  3. why are you paying anything? did you ever acknowledge the debt within last 6 years? did you pay anything in last 6 years? if not then they are statute barred surely and totally unenforceable IMHO.

  5. savings accounts are available at nearly all Building Societies, you need one that gives a card to withdraw from cash machine and also instant access too. Most building Societies do them, it is for normally teenagers or 16-17 year olds who struggle to get bank accounts. Most wont do direct debits but will accept payments in (benefits, tax credit, EMA)

I miss my daily phone calls from DCA's I miss their "we need you to confirm who you are for security purposes" and my response "ok but before we start I need to confirm who you are for security purposes" that was normally followed by silence then "we know who we are sir but...." well thats good because I Know who I am too" silence......... then they followed with "you really need to speak to me" followed by my stock response "why are you lonely? dont you have any friends? awwwww I'll talk to you then....what football team do you support?" they then nearly always hung up and then got numpty at next desk to ring me back and so it started again
  7. Hello Everyone, I received a letter today from Halifax about a mortgage I had with them. They repossessed the house and we moved on obviously they sold the property. However this was at least 15 years ago maybe longer. They are pursuing me for shortfall, now I know that debts are statute barred for credit, however surely they must be some law for the same. I have never contacted Halifax about any debt/shortfall ever, they have now apparently passed it to solicitors Walker Morris. Any advice gratefully received any letters I can send (couldn't seem to find one in library). On one point the mortgage was an endowment which wouldn't have covered the total (do I have a claim against them for mis-selling it wouldn't it be funny if they had no claim against me but I had claim against them and their persistent cost them money. Also this mortgage was with Ex Wife and was in her name so surely they should be pursuing her too? PS the mail is going to address I left 5 years ago ( I lived with in-laws due to us having severe money problems all sorted now and due to fact we cleared all debts I suspect they got that address via credit file showing me paying debts off and thought lets get our cash too) so they have no knowledge of my new address nor will they. I think what is said above is right way ask for a meeting with the manager perhaps with senior member of staff there also clear the air saying how disappointed you are by his actions etc. and then see what is said. I suspect it will be apologises all round etc perhaps suggest a specific policy is bought in to cover social media and posting then this problem wont occur again and if it does it will have rules & procedures. I suspect it was heat of the moment posting but still unprofessional.
  10. First thing does company have a policy on facebook and posting work related information? Next who owns the home (local authority. private)? It is in poor taste posting it however most of us have posted things in a little anger only to regret it later this may be the case. Also can you get a screen shot of the posting in case you need it if you take it further?
  11. Glad you are supporting each other, in a years time you will have forgotten all about it. just a quick thought if you can look at storage places in case you get in B&B accommodation.
  12. first of all contact your local authority housing dept. if you have a children they have a duty of care to house you (although it may be a B&B) also contact Shelter they may even at this late stage be able to help to keep your property (but dont bet on this). This isnt the end of the world (although it may feel like it) you will probably feel a great weight lifted when you get new accomodation. Most council run schemes that will pay your deposit for private rented so thats another option but take this weekend to do a plan of action. Shelters number is 0808 800 4444 they are open saturday and sunday 8am-5pm so ring them today, and good luck
  13. absolutely nothing you can do in reality, what they have done is in anticipation of new law coming in stating after 12 weeks you will get the same rights as permanent workers. I'm sorry to say unless you have good strong evidence of prejudice theres not a lto you can do but on the bright side you have 12 weeks experience so next job you can use this (as a side note I would say it was a temp contract on further job applicationa)
  14. exactly what DX said, they have no powers to do anything and they know it they hope you know nothing about their 'powers' and what the legally can do personally I'd ignore or fire off a couple of the letters from library (phone harrassment one and prove it one) they tend to disappear when its obvious you have a knowledge of the law.
  15. Oft have just stripped a DCA of their licence and warned 119 about there actions so complain complain complain your complaint could be the one that gets them put out of business
  16. Well OFT have got rid of one DCA http://www.oft.gov.uk/news-and-updates/press/2011/98-11 but looking at the wording of tribunal details I would expect a few more to be releaved of their licences
  17. you can get a pre pay credit card (works like a top up phone) Cashplus do one it gives you the freedom to pay bills shop online etc, you can even have your wages paid in but you can only spend whats on card. Other than that you could go to building society and get an instant access savings account a lot of building societies do them (small ones are better but Nationwide do one) That again has no credit allowed
  18. hmmmmm our old friends Carter/lowlifes/fredrickson. I doubt they will do any litigation I personally feel this is a fishing trip. Do you have confirmation from 3 that the contract was paid up and finished? if not can you get it? if the answer is yes then these clowns can whistle, as because as soon as they start court proceedings you can blow the claim out of the water. I would go to 3 get them to confirm its paid off then tell them to call of their little minnions
  19. right he is certainly acting illegally he can not get a locksmith he can not enter your property (unless there is open window or door) He can not put you in prison, pay direct to council via online payment method. has he put his charges on any paperwork? never ring these knucklescrappers ask council to take it back due to the illegal threats made by these clowns. Did you pay via direct debit, cheque or postal order? keep paying the council but make sure it is paying off this debt not this years council tax.

This company is very aggressive, in getting cash from you however if this the first communication you've had from them it may be a fishing to see if its you i.e you respond then BAM they got you. If they had a warrant of execution the bailiffs would have been there by now. My personal response is do nothing and see what happens but others may have better advice, its in their interest/benefit for you to get in touch not yours. Lets put it this way If I had a valid warrant I wouldn't offer you a chance to pay I would get the goods and sell 'em. I'm sure the next offer from them will be a % off the total etc etc.
  22. I would separate the two letters the compensation letter would go to council (what and to who I'm not sure) the complaint about the council & Bailiffs actions I would send separately to councillors and MP
