Thank you all for your help and advice.In talking to my wife I have discovered another interesting fact,at the time the loan was arranged she was teaching Yoga one night a week to two or three women.This only lasted for two/three months.She knew nothing about PPI (not many of us really did),anyway,the loan was paid up and a short time after that she applied for another loan.This time she was not working at all,the lady in the bank asked her some questions that were put into a computer,she was told she did not qualify for a loan.A short time later the bank manager phoned her and told her she could have a loan.When she pointed out that she had been turned down he said,"there are ways around it,it depends how we answer the questions that are put into the computer".Anyway the long and short of it is that she got the loan,however,the repayments caused us quite a few problems but it was paid in full.I complaind to the bank about the manager and also the FSO but after a few letters backwards and forwards it came to nothing.All this has made me determined to fight for the PPI on both loans.

Hi everyone,I received a reply from Halifax today.They say that they are currently processing our request.They go on to say "In order to ensure we match your exact requirements,please contact me at your earliest convenience to discuss your request". My initial reaction is to ignore this letter and wait for them to comply with the the SAR.Do you agree with this.
  3. Hi Everone, Does anyone know if a company has successfully challenged a claim by someone claiming PPI .That is,by claiming that the claim for PPI was too far back to be considered by law.
  4. Thank you all for your support.My SAR was sent on 21/4 so I'll wait and see what transpires. I also found the original copy of a loan agreement with Welcome,this contains PPI and Healthcare also around the same timescale.I'll fire that off next week. Again,many thanks.
  5. Hi Everybody, Like most of us I keep seeing ad's for reclaiming PPI, they all say we can claim up to six years back. Most of the stuff we have originated between 2001 and 2004 (a bad time), I posted a thread asking for advice regarding how long we have, and Bankfodder said we had Six years from the time we suspected we had been mis-sold PPI. Last week I sent off an SAR to Lloyds re' a loan in 2001. Today on the spur of the moment I phoned the FSA and asked for clarification from them. They told that there were two time periods relevent...firstly that we had three years from the time we suspected mis-selling of PPi to make a claim. secondly that we could not claim back PPI on a loan more than six years back,and that their ruling was from 14/1/05. He went on to say that any decision to pursue an agreement prior to that date should be based on specialized legal advice. I confess that I'm even more confused now. I could really do with some help please.

  7. Thanks Bankfodder,We have had several loans over the last ten years or so,also a couple of credit cards.Can you tell me if there is a step by step guide to reclaiming PPI. From what I can gather it seems more complicated than the bank charges were.
  8. Hi,I've seen quite a few ads on TV regarding PPi,they say you can make a claim for PPI refunds on loans ,etc up to six years.Is this a hard and fast rule or is it possible to claim further back.

Hi Bigredbus,I think you'll find that the act says they must give you from twelve months but at least six months notification from the retirement date,ACAS told me that I may be entitled to compensation if they fail to do this.I think if they give you less than two weeks grace unfair dismissal comes into it.These are the bits of info i've got from phoning various organizations,but I'm not sure if I have a case for an industrial tribune.
  12. Sorry about the delay in getting back to you.They didn't give a reason,it seems the law does not require them to.It seems the act gives you the right to request to work beyond 65 yet gives the employer the right to refuse you without reason..legalized ageism,a law without teeth.
  13. Does anyone know if/how you can claim compensation from your employer if they give you less than six months notification of your retirement date.

Hi Rooster,I want to work beyond 65 years.I requested to work on but my request was declined and I am appealing.If I lose my appeal do I have any recourse with an Employment Tribunal re' the company not informing me of my right to request to work beyond 65...they informed me four and a half months prior to my retirement age.The act says they must inform me at least six months prior to the projected retirement date.
  15. Hi everyone,I have recently been informed that as I am retiring soon I may request to work beyond my retirement age.I was notified less than six months before my retirement date do I have any legal recourse.

Just a follow up on my thread,I phoned Claims Management Regulation Monitoring and Compliance Unit and was told they are aware of this company and have received other complaints.They want me to send them the last letter I received from Consumer Advice Uk,their terms and conditions plus my last letter to them.I'll keep the CAG informed of any further developements.

Hi, I read your article with interest.In October of last year I was contacted by Consumer Advice Uk re' claiming back PPI.At first they said it would cost £189 to get back PPI,I said I would think about it,the next day they phoned me saying that they could do it for £50 as it would be done inhouse and not with an outside agency.I must admit I was naive in thinking they were genuine(hindsite is 20-20) and sent off the £50 and a copy of a loan agreement, and not long after that they wrote saying that they could claim back £766.86 and stated the reasons why the claim would succeed.Two months passed and I had not heard anything from them,a recorded message said that due to bad weather the office was not able to open,after the snow had cleared up I tried again only to be told that there was a fault on the line,BT said that as the line was not one of theirs it was impossible to find out who the provider was.I wrote to Consumer Advice UK (recorded delivery and was signed for 5/2/10),still no reply.It was only after Google-ing them that I discovered you article.I phoned Claims Management Regulations but they were busy and I left a message.Do you have any more news regarding these people.I thought about Trading Standards but I think it might be just another grain of sand in the desert.
  18. Thanks for the advice Scott,the thing is I only have until Wed' 10,and it would take longer than that to contact Lloyds and/or their solicitors.Also I'm not sure what kind of claim to put in.
  19. I have received a letter from the court telling me that i must either give details of my claim for bank charges or my claim will be waived.Can anyone tell me if there is a way to amend my claim and if so how do i go about it.

Hi everyone,I have a claim in court against Lloyds for bank charges which was stayed.I also have a DCA trying to pursue an overdraft most of which was due to bank charges.I have written to the DCA telling them that they may not pursue an alleged debt that is in the county court system.They stopped writing to me,however I have received a letter from the court telling me that I must file and serve full particulars of my claim by 10 Feb 2010,if I do not do this my claim will be struck off.If this happens the DCA will resume their actions.As the Supreme Court threw out the OFT case I don't know how I stand.I'm sure that there must be many people in the same boat as I am,can anyone tell me what course I should take.

  22. Changing the thread title is a very good idea,thank you.I have found the letter re refusing permission to visit.Could you suggest a format for telling Wescot to pass the alleged debt back to Lloyds please.
  23. Wescot are the acting agents.I now need to look for the template letter re doorstep visits, then tell Wescot to pass the claim back to Lloyds.

Thank you all for your help,I have sent a letter saying that they may not pursue a debt that is in dispute,and will now send off the letter refusing permission to visit.The name of the DCA is Wescot.I do know the amount that being pursued by Lloyds but as we have certain undesirable people monitoring this site I won't disclose it on an open thread.I had a notice from the court saying that the claim has been recorded and that Lloyds would be informed of my claim,this was followed rather quickly by a notice of defense from Lloyds via Wascot.As of now I assume that the claim is still active as I have'nt heard otherwise.
