  2. Oh they have already admitted that the cannot find the CCA for your loan.. Now that puts them in a very dodgey position.. Maybe just to be on the safe side I would submit a cca request along with £1 asking them to provide a true copy of the alleged agreement. If they cannot produce the agreement they cannot enforce the agreement without a court order. They have 12 Days to provide this copy to you (plus 2 days to allow post etc) If then they do not provide the copy within the 12 days they have commited an offence, If after a further 30 Days they do not produce it they will have commited a crimminal offence.   3. Looks like the are caving in easilly. Perhaps they know the Brown Sticky stuff regarding PPI is not being accepted these days by consumers..
  4. Unless they produce evidence that the charges they applied to your account are a true representation of the loss / Cost to them, then it is simple .. It is a penalty charge and we all know that penalty charges are unlawfull under Common LAW. The Law is there for the for your protection. Let them stand up in court and prove that their Penalty Charge are fair, Make them disclose the true cost , but of course for commercial reasons they will not have the balls to do that. Good Luck Ian

Hi Alibobsy, As I group are now part of GE Money Home Lending you should deal with GE Money, Or I will rephrase that you should try and Communicate with GE Money but no doubt you will find it a pretty 1 sided Conversation. As you will see from post 97 GE have a company policy on treating Customers fairly, Sadly I think the person responsible for writing up that load of drivel forgot to send it out to their staff, which does not at all surprise me as GE's Communication skills leave a lot to be desired, well that is if you are complaining to them, But if it is the other way around it is a differnet story alltogether. Having done a good bit of digging around on GE, and maybe a bit of a comfort is, that it is not only in the UK that this outfit use their company size to bully and Ignore customers, it seems to be a worldwide thing. (try Google GE and court cases or complaints, you will find a good few results which makes for some good reading. (even found ref to my cases on Google..lol) Once you are ready to start on them give us a shout on here and we will muck in and help out.. Ian

  9. Hi, So far I am unaware of a case for mis sold PPI reaching court, Well I have got as far as an allocation hearing, Kicked out of Small Claims and into main system. Court Date is not until December 2007. As for court Bundle, All I have to use is copies off all the correspondence (which the court already have) and copies of agreements etc. You will need to have copies of any Agreements etc and documents that you refered to in your POC. Copies of recent FSA reports etc wouldn't go far wrong either. If you have the time you can send me a copy of your POC and I will have a read through and see what you will need. There may be some Interesting Press coverage on PPI this comming this weekend.. Good Luck Ian

Fingers crossed that he goes in your favour, as they have not even bothered their backsides to respond to the FOS then hopefully this will act in your favour, I suppose its a bit like they are not defending the complaint. Some of these companies think they are above the law and even above the regulating bodies, We I can name one company that really think that.. GE. I have been fighting with them since October last year and have eventually got a court date of Dec this year. Good luck and if you need any help , Just shout. Ian

"no written confirmation is required to opt into the policy" Are these Jokers having a laugh,You need to get them to proviude you with a true copy of the credit agreement, PPI is classed as a seperate contract with most companies, They seem to think that they can simply add it to your account without your permission..I dont think so.. When you submitted you SAR you should have recieved copies of all information relating to your account, not just copy statements, The onus is on them to provide clear evidence that you did in fact opt into the PPI, but thats just my opinion.. Hi, First thing to be wary of is a face to face discussion with them regarding your complants, Personally I would not discuss any compliants with them unless you have the option to record any discussions. One thing I would also consider doing, If at the meeting they do agree to anything I would ask them to put it in writing and give you say 7 days to consider their offer etc. Do not let them pressure you into makeing any on the spot decissions (unless it is for full settlement of your complaint), you know how slimey and underhanded these lot can be, well they have caught you before now havn't they. Just be careful and stick to your guns, Personally I prefer to handle any complaints in writing, at least this way they cannot deny or change what they state to you in writing, In face to face meeting it could come down to their word against yours which would be far harder to use as evidence should your complaint have to go to the FOS or Court.   16. Now this is a very Interesting Question, Who is to blame.. And it is something that I am spending a fair bit of time working on at the momment regarding my own claim. I will post some info over the weekend regarding what is actually happening regarding this issue.

HIya, That looks fine, I would suggest that under your reasons Point 2 " I was told I had to take out the PPI at the time of the loan or not at all , I would remove the Or not at all on this one.   23. Hi Lyn, Did GE put that in writing, re contacting the sales rep ?, If they did can you please let me have a copy of it as soon as possible.. Tried calling your mobile but you must be at work.. I have someone who is very very Interested in that matter.. . If anyone else has had a similar response from GE telling them to take their complaint up with the individual sales rep Please contact me as soon as possible.. Ian
