Ive had a couple of serious Electrical Hickups on my 307sw, Had an instance when the car was parked on drive , the headlights would for no apparant reason come on, It took my dealer 4 weeks to sort this problem out with the replacement of the ECU units at a cost of around £1200.00. And more recently, over the period of about 3 weeks for no apparant reason the engine would limit the revs to 2000 revs, as you can imagine not a good thing if your overtaking etc, Only way I could resolve this was to dip the clutch and hit the accelerator, this appears to clear the limmiter for some reason. Peugeot had the car in for 3 days again and could find nothing definate that caused this to happen, they did re download the software to the unit and gave me tha car back to run it for a few weeks to see if the problem has been fixed. The guys in the Dealership here in Dundee are very helpfull, I always get good service, and I almost have my own Private Parking space there as the number of times My car is in there recently..lol Ian
  2. Hi Caro, Sorry about the delay getting back on this one, Just been busy taking the house back off the market and remorgaging etc etc.. Oh and have promised OH that I will fit new Kitchen in a couple of weeks..arghhh. I know that once the FSA started to regulate the sale of PPI, that any PPI taken out along with a loan had to be split seperately so that the actual cost of the policy and Interest on the PPI had to be shown seperate from the Loan. I am looking into this in more detail along with another issue I have with Lloyds yet again..lol. According to the CCA regulations too they have to show on the agreement the total charges for credit, GE did not show this on my original agreement, thet replied that if the APR was variable they were not obliged to state the cost of credit, Again Im still looking into this.   4. Go for the Interest.. You will get it back too, Just mention my name to them..lol ( Only joking about mentioning my name..) Long story bout me and Lloyds.. Call them up and tell them you will accept their offer as part settlement and that you will be claiming the Interest via the Courts if they do not refund it. Ian
  5. Hi Dave, as Hellhasnofury says, I am at court stage with GE Money over mis-sold PPI.. Submitted POC and AQ back to court some time ago, Of course they deny they did anything wrong and blame me for not readind the small print..lol. My claim with GE has been going on from about October but hopefully once the courts get their finger out I hope to hear pretty soon what Direction the case is to take. I Intend Small Claims but they are trying to say Small claims is not applicaple in my case, which of course is Crap. Again it is a scare tactic / bullying tactict as they are threatening to claim their costs from me.. No Chance..lol Have you ever tried getting a drink out of a Scotsman.. Every POC would be slightly different depending on individual circumstances etc, If you need help drawing up a POC let me know. Ian
  6. mmm A Verbal Agreement My %$£& .. That has to be one of the best replies so far..lol. Glad to say a Verbal agreement would not hold up much if at all in any court. It is unbelievable what these outfits will try to get you to go away and leave them alone..lol .. Re the Fraud question, For the avoidance of doubt claims for mis-selling of PPI can not be founded on the Fraud Act 2006. This Act is concerned with criminal liability and is therefore only applicable in the criminal courts. Go get em Citybloke

  8. The loan should have the following stated as part of the CCA. Loan Amount , Loan Interest(Charge for Credit), Total for Loan PPI Amount, PPI Interest (Charge for Credit ) , Total for PPI Total Advance Total Charge for Credit Total you have to Pay.

  10. Hi Mike, You will really need to go through their Terms and Conditions with a fine toothed comb to see what it states regarding self employed. Some polisies will cover self employment but I have found that they will only ever pay out if the company goes bust. The trend for these policies is to find any way possible not to pay out if you try and make a claim, which is ridiculous considerring the amount they charge you for these policies. You may get enough evidence if you submit a SAR and they do provide any recorded telephone calls, though you may find that on that particular day of you arranging the loan etc , there may have been a problem with the recording equipment.. As I say they will try and riggle out of complaints. Again too they will put the blaim on you for not fully reading and understanding the Terms and Conditions of the policy. And as you told them that you were self employed and they sold you a policy that does not cover self employed then they should be held liable for this. Hope that Helps Ian

Hi, Sadly I dont think you can go directly to small claims court on this one, before you take any legal action against a company you should be able to prove that you have at least complained to the company and given them a reasonable chance to sort the problem out before any legal action. If you were told at the time of these loans that PPI was a requirement to obtain the loans then that is a clear case of Mis-Selling, though as I have found some companies will defend this and normally come back with something along the lines of , you signed for PPI. I have been caught like this a couple of times, 1 Case has been settled but the other case has been ongoing from about October last year. I have not had any dealings with Citi Loans so I do not know how they will handle any complaint regarding mis-sold PPI, Maybe someone else in the PPI forum with Knowledge of Citi Loans will be able to help.   12. Hi Itsme, It could have also been that my claim with Lloyds re the PPI was sort of settled before the Brown sticky stuff hit the fan with PPI. It was only after my Lloyds claim was settled that I really started looking into PPI in more depth and started my campaign against GE Money (which is still going on and on..lol - Just waiting for the District Judge to get Directions for case). I know for sure I am not at all liked by Lloyds, through their latest correspondence and threats from solicitors etc, again this has still to be resolved, but lloyds have gone all quiet since my last letter to them. But then again I have another upcomming fight with them due to start in the next week or so..But will keep that under my belt for just now.. All these organisations will change their tactics as the issues with PPI become more aware to the general public, again I have been a bit quiet on this front but something is in the pipeline as soon as I get the court Date for my case against GE Money. It is know for a fact that Lloyds have been known to monitor CAG.. postings, thats why Im not saying anything about what is in the pipeline for them..lol Ian

