  2. Hi Team I'll give you all the new info that Ive managed to find. I'm sure there is another letter missing which I will search for and upload. They also sent me a payment statement showing I have not missed a payment since the account was "handed" to them on 01/10/2000. Opening balance shown £12,507.59.The current balance is £11,772.59. Please read the uploads and give me your views.

  4. Hi guys I sent the SAR and t hey pretty much repudiated that they needed to give me any more information. I have found some of the correspondence but am missing one letter. I will search for it tommorrow and upload it asap. I think the missus has filed it instead of me so it will be in a "safe" place .If not I will upload the relevent letters I have found. What I sent was a SAR along the lines of Citizen B's form on this thread 27th Sept 2013. Keep up the good work guys and thanks.
  5. Hi Guys Heard nothing from Asset Recovery for months and now Ive received 2 letters on returning from a recuperation holiday. Ive uploaded the letters. The second letter seems more threatening, so any input would be appreciated.

  8. Hi hmoss Im surprised no-one has replied to you but these guys are very busy and when they read this I'm sure you will get some good advice. You have 2 weeks to prepare your defense so start by gathering a paper trail of what you've done to repay arrears.Dont use e-mails but photo copy letters etc.Work out an acceptable plan of repayment after you have completed an I & E form (You will find one in library). Do not put overtime into this unless it is at a guaranteed and sustainable level ie dont make an offer tou can't afford. I hope that for your level of debt that any judge will find favourable for you.Good luck.

  10. Hello again It just got weirder. I've looked up midland and general securities on t'web and they were incorporated 28th March 1996 (2 years after our house was repossessed) and dissolved on 19 september 2000 so where do they come in to the equation????
  11. Thanks firstship, I will have a look at Citizenb's letter and probably send it when I've doctored it to suit. In the meantime how will it affect my case if I did stop payments as I have received nothing more than court threats and I don't want to adversely affect any future court case. Also as mentioned in an earlier thread my loan was taken out with a firm called J & J Securities but the doc Ive received from Asset Recoveries shows part of an application from afirm Ive never heard of called Midland and General securities. Any ideas??
  12. Hi Surfer01 That would have been nice at the time but when I took out the mortgage they were more bothered about selling mortgages than insurance. I was also in a "safe" job with the coal board and didn't think I'd need one. What a difference a few years and a change of government can make, at least now I've gained a first class degree in hindsight.

  14. Hi Guys. I received a letter from Assett Recoveries yesterday complete with very little information which I will try to upload so you can see what I recieved. Ican only add 5 items per post so I will add the final one next. I expected a lot more correspondence from them but when you read their letter they do not believe they have to provide any more information they have about me. Also an eye opener for me is that I took out the loan origonally with J & J Securities but they have sent a copy of a loan application form with a firm called Midland and General Securities.

Hi Lazy Toucan, I did follow your earlier thread,Sorry to hear you did not decide to fight it.You must be aware that both your primary lender Nationwide and Black Horse who also have a charge against the property will pursue you for recompense.Once the dust settles and you have a new residence wait for them to contact you. If and when they do please post further information so the team can give you the best advice.When my house was repossessed the primary lender was repaid in full but I am now being pursued by a second charge.I managed to negotiate a nominal interest free repayment but I believe this is from a company who bought the debt from the secondary charge holder.They are now trying to increase the amount of repayment and try to get a charge on my current property even though I have not missed an agreed repayment. These debts can follow you for a long time and my only advice at present is to keep this thread alive and keep us updated with everything as they happen so we can give you the best advice when there is more information. I never recieved any information on the sale of the house until very recently so could not dispute the residual debts, charges etc.so if you can follow thr house sale it can give you helpfull information, Good luck for the future.

Hi Lazy Toucan, Beware if the house is repossessed and sold on there may be residual costs and charges that may turn your house into negative equity.This may mean that there may be residual debts that can follow you.I know this can happen through experience.My best advice is to read the advice given by the site team and other caggers. Also they will definately be asking you for more information as your thread is a little vague.Read learn and react. The advice given I have found to be very good Good luck

  18. Hi team, I recieved a reply from Asset recovery UK. They provided some of the info I asked for but not all. They have not proceeded with the courts yet but I'm not sure they wont. I'm not posting the sar yet because I want to be sure I've got it right. What do you think my next step should be? I asked for a letter of assignment which they have not sent. they also sent a copy of payments recieved dating from 01/10/2000 showing I have not missed a due payment.

Hi sd23 I dont know how the court or solicitors acting for the prosecutors will react.Dont offer the court a kneejerk offer.I know you are under pressure but courts tend to review a balanced and sustainable offer or repayment than keep seeing you there repeatably because you cant sustain your proposed repayments. also ask if interest on defaults can be deferred whist repayment takes place.Nothing to lose,A question costs nothing.Good luck.

  23. Hi again firstship They reckon I still owe them £11700 although they arent charging interest at the moment they have threatened to charge interest again from the start of the debt. Can they do that? Ive already started trawling the library for suitable forms and anything else that I may have overlooked, My biggest problem is that I can only find very little correspondence prior to 2002. We moved house about this time and it appears letters/ statements etc may have dissapeared around then.
