    • Interesting question regarding what Government accounts opposition parties have access to, before an General Election. From what I understand, Government department accounts that are published are always lagging behind and would not include some amounts which are classified as 'commercially sensitive'.  Therefore opposition parties and Parliamentrary select committees would not have access to accounts which contain real time up to date information. If a new Government have found £20 billion of spending liabilities they did not know about, this could be true, as £20 billion is not that much when you look at total Government expenditure. Government department are making decisions on spending all of the time and it could be the previous Government were planning tax changes and/or spending cuts to balance the books.  Jeremy Hunt has recently said that if the Tories had stayed in Government and held an Autumn budget, it would have been very difficult to cut taxes as some had wanted.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

These are in house collectors fro RBS and have also tried to harass me into paying extorniate repayments on an ulster bank Credit card that I am currently awaitins SAR request to see what charges I can claim back.

 

I would not enter into conversation wilth them on the phone as they are bullies:mad:

I had all sorts of problems with Triton (who are in house collectors for Natwest). It took nearly a year to get things sorted. After writing god knows how many times, and several phone calls were no one seemed to be able to doing anything concrete, I actually wrote to Natwest and complained about Triton. They replied informing me they were launching a full investigation. After another month or so, Triton wrote to me and agreed to accept the repayments I had offered at the start of it all (nearly a year). I have not heard anything since, and my repayments have been paid on time and accepted. My advice is as always stick to your guns, and if you have any problems, contact this initial creditor, as these tools are only in house. It had the desired effect for me!

 

By the way, the address I had for Triton is: PO Box 183, Telford TF2 2BU,telephone 0845 301 5137, but as I mentioned this was a Nat West account.

Hi

You are so right about them being rude thats not the word for them!!! I was passed on to them by Natwest as due to being on mat leave i had a big drop in salerly. I offered Triton a resonable offer of payment of £60pm but they declined said they wanted £280!!! I have now received a letter from them saying they are dissapointed with me and will be seeking legal proceedings!! How can they do that when im willing to pay? Absolute idiots!!

Yep, all sounds oh so familiar! The people at Triton are just screen reading robots. All they seem to ask is "how much are you going to pay today", over and over and over again!! Like I suggested, write to Natwest directly, and inform them of the offer you have made, and lay it on nice and thick about Triton being totally unhelpful, nobody seems to know whats going on at Triton, they wont accept any offer, they are wasting your time on telephone calls and letters etc. With me, Natwest came back and said they would investigate, write to Triton and let them know you offer again, and I am willing to be it gets accepted. Hi,

I have recently recieved a letter from royal bank of scotland saying that they have passed my debt on to Triton Credit Services, I have tried calling Triton Services with the number given and other numbers given from other sites, but cant get through to them?

Does anyone no if having a credit card debt is different to a loan debt? Not sure how to go about this, never been in debt before, can anyone help?

I havent spoken to Triton before (no answer) but havent heard good things about them, can anyone please advise me on what to do?

Not sure why you would want to speak to these 'people' though - they will contact you if they need to

 

I would insist on keeping everything in writing - they are less likely to bully that way.
