  1. Hi staffylou I'm sure with the help and advice on here that you'll have a successful outcome. I attended two repossession hearings with a friend, one for the mortgage and the other for a secured loan. I've never seen anyone as scared, but the relief once it was over for her was unbelievable. The Judge was very nice and it was over in 5 minutes. Once the judgement was made she said it felt like the stress of the last 12 months had just disappeared. Obviously she has to stick to her repayments, but she is no longer hassled by the mortgage company on a daily basis. If you can afford your monthly repayment plus a little towards the arrears then you've a really strong case. Do you have dependent children living in the property? Stay positive:) jaxads x

You will be able to defend their claim for possession provided you can maintain your monthly payments plus a small amount towards arrears.   6. Raymondo - Welcome to CAG. From reading your post you say these things may happen if it goes to court. Who are the recovery agents? Is the fee for £80 and is this the first notification you have had? They seem to send out a few - you will probably get a letter soon offering you the chance to repay in instalments that are manageable to you and therefore stopping it going to court and incurring further charges. (Or you could contact them and offer repayment over several months.) I hope this helps.

  8. Can DCA's be reported to them or just the financial institutions themselves. I'm shortly to be reporting a DCA to Trading Standards and OFT, but just wondered if I could also put in the FOS?? I'd love to think it could eventually cost the DCA £500 :D

  11. Dear Nattie -- I remember you helped me at the beginning too - for which I was (and still am) most grateful! I think it's dreadful the way you've been treat - especially given their new tv campaign -- but then we all know that they all work more like the "introductory biscuit" advert that the Nationwide put out!! I wish you all the very best for the future whatever you decide to do x The banks will one day soon get their just desserts.
  12. Hi Paul Ell-enn is usually around the repossession forums and I'm sure she'll be along soon to offer you some fantastic advice. I was in court with a friend recently who had to fight an eviction date - she included the "Norgan v C&G" case in her statement and she didn't have anyone representing her (just me as her friend!!) The Judge was absolutely fine and didn't even refer to it. I understand Judges are under a directive wherever possible to keep people in their own homes!! As Jansus asks, are you able to afford your mortage payment and a little towards the arrears each month? How long is left to repay your mortgage? Please try to stay positive - I know this must be a really dreadful time for you x

Well, its more than obvious yet again that one desk doesn't know what the other is doing One letter received from GLENIS GLOVER at RED saying one thing Another from SAMANTHA SWALLOW at LOWELLS saying different Glenis Glover and Samantha Swallow --- they've got to be fictitious!!!! Needless to say, they're getting a letter right back telling them what's what:p and I could sign it Cathy Credit or Mary Megabucks !!!
  15. Hi Mad Mick Don't panic. As Pathway rightly says, it is a scare tactic and they more often than not do not send anyone out, but if they do, just tell them that you are not prepared to discuss the account with them and that any correspondence must be in writing. It's a bit much sending you a calling like that when you are only one payment behind. Do you have any charges on the account that you could claim back?? If not then you could send them a CCA agreement request to see that they have the necessary paperwork in order to collect on the debt. Best wishes.
  16. Good luck Mike - what a dreadful thing to have happened. I cannot believe it!!! It's their fault that they missed scanning it anyway, and as you say, as soon as you got home you rang them to sort it out and then went in to pay for it. He's obviously thought he could make a name for himself - well he certainly has now. His bosses will be delighted to receive the Solicitors letter. I hope that their investigation shows that muppet of manager up for exactly what he is - a jumped up little nothing:mad: Best wishes x

  20. I'd be tempted to write to them, tell them you've redone your income and expenditure figures and can only afford, say £10 a month. The £30 seems like a lot. Then you can send off your CCA agreement requests which will probably put the accounts into dispute - thus giving you a little more breathing space. Also I think it would be a good idea to cancel the direct debits. You don't want them having access to your bank account!! If you are going to pay them, say £10 a month, get some paying in slips from them. That way you are in control and not them!!! I used to be petrified if a DCA rang me and almost in tears when I received a letter. Thanks to CAG I'm not any more. I actually look forward to ringing them -- but only because I like to wind them up;). The more you read around this site the more confidence you'll gain. You'll get there - stay strong and follow the excellent advice on this site. Best wishes.

I cannot really give you any advice (but do offer moral support), other than to say I know the situation you're in and that the wonderful Ell-enn will hopefully be around soon to offer you some advice. I have read on the forums that judges have a directive to try to keep homeowners in their home if this is at all possible, so if you can show that you can recommence payments I'm sure they'll be sympathetic to that. Stay positive.
