  6. Hi - am starting this new Cabot thread. The alleged accounts were originally Bank of Scotland, then passed to Blair Oliver & Scott, then Moorcroft, then EOS then Wescot -- and finally purchased by good old CABOT. I originally started this thread as Bank of Scotland, but its ages since its been updated and its been passed about so many times, that I thought I'd start it again. Basically there are no credit agreements. Bank of Scotland as the original creditor couldn't provide them, neither could: Blair Oliver & Scott Moorcroft EOS Wescot and CABOT. So, in August last year they wrote to me saying : "If you don't responde now, one of the following options will occur: WARRANT OF EXECUTION CHARGING ORDER ATTACHMENT OF EARNINGS ORDER ORDER TO BOTAIN INFORMATION - you will have to attend Court to be questions under oath by a Court Officer. AN EXTERNAL DEBT COLLECTION AGENCY CALLING ON YOU. Now, They were going to do this, without any paperwork to back up the alleged accounts. I think not - I wrote off and told them so and the account has been on hold since August 2008 - so I'm now going to poke them with a big stick and tell them I want the matter looking into again and if they cannot come up with the requested paperwork that I want the files closing!! Lets see what I get back
  7. I've been waiting for my cca's since they put the account on hold last August!!! I'm going to write to them today to request that they either send me the agreement or close the file (there is no agreement as is been passed from Bank of Scotland, to Blair Oliver & Scott, to Moorcroft, then EOS, then Wescott and finally bought - without paperwork me thinks - by good old Cabot. One of the letters I received last year said "if you don't respond now, one of the following options WILL occur: A Warrant of Execution A Charging Order An Attachment of Earning Order An Order to Obtain information An External Debt Collection calling on you ---- bit of a nasty letter considering they don't have any paperwork and can only do any of the above with a court order How many people would be scared silly reading a letter like that? Anyway, I am about to write now telling them where they stand

  9. Unfortunately it doesn't work with LINK FINANCIAL either - they say they are a telephone based organisation and don't send letters (although they did have to write to me when they couldn't find my cca agreement:D). Even though they've no agreement, I still get the odd phone call!!
  10. With gift receipts from Next and M&S you get the amount paid at the time of purchase. I think Debenhams have definitely made a mistake somewhere
  11. Hi Weeble - welcome to CAG and well done on getting so much of those debts paid off. Are the majority of your debts still with the original lenders or have they been passed to DCAs. I would be inclined to send off CCA agreement letters to all of your creditors. The letter requests they send you a copy of the original signed agreement. If they have the agreement, and it's enforceable I'd then be inclined to offer them a starting figure of 30% of the outstanding balance (you can always negotiate). If they are unable to send you the agreement (then no agreement = no enforceable debt, so whilst the debt still exists they cannot enforce it!) In that case, I'd either make an offer of 10% or tell them to get lost:D Keep everything in writing and send all requests by recorded delivery. These requests cost £1 per account. I know it costs a little extra, but I'd send postal orders - that way they don't get to see your signature on your cheque . Also, print your signature on the letters and don't sign anything!!!
  12. Hi dpadm - You could always send them a CCA request. That asks them to prove the debt by producing your signed agreement. If you send that they have 12 (+2 days for posting) in which to respond. If nothing else, this just gets them to hold action for a couple of weeks. Depending on their response, and whether or not they have the agreement, will then determine how you response. ie - no signed agreement no enforceable debt (the debt still exists, just they cannot enforce it!)   13. Hi Teldave I went all "goose-bumpy" after reading your last post. I'm delighted that you're feelilng better and more positive. You'll soon start to feel "in control" and things WILL get better. When you start to get replies to your CCA requests, post on here and let us know what they say - the "experts" can then guide you further.   14. It won't do them any harm to let them know that you're recording the call Ask if possible that they send the statement of account to you in the post today.
  15. Hi 4dam I responded to your pm!! Telephone LBL (dialling 141 before their number to keep your number anonymous!). Request a full statement of account in order that you can see exactly what payments / charges have been made and most importantly what they received for your car when it was sold at auction.   19. Hi Dave Did you have any charges on the account, ie for late payment, default, telephone calls, etc? If so, you can claim them back. I did but only started the process once I'd received the log-book back and confirmation that my account was repaid. Best wishes.

  21. Hi Starbar, My account was with bank of scotland and they passed to Blair Oliver & Scott (their own in house collectors). I used to be terrified of them until I found this site and stood up for myself. Once they couldn't produce the CCA, they passed the account to various other DCAs and thanks to the letters on this site, they had to then keep passing it back to Bank of Scotland due to the lack of an agreement. They eventually sold it to Moorcroft (what makes them think they can succeed I don't know) and I've been corresponding with them for a few months now!! That is just what happened to me -- and after all this time ...... still no agreement. Poor Moorcroft, buying an account with no paperwork

  23. Yep - moorcroft tried that one on me too with BT. They wanted an extra £23 so I paid the bill direct to BT and they got NOTHING!!! A few months later I got a Moorcroft threatogram and I telephoned (YES, telephoned:D) to give them the joyous news that as far as I was concerned the bill was paid months ago, in full, to BT!!! All those letters and red ink and they didn't get a penny out of me Fuzzybobble, I listened to your "you've been fuzzybobbled" on you tube. Absolutely hilarious - put me in a great mood for the rest of the day xx
