  1. As long as it is within the 6 Year time limit there is no reason why you cannot try to recalim for Mis-Sold PPI. If you have copies of all the documentation then I would initially write to them with a complaint regarding the selling of the PPI. If you do not have all the documentation I would advise that you obtain a copy of this by submitting a SAR to them. Good Luck and if you need help Just shout. Ian

These Companies make me so ^^^%^%$$& Annoyed, They prey on you at at time you are vulnrable and in a weak possition, they know that the only way you have gone to them for a loan is that you are probabbly desperate and will agree to almost anything to get the loan. And do they actually care that with adding the PPI that they are actually increasing your overaul debt, do they Hell.. Its all about Profit, Targets and commisions Im afraid.   4. You dont eeven have a copy of the PPI Policy ?, There may not even be on in place, you could be paying for something that does not exist, That may sound bad , but it does happen a lot. You need to find out from them who the PPI is with and submit a SAR to the Insurance company. Good Luck Ian
  5. At the time you took out the PPI was it made clear to you that it would not cover for pre excisting medical conditions etc, If NOT. you have been Mis-Sold the policy. Did you tell them at the time about the pre excisting medical condition ? Ian
  6. If you submitted a CCA request they have to supply you with a true copy of the Executed agreement, By the sounds of what you are saying they have not supplied you with a true copy. I would tend to write to them explaining that you do not believe the agreement they have supplied is a true copy of the Original agreement and give them 14 days or so to supply the proper Paperwork. Did you request it with a CCA request or a SAR ? Ian

Hi Todge, Thanks very much for your input here, I think the reason that the Fraud act is not 100% relevant in my case was that I used it regarding statements made to me at the time of my Application which was back in 2003. That is the reason that I agreed to remove that section from my POC and the Judge seemed to agree with me. I just didnt want to provide them with any loopholes so to speak, Mind you I have enough other points to get them on. They way that they have also enetered a Part 20 Defence has also slowed down the whole matter reaching a final hearing, Basically they have issued a Counterclaim against the sales rep in an attempt to get themselves out of any Legal Liabillity.   9. Hi Milly, I used the Misrepresentation Act in my claim, I did also use the Fraud act but this has now been removed as it is more related to criminal cases rather than Civil cases. I have also asked in my claim for quite a lot of disclosures regarding commision etc, and what grounds did the sales rep leave etc etc, Though I have had it confirmed from a source that basically all the sales reps wer in a round about way sacked by GE.. And GE have now also submitted a Part 20 Counterclaim against the ex sales rep in an attempt to pass the buck directly onto the sales rep who was working under their guidance and terms and conditions. At least with being allocated to Fast Track GE will have to fully disclose all the information that I have requested which of course will be made public etc, And today I have also agreed with one of the National Papers for them to have Exclusive rights to the full story, I am in the middle of copying all of the correspondence etc relating to my Complaint and Claim to pass onto the Newspaper for their Legal Guys to look at and so that they have every piece of Information that they need. Hi, It does not matter that the Insurance company are based in Ireland, the fact is that the Agreement was taken out and signed in the UK and Halifax would be responsible as the selling agent of the Insurance. (The Insurance company are probably related to Halifax in some way too). It does worry me that you have never had a policy from the Insurance, How the Hell (sorry hellhas ..no pun intended..lol) are you suppose to know the terms and conditions of the policy etc, if in fact a policy does actually excist. I would also send a SAR to the insurance company and see what information they have on you, and request a copy of the PPI policy relating to your loan account and ask for a breakdown of what payments have been made against the PPI policy. You never know they may not even have a policy at all, It will be interesting to see what your SAR reveals.. Good Luck Ian

