  1. Mine had a dent in the front number plate and scraping to the front bumper. It wasn't there when they took it, and I didn't notice it until the day after, they'd returned it - but where it was parked at home, there is no way the the damage could have happened whilst in my care The agents who took the car did return it free of charge -- if you can call it that!! They said they'd hold onto the car at their premises to give me time to get the funds and then return it to me, but for me to tell logbook loans that I'd be collecting it myself. Because if they were delivering it back LBL would slap on another £100 in delivery charges!! They said at least it would save me an additional expense -- ah recovery agents with a heart!!). They returned the car within a couple of hours of me paying LBL - and with half a tank full of petrol (there wasn't any in it when they took the car!!) It makes you wonder though if they're told to inflict damage on the car once they take it!!!! I've replied to your pm

  4. Hi whispers - I replied to your pm What rate of interest are you claiming ? I didn't claim the intersest in my first letter, but indicated that if they refused to repay the charges that i would go for contractual interest at the court stage. After the agreement number, write "balance £0.00 - accountcleared"

We obviously attach everything to the N244 - do we just need to hand in one copy. Also the N244 - does that mean only one person need sign it?? This is what I've answered so far 1 Both names 2 Defendent 3 Suspension of Eviction Order 4 No 5 At a hearing 6 15 mins 7 N/A 8 District 9 Both Parties 10 See attached statements - is it necessary to sign the statement of truth at Q10? Again, only one person need sign?? 11 Does only one signature need to show, ie the person handing in the form and not both signatures Sorry, to bother you again -- just need to get this right!!
  10. Hi Ell - I think she must be 2 instalments out although not exactly sure, will try and clarify. Also, as you can be given an appointment with the judge at short notice when you had in the N244, do you know does that mean that there won't be a representative from the "other side" there??
  11. Hi Ell-enn Thank you so much for getting back to me. Right I've her figures here so hopefully this will help: She should have been paying about £380 per month, plus £100 arrears. Has been paying £500. January's payment had reduced to £360, still paying £500 so that's an extra £40. It set on keeping repayments at £500, thereby paying that little extra off the arrears than has been ordered. She wrote to lender (Nationwide), but they said that they would have to have full arrears paid off by eviction date, or apply to the court for a further suspension. Joint names and three children. I&E are already done. Other properties in the area, due to economic climate as all over, have not been selling well. One last thing, do you know the cost of submitting the N244??   12. Dear All I helped a friend last year, with much help from Ell-enn:) to get a suspended possession order. However, she missed a payment last year and she now has an eviction date for next month. I've downloaded a N244 and would ask if Ell-enn could please help with question 10. Basically missed a payment due to another large repair bill for the car (car is now 6 years old but is almost brand new due to the amount of new parts it's had fitted!!). She made payment as usual in November, but December and January's payment has effectively been made. Has three young children, but can foresee no future problems with the car, and I&E looks good. Suspension granted on paying normal payments plus £100 and she has been paying in excess of that for the last 3 months - just rounding the figure up. Ell-enn, what do you think the chances are. I was hoping to perhaps put something in the Q10 section about the houses not selling in the area at the moment (1 in the street for sale 10 months another over 6 months) and perhaps stating if she could just prove, say for the next 6 months that she could meet the payments would they give a further suspension. Advice would be gratefully received.
  13. Hi - please stay positive. Who has told you that the judge will grant possession straight away, it wasn't GE was it! That is not a true statement. You can complete a form N244, which you can downloand from the HMCS website. Ell-enn is a superstar when it comes to filling these in and I'm sure she will be around the forum soon. Please try not to worry, you sound as if you will be in a good position to repay soon once your current mortgage term ends. Jaxads x
  14. Hi Scooby - so you only have until the end of today to get payment to them or they will sell the car is that right?? What is the very least that they will accept from you in order to get your car back and resume the agreement ? Would they do that? What is your car valued at?? I know it seems like a lot of questions, I'm just trying to see if there's any way around this!

  16. Hi Dave - do you have a statement of account from them detailing exactly what was paid and what charges they added?? If not, you need to contact them and request a statement of account.
  17. Hi toto - many thanks. I've not done a POC yet!! I've been waiting for some time for the inforamtion to come through from Nat West. Now it has, I think that I've a good case to request the monies be returned as they were paid under duress and Nat West have no documentation and cannot tell me how much the original loan was for!! Before I write off requesting this, I'm just putting out the feelers to see what I might have to pay in their legal costs should it get to court and I lose, ie would I have pay only the sum to courts when submitting the claim forms - or would Nat West claim against me for their legal fees too? Basically, I'm trying to weigh up what I may stand to lose before I put "court action" in my next correspondence to them?? I don't want to threaten the action and then find out it could end up costing me a fortune!! Many thanks -- getting nervous now for the result of the FOS / Abbey case taking place today

I've been on the site for 2 years now -- so cannot count the amount of hours that i've spent reading through threads (it certainly beats the ironing and housework:D) and it's amazing the knowledge you can gain from this site!! I do have another thread re Natwest, but cannot find anything about the charges I could have to pay if I lost such a case, so thought I'd post in the legal forum to see if anyone here could advise. Basically, I'm asking back for monies I'd paid to them, via a third party, under duress, for which they have no documentary evidence (which they have confirmed). It's probably a 50/50 chance, so I just wondered what I'd be letting myself in for should I get that far and lose Best wishes.
  19. Hi -- can anyone tell me what sort of costs I'd be looking at, should it get this far, if I have to take Natwest to court:eek: It would be for an amount of about £11k so its pretty scarey and also, what costs would I have to pay them if I lost !! Any advice peeps xx
  20. It's just a waiting game unfortunately:mad: I believe the next significant date for the OFT Test Case is 26 January - so we may (?) hear something soon ????