Hi Sharon, you could use the following letter, you may need to change parts of it though, Customer Care Department Lloyds TSB Insurance Tredegar Park Newport South Wales NP10 8SB Re: account -------------- Your Ref ------------------ LETTER BEFORE ACTION Dear Sir or Madam, I am writing to reject the offer of a refund of £1968.01 which was made to me in your letter dated --------------. The policy involved was mis sold to me by a member of your staff at a time I was in financial difficulties and I was pressurised to take the policy otherwise the loan would not be approved. My request is for the refund of the whole policy cost of £2874.92 plus interest of £842.68 making a total of £3717.60 The offer of £1968.01 is far from acceptable but I would accept this figure as part settlement and will continue with court action to recover the remainder. Over the period of the loan the policy will have cost me £3717.60. I would continue to pay the loan at the agreed monthly figure until the end of it’s term. Your offer is £1749.59 below the actual cost and I can only see this as being an unlawful penalty charge. The policy was sold in a deceitful manner by a member of your staff and this matter has also been discussed with the FSA and a complaint form has been filled out for the Financial Ombudsman Service. I would also like to bring to your attention the FSA principles for the “Treating customers fairly – towards fair outcomes for consumers . Principle 7 “A Firm must pay due regard to the information needs of its clients, and communicate information to them in a way which is clear, fair and not misleading”. Principle 9 “A firm must take reasonable care to ensure the suitability of its advice and discretionary decisions for any customer who is entitled to rely upon its judgement”. Your responsibilities I would draw your attention to the terms of the contract which you agreed to at the time that I opened my account. It is an implied term of that contract that you would conduct yourselves lawfully and in a manner which complies with UK law. What I require A refund in the form of a cheque for the sum of £3717.60 I require repayment in full of this money and. If you do not comply fully within 7 days then I shall begin a claim against you for the full amount plus interest plus my costs and without further notice. I will also Submit the completed complaint form regarding this matter to the Financial Ombudsman Service. Yours faithfully,

Hi Sharon, Another Lloyds one..My Fav..lol Just a couple of things that spring to mind straight away here.. 1) On your loan agreement it should state the cost of the PPI policy plus the interest that will be charged on the PPI. This would be the total that I would be looking for them to refund in these circumstances. 2) If they pay a rebate of £1968.01 into your loan account and do not decrease the monthly payments then the loan term should obviously be shorter as a lump sum has been repayed into the loan (the lump sum they are offering is equal to approx 6 Months payments if you get what I mean). This is a well known Lloyds tactic too, they tried that one with me but I stuck to my guns and demanded that the refund for the mis-sold PPI was paid back into my current account where my monthly payments were taken from. They did in the end agree to this. I did have a nice long Lloyds PPI posting on here but after the Tonight with Trevor McDonald Programm and some correspondence from their CEO and Solicitors The posting was removed from Here for the sake of CAG, Im still in discussions with them over this too and the fight is still ongoing and will be throwing something else their way within the next week or so..lol. Hi Jules, Once again shocking tacticts from these so called respectable companies, If they stated that you requested them to add the PPI onto your account ask them to provide you with Documented Evidence of this, which of course they will be unable to do. I presume you obtained your copy statements when you submitted a SAR , If so write back and tell them that they have not fully complied to your SAR as they have not supplied any documentation relating to the Payment Protection Insurance. They should also be able to supply a copy transcript or audio recording of any telephone conversations. Good Luck Ian
  18. Hi Jezzy. It is my understanding that there has to be a cooling off period for any credit agreement. Which company was the loan taken out with, If you can scan a copy of the Terms and Conditions of the loan I would be interested in having a read through these. Ian

  20. Hi, Sorry itsme , Have to slightly disagree with them having to rebate the difference onto the loan account balance. They did try that with me , but I continued to fight and got the PPI premium refunded directly into my current account, after all it was my money and I decided what I wanted to do with it, they did of course try to dictate as they normally do, but they lost..lol. HI Mike, I would submit a SAR under the data protection act along with £10 to have them supply all information that they have on record regarding your loan, You should also request transcripts / Audio recordings of any telephone conversations that they have regarding your application etc. As you are aware they always warn that telephone calls may be recorded.. If they do not have or provide any of these telephone calls then I would say it is your word against theirs and you should fight them for full refund of PPI plus Interest. Ian
