  1. Hi - I've just paid a CCJ and been advised that it has been marked SATISFIED. I've been told I can apply to have it SET ASIDE. What difference, if any, will having it SET ASIDE as opposed to being marked SATISFIED make?? Many thanks.
  2. I went to the petrol station, filled up with petrol, went to pay and found the "card" in my pocket (which I thought was my bank card) was my boots advantage card!!!
  3. The maximum these people can charge for their "service" is £5 - so you are therefore entitled to a refund of £44. Write to loanfinder and tell them that they need to return to you £44. I did something similar a couple of years ago, but cannot find the letter now for the exact wording. Don't ring them up as they'll be rude and arrogant once you request a refund. Keep it in writing! Hope this helps.
  4. Hi - the arrears don't seem too high - what is your normal monthly payment and how much towards the arrears are you able to make each month? Also given that you're now in a position - having been offered a new job - to make regular payments, then hopefully you should be ok. Take all the information you can to the court with you (I take it you've already completed the N244 form in order to get the appointment at court). Have you also completed and income and expenditure form? Have you mentioned in your statement the Cheltenham & Gloucester V Norgan Case (in which the arrears were allowed to be spread out over the remainder of the loan term). I'll flag your post with Ell-enn who's CAG's No 1 when it comes to this kind of situation - she'll hopefully be around to offer you some sound advice. Best wishes.
  5. Hi and welcome to CAG. Well done on posting - it's scarey at first but you'll find that we're all a helpful bunch and will help and advise as much as possible!!! Firstly you need to request a full statement of account from Capstone, then you can see exactly what they are charging you and whether it is being added onto the arrears (it should not be!). In the meantime try and make the payments as you've said (try not to send payments that will bounce as whilst it may buy you a little time, it will also not look good on your payment record and you will incur charges for returned payments from both Capstone and your bank). What do Capstone charge each month for arrears? I know that GMAC have been forced to repay back 100000s in charges recently. Perhaps once you get the house "safe" again you can look into the charging structure with a view to reclaiming some charges. Post back when you've any updates and peeps on here will advise accordingly. Best wishes and stay strong x

  8. Hi Devlin - the arrears don't include charges do they?? I take it that they will have probably charged you for the privilege of being in arrears Don't think about borrowing more to pay off the arrears - that may make things worse in the long run and will be an additional repayment on the Income and Expenditure sheet. If you can make the payment tomorrow then that would look good and show commitment. When/if they go ahead with the eviction request, you will get notification of this hand delivered. You will need to defend that with a form N244. You'll need to have figures to hand, ie balance outstanding, amount of arrears, amount you can pay towards arrears, how long is left on the mortgage, etc. Also, you'll need to do an income and expenditure sheet to go with it. You could make a start by getting some of that information together so that if/when it's needed then you have it to hand and can get started on your defence. You can also do a personal statement, in which you can list the problems you have had which led to the further arrears. Stay strong, keep your chin up, get into "fighting" mode and more than anything - look after yourself and your little one:)

  12. Hi all - I haven't been on the site for very much lately, so hope all are well and keeping up the good work. Just a quick question - I've emailed Halifax this morning and am just wondering if they respond to emails?? Basically, I've sent them a letter in response to their 'get lost' letter following the OFT Test Case result. I wasn't sure if it would get there within the 8 weeks so have emailed them as well. Will let you all know how I get on - but just wondered if they respond to the [email protected] emails.
