  1. Thank you everyone for your help,I phoned the Homes and Directorate office and they agreed that the "rule of thumb" idea is not the solution.He is going to find the plans and send me the details.

HI citizenB, Our situation is quite confusing.I have heard that there is a rule of thumb regarding responsibility.However, when the council contractor came and looked at the fence he said that he would have to phone the dept that dealt with the boundaries,he phoned them whilst he was with me and told me that the dept could not find the plans that would say whos responsibility the fence was. He left saying that he would put in a request with that dept to ascertain which property was responsible for the fence.If the house that is on the other side was council property there would be no problem,but it's private.Today at 9.00am sharp I received a phone call from the council and was told that "if you stand at the front of the house facing it,then the fence on the left is the resposibility of your neighbour". Fine, that fits in with the rule of thumb theory,but then why would the contractor say that as the council had repaired so many fences recently thay had decided to consult their plans so that that they ascertain which house was responsible for the repairs.It does seem a little strange that it all comes down to..left hand yours,right hand theirs..right hand yours,left hand theirs.

Hi everyone, The fence at one side of the property (council) that I live in was damaged by the gales in April.After twenty or so e-mails from the council and numerous calls from me I was informed that the fence which is on the right,as you stand with your back to the house, is the responsibility of my neighbours.Could anyone confirm this for me.

  6. Hi Everyone, I recently discovered that I had PPI on a MBNA credit card. I took out the card around 2000 and then got into financial difficulties. The card was cancelled and after a couple of years of paying back the outstanding amount the debt was sold. Three weeks ago I phoned MBNA and was told there was PPI on the card. I then went on to the FOS site to fill out a PPI questionaire but I can't remember whether or not I made the application over the phone or by mail. Does anyone have any advice as to how I should handle this. If I can win back some PPI it would help to reduce my debts.

Thanks for your advice ims21, I've been to the FOS site,their questionaire is quite long winded (8 pages) and some of the info they ask for I don't have.I was hoping for a more general template letter.Last year I sent off a claim to RBS (re' a loan), just quoting the account number,but not mentioning a figure.Within a very short time they made an offer which I accepted.I was thinking that I could maybe follow the same procedure with MBNA,but I only have template letters to send to bank.

Hi Everyone, I found out last week that I had PPI on an MBNA credit card which I took out around 2000.I got into difficulties with the card and entered a payment plan.The debt was sold to a DCA about 15 months ago.I had paid off roughly £2000 of the outstanding balance before the debt was sold.As I do not know the exact figures concerned is there a general letter that I can send to MBNA to see what kind of response I get.

  12. Hi Nystagmite,The "week 13" has been mentioned a few times.Could you explain it to me please.My son had his medical assessment on 31/1/11. We won the appeal this week,do you know how many "backdated" weeks he might get.
  13. Thank you all for your help.I don't mind the delay,just so long as we know when it will be backdated to.At around £40 per week he is looking at over £2000.I'll ring them every week.
  14. Hi Everyone, Last January my son was deemed fit for work after undergoing the ATOS medical assessment,and as a result he lost his ESA allowance. We appealed the decision and won the appeal this month.After we launched an appeal his ESA was reinstated at the lower rate.Now I assume that he will be put back on the previous rate,but I am unsure how far back his money will be backdated.Can anyone help please.
  15. IMS, Thank you.I will try again to find the receipt,but in the event that I can't I'll have to go with what I have,I'm going to sign off for tonight,But perhaps tomorrow you, or maybe another cagger can suggest a template letter which might fit this scenario. Many thanks.

I sent an SAR and enclosed a cheque for the sum of £10.00 and on the back of the cheque was written the name of my sister in-law and her account number.surely the fact that the letter was an SAR and that the SAR letter stated that a cheque for the amount of £10.00 with the aforementioned details should satisfy any legal requirements. An SAR was sent,and received(by proof of the cashed cheque) What defense do they have.
  18. Yes,however I can't find the Post Office receipt.But why does it matter !!!.The cheque which was enclosed with the SAR was cashed by HBOS.We have a bank statement to proove this.
  19. Hi,Today my sister in-law received a letter from HBOS in reply to my letter telling them that they had failed to comply with the SAR. They say that they cannot trace the SAR request and go on to tell her that "if you wish to apply formally under the data protection act a fee of £10.00 is payable". To say that I was angry does not even come close,it was just as well that the moronic creature that wrote the letter was not in reach.As stated before the cheque was enclosed with the SAR request ,it had her name printed on the back together with her account number.Can you believe that they deducted the money from the outstanding amount in her account(I helped her to arrange a DMP with CCCS).I'd like to go after these arrogant,inept idiots.Can someone please help.

On 24/10/11 I sent a SAR to HALIFAX on behalf of my sister-in-law.(i was writing in her name) I enclosed a cheque for £10.00(the cheque was not in her name as they had previously seized monies because of monies outstanding) printing her name on the back of the cheque and her account number.The cheque was cashed on 01/11/11. To date I have received no response trom Halifax.Can anyone advise me as to the next course of action.

  22. I've just been looking at an article in Martin Lewis' moneysavingexpert.com.(updated 25/10/11) In it he states "If your account was still active in the last six years you can claim. So a loan taken out eleven years ago and repaid in full five years ago is fine, in rare cases you can go back further" Do any of the SITE TEAM have any views regarding this.
