Hello.

Sorry if I sound a bit stupid. I'm pretty inexperienced. I asked Halifax formally for my credit card statements at the beginning of August. These people drive me nuts. They have to be the most arrogant and abnoxious bunch of people I have ever dealt with in my life. And that's saying something! I received nothing even though they signed for my letter. I rang up and gave them grief recently. They insisted they would send them through. I still haven't had them through. What I did get was a settlement offer of £221. I am going to insist on getting my statements. When I get them how do I work out what they owe me? They say it is the difference between £12 and what they actually charged me. Is this true? Do I add on interest? If so, do I have to work out the interest on each individual charge separately? I get lost trying to read long threads. Some simple answers would be appreciated.

Did you send the SAR letter with the £10 fee?

 

As your 40 days are up, you should now send the non compliance letter.

I think they will cave in on giving me my statements. I'm not too concerned about that right now. All my charges in this claim are solely for my Halifax credit card. They are over the limit charges and late payment charges. I just want to know what to claim when I get my statements through. Is it the difference between £12 and what they actually charged me? Do I have to work out the interest on each charge individually?

I can claim back all the credit charges IN FULL? If there is a £30 late payment charge I can claim back £30? Are you sure? Christmas has come early for me is this is true. I thought the £220 they offered me was paltry. With all the charges in full and interest I could be looking at £1000. Please just confirm this once more and you have made my day! Thank you kindly.

YES !! The full charge, I used the Simple myself, not sure what the difference is. Someone a bit smarter than me will tell you;)

Hi,

 

Just had a look at the spreadsheets. Just use the Simple, this gives you the 8%, I think the Advanced is for claiming more than 8%.

Firstly, never believe anything the Halifax tell you, generally it is utter rubbish or lies. Keep everything in writing, don't speak to them on the phone. They are very, very slow but as long as you have put the account in dispute in writing then the onus is on them to respond, no matter what else they send or fob you off with insist on the statements and add the charges up yourself, keep all the rubbish they do send and tell them you have it on file as part of the evidence you may ultimately present to the FOS and the court if they continue to fail in complying with your wishes.

Scott is right, you just need the simple one.

 

Also when you fill it in, all you need to put for the reason is "charges as notified" as that is all they put on the statements, but you DO need your statements so you can get EVERY PENNY back.

 

ALL your charges can be claimed back. Of you have any worries just ask, as you have seen there is always some one around to help you. :D

Well after nearly 4 months I got my statements through. It took several follow up phone calls and letters though. They really are the pits. They laughed at me on the phone and told me I didn't have a clue what I was talking about. I stuck to my guns though. My wife wants to claim back her halifax charges too now. She had a bank account and 2 credit cards with them. How does she go about her SAR? Does she send to have send off more than one? What address does she send it to?

Im glad to see you got your statements, now the fun bit starts. working out how much the charges total up to..:D

 

As for your wife, she needs to send the S.A.R - (Subject Access Request) letter, but just the 1 fee will cover it. Just make sure you put all the account numbers on the letter.

i did not know my loan details, so just sent a standard letter to my local branch to ask for details - i roughly knew the year and how much i was paying. they forwarded me the details, then i applied for a SAR -AND WON £2,871!!!!!!!!!!

HALIFAX: PRE 6 year claim 1991-2006 WON 21/3/07 £2616

CAPITAL 1 - WON 19/3/07 £800.22

CAPITAL 1 - WON 19/3/07 £325.75

AQUA - MCOL 2/3/07 £172.79

ABBEY - MCOL 2/3/07 £261.37

HALIFAX VISA - WON default removal 19/3/07

Most of the time you have to send proof of who you are, ie, bills with her details, a driving license or passport. You might be able to do this in your local branch.

 

Now you have worked out your spread sheets, you need to send the prelim letter, and include a copy of the spread sheet.

 

You then wait 14 days and send the next letter, the lba.

Yes if they offer you the money before you file at court you cant claim the 8%, but the likelihood of that is very slim.

If they pay up immediately. Aye! and pigs might fly. Know what you mean. Sounds like the obvious thing to do. Would save the Bank the interest but they like to play silly b**gers, and drag it out as long as they possibly can. Don't know if you can claim the interest before going to court, your always advised not to.

I have seen the sticky thread with the Halifax contact details for prelim letters. I just wanted to check if it wasn't better to send my claim to their Dunfermiline Card Services address, as it is only related to my credit card? Everything is ready to go first thing in the morning. Also, is recorded delivery ok or shall I go for special delivery?