  14. HI, By what I can make out on your agreement the way that the PPI cost was qouted was within the regulations at the time, PPI only became fully regulated after Feb 2005. Now they have to show the PPI cost and the Cost for Credit of the PPI as a seperate Item. Hope that clears that bit up for you. Next, The refund that they have given you will have been worked out in a weird and wonderful way by them, They tend to state that the PPI is more expensive at the start of the loan as it carries higher risk, what they mean is that there is the risk that if you make a claim they will, if they cannot wriggle out of paying out somehow they may have to pay out on the insurance. The way they always state that the PPI will cost you £x.00 per month is not a true reflection of what actually happens, With a single premium insurance policy what they are in fact doing is advancing you the PPI premium as a loan and of course adding interest to this. The whole insurance premium is paid upfront to the insurance companty at the start of your loan, well the premium less their Commision (which in some cases can be as high as 90%) is paid to the Insurance Company. If they state to you that a single payment protection insurance policy will cost you £x.00 per month they are simply misleading you on that one. What you need to do is calculate the real cost of the Insurance policy that they sold you, You need to take the Policy Cost and add interest at the contracual % APR over the loan period. (if you need help with this let me know and I will work it out for you). An example of the real cost in my case was a 5 year Policy on a 15 Year loan (Rip off to say the least), where the policy cost approx £3000 but when I calculated the Interest on that over the 15 years it amounted to nearly £4500 in Interest making the true cost of the 5 year policy nearly £7500.00. Now if I had taken PPI through an Independant Insurance Co I could have covered the PPI for 5 years for a total cost of £720.00, under one tenth of the cost which is absoluatelly disgusting. Maybe that is why I am fighting so hard over PPI and trying to make the general public aware of this massive [problem]. Personally I have nothing against PPI policies if they are sold properly and not at the highly inflated rip off prices that the Majority of High Street lenders sell it at. Ian
  15. Quick Update, Well that's my Statement of Claim adjusted as agreed with the District Judge at the allocation hearing. On reading through my claim again I feel that evidence provided in the claim is sufficiant to continue the claim even through Fast Track. I will be posting it off to Court this week and forwarding a copy of it direct to their Solicitors. I will also be having a go about the solicitor that they used for the Allocation Hearing, Obviously GE waited to see if I had the Balls to turn up for the hearing and when I did they appear to have appointed a local Solicitor within about an hour, (we overheard some comments regarding GE from 2 solicitors talking not too far away..lol), Obviously he was not fully aware of the state of the claim etc and he even forgot my name, he had to call me the claimant..lol Well I have been called worse. Well just have to sit back yet again and wait and see what Bull**** they come back with this time. And I will be keeping some little bits and peices up my sleeve for use later on..lol ;) Again thanks to all who have Supported me so far and hopefully will continue to hang around until this one is settled one way or the other.   17. I have now Cured all my Problems with my 307SW, Clutch, Flywheel and horendous Electrical Problems.. I Traded it last week and replaced it with a Vectra..lol Ian

Hi, The FOS will not take on yor complaint as PPI only became reugulated around Feb 2005, I tried them with a policy that I had taken out at end of 2003 and they refused to accept the complaint. I think Firstplus are members of the FISA, so you could complain to them, I tried the FISA but to be honest they were a waste of time and effort, they have no great authority or respect from the likes of GE Money / Firstplus etc. I had to raise a claim through the Court in the End, In fact am still fighting that claim, Sasly the claim has not been deemed suitable for Small Claims court and has been allocated to the Fast Track instead. Hi Ray, That is standard policy for Lloyds, Yes have your money back but we will pay it into your loan Account, They tried that same line with me, I told the to go take a flying ***** and they eventually agreed to send me a cheque for the PPI refund and Interest. It is your money that they conned you out of in the first place so it is up to you how you want the money refunded. They cannot dictate what you do with your money.. Ian

  21. Courts are pretty busy, I have had my claim allocated to Fast Track and a court date of Decenber.... that will be over a year I will have been fighting those &&^$$$&&* &^&*(( at GE. Ian
  22. Sounds to me like a bit of a cover up or delaying tacticts, It could be that they do not actually have the agreement. Demand a copy of it and ask them to send it recorded delivery this time. Good luck Ian
