :?

I hope you get a PIN number I didnt

 

 

The next I heard was a month later
