    • Morning, So the finance company is Warrenties2000. I have just sent a copy of the rejection letter to them too. So now they have it as of today, and the Big Motoring World have it as of yesterday. We still have 2 days left out of the first 14 days. The report is not a report, it's an email thread which the mechanic forwarded on to us. it shows that he did send the email to Warranties2000, their reply, and then his reply to them. This is the email that Warrenties2000 have said they've not received. BMW said the diagnostic test usually costs £100 but they have offered to pay £70 of it as a good will gesture. We have told them over the phone that we're not paying any of it. We are 8 miles away from the dealership. We have had 8 days of use of the car and on the 9th day it went to the garage. The garage found the faulty battery and faulty gearbox about half an hour after we dropped the car off.  I've just messaged my husband to tell me who we got the finance from as I don't know. He handled everything with the car.  The extended warranty was £1800 over three years and that was with Nissan I think. My husband contacted the Nissan warranty people yesterday and he said they're raising a complaint on our behalf. I will check with my husband to see if he has cancelled the warranty, I'm sure he has but I will check. So update from yesterday. My husband has cancelled his car insurance as of Friday as the car is undrivable anyway. I'm going to the car today to get our other bits out if the boot.  I have enclosed the details you have all asked for.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I'm nervous about this!! sent my letter today to request 6 years statements but never done anything like this before I am worried as I was made redundent about 5yr ago and resulted in fin diffs they hit me with charge after charge, charges sent me over my overdraft then i was charged even more can they use that against me and say it was my fault??

Although HSBCrusher has given me the movitation not to pannniicccc!!!:eek:

Received a letter on thurs saying statements would follow and my £10 chq back, then millions of statements came this morning :eek: !! am guna go thru em tonight and see how much im owed so will keep you posted!!

 

A question tho, do i send a list of the charges with the prim req what there for etc or do i just send the letter with the total??

i would recommend sending you're charges breakdown with your preliminary letter

I think you may find that they aren't ignoring you - I can imagine they are receiving mountains more mail and not simply getting to it to action in time he he!

Les Gunn was right they weren't ignoring me I rec a letter on friday offering me £100 less then wot i'm claiming for! but I sent my lba last weds, should I wait and see if they respond to the lba or send a letter to say I accept this as partial payment? or should i just take the money and run!!!! :p
