  3. I did want the VR but only as a last resort if they cant find me a job... Just wanted to know where I stood legally if you said no case then I will leave it be I wasn't sure if they could advertise your 'job' by accepting the request
  4. Middle of last month my employer announced their structure changes and what it looks like for managers. We were told in a presentation that we have to submit our preferences for the new job roles and there will be an option for voluntary redundancy. So we are given some time to decide (about 10 days) with figures for VR on what we wanted to do. Some q&a's came out. When they did it then said that VR would be considered no.1 preference over the other preferences. After getting my head around that i though ok I need to ask HR some questions that relate to me and these answers were not forthcoming so when deadline day/time came I had no choice but to put down what I wanted without all the answers I required. A week later they informed me they had not made a decision they will be in touch and acknowledged my requests. Another week passed they called and informed me again still not decided but by this time everyone around me regardless of choices had their outcomes. As another week passed I spoke to our HR department as I was not getting answers on what was happening and wanted to understand why. They said that every person went through a scoring process and that I had scored too high for them to automatically let me go VR so they need to decide what is best for the business. Ok fair enough maybe VR i wouldnt get. A week later I get a call to say my VR request had been accepted. Excellent at least some closure on this I can move forward. I get a call from the new area manager to tell me that the job I am currently doing they will be advertising and wanted to make sure I was happy with my VR. I said well if you are advertising my Job why did you accept my VR request bearing in mind they asked me if I wanted to be considered for it. He said they can because my Role technically no longer exists and its a different job title. Ok. When I look at the 2 roles there is 1 difference and a new title. I went back to this person and said ok they maybe a slight difference but this role and a slightly lower position were considered suitable alternatives when making the choices what has changed. To which he which he couldnt answer. I then said if my role technically doenst exist then on the date of the changes I dont want to be in this role and be placed on gardening leave or alternative duties in line of my current job description. He said he cant do that however I can effectively take a demotion while I worked my notice, or I can withdraw my VR and they will score me up (thought they already done) and see where I can go and then apply if i need to. I was told any score I was told earlier I am not entitled to know what I could of lost out on just the score as this in confidential and they will effectively tell me others scores! This conversation went on for a while and it was agreed I stay doing what I am doing until my leave date. Now I want to know can they advertise my 'job' if they are making me redundant/accepting my VR request? Can they ask me to work at a lower level? Can I effectively claim I have been dismissed/forced out of the company?

  9. HI all I sent the letter of complaint on 17th October and its been over 8 weeks and not heard a thing abou this particular account... I did get another letter from HFO regarding a different account number (think I started another thread for that)... I also wrote to Barclaycard and not had a response... I have both receipts and proof they have been signed for and received... I have looked on FOS and they have 8 weeks to respond to me... So is it time to give FOS an email/letter of complaint or shall I wait until after the xmas period before going any further?

  11. I have written a letter to both HFO and Barclaycard also sent copied to OFT. HFO letter basically says that I do not owe this debt and have forwarded their letter onto Barclaycard for investigation. Barclaycard - a run down whats happened. With copies of letters asking them to investigate this. Sent copies to OFT. Now its just a waiting game I guess!
  12. In terms of this latest letter I feel a need to respond to HFO. I may respond in lines of... Further to your letter dated .... As you may already beware we have a dispute and a complaint regarding debt xxxx I have requested your complaints procedure. In the meantime I do not acknowledge this debt you claim I owe. I will be writing Barclaycard for more information about this account.
  13. I havent heard anything regarding the complaint. When I went to the OFT and and did my WS we spoke briefly about my reply to the other one. Technically my complaint isnt with Barclaycard its is with HFO as they are the ones hassling me. I think the most I can do is send Barclaycard a letter making them aware a company that claims to represent/bought their debt is doing this to me. I cant complain to Barclaycard coz I am not there customer. I have emailed OFT today who I spoke to and see if they can advise or pass to someone who could help me. I feel I need to do something. I need to know what their complaints procedure is and in line with FSA/FOS. I dont want to go running to FOS when I havent given them any chance to resolve this...
  14. Yeah an interesting one this is... As there appears 2 accounts I feel I should do what I did last time... Ring Barclaycard for what its worth and then send HFO a letter!

Today I got home and I see this lovely letter from our friends at SW19. GREAT They must be replying to a letter of complaint I wrote to them about. So I open it and its REMINDER - NOTICE OF ASSIGNMENT. So before I went any further I thought they must be changing tact! I go on to read and says this: Your original lender: Account number: HFO Case number: Amount Owing £3893.99 Current Interest Rate: 12% As you have already been informed, your account, including all the legal rights and obligations associated with it, has been passed sold by BARCLAYCARD to HFO Capital Limited. Your account is currently being managed by HFO Services Limited. The current outstanding balance is £3983.99 ETC ETC Telling me I must reply in 7 days etc.. So I look at all my other docs and its a different account number so I am confused... I look at my equifax record, and its not on there but is from my archives and under a different name again and under attributable data. Default date of september 2005 so obviously that has now dropped off! So what do I do here now should I start again with a prove it letter and start another round of postal tennis with them?
  17. update - statement now completed... I am going to send a letter to HFO headed up as a complaint as this is what the next step should be. Also send a letter to BC to make them aware on what HFO are doing. I can't complain to BC as I no that customer.
  18. Plenty... Seemed shocked when I told them I needed to provide proof of my ID! I need to write another letter this weekend in response to their last... was waiting until until this was over then see if this person could comment on it!
  19. Witness Statement started and couldnt be finished within the time frame hoping to be done tomorrow!
