  1. I agree. As the OP was thinking of using money elsewhere, that would show that it doesn't have to go into a repayment mortgage, so deprivation could still apply. When the policy is cashed in the OP has a duty to inform DWP.
  2. I would have thought the OP would be investigated for spending 8 grand in a few days so that capital is under the limit that affects IS.
  3. The £2k isn't a hard and fast rule, some do get prosecuted for less, and more likely if they have any history of fraud before.
  4. Once you get the £13500 you will need to inform them as until it is under £6k your benefits will be cut. Paying off debts etc could be seen as deprivation of capital, depends on the nature of debt/ spending They can also look as you buying a car home improvements, depending on price and need. Not reporting it could be seen a fraud.
  5. No, the new claim will be based on how you are now, and use the fresh screening from ATOS. ATOS have been proved to be liars so don't doubt yourself if you fail. With a doctor on your side, you will have a good chance of winning an appeal (if needed)
  6. Then you can put in a new claim. But you really will need to appeal if you fail next screening. Also if you fail, while you appeal you can still get ESA (at assessment rate) as long as you send in a Dr fit(sick) notes
  7. Sadly most people seem fail a ATOS screening (I'm not going to call it a medical). So for a new claim to work you more than likely have to appeal. What date did you claim last time?
  8. Doubt you will find any protection cover for a current illness, bit like shutting the gate after the horse has bolted. You could look at claiming HB and CT depending on your status / income / savings, I'm guessing you're getting SSP.

  15. What seems to be happening in cases like yours. You will get a letter stating your overpayments, also they might be a penalty (any penalty will be less as you made first contact) You arrange to pay the overpayments back.
  16. The only advise you will get on here is to be honest with them. Whenever he moved in, that's the date you give them. Sound like what your partner wants to do is for you to commit benefit fraud and that won't be condoned on this site.
  17. IMO the bank was wrong giving so much of an overdraft when a much lesser amount was asked for. But I don't think being on benefits should automatically stop a person having an overdraft.

  19. I understand what you are saying. Although you were getting that money, it will have to be paid back to HMRC as it was an error, so HB will have been correct in that regard.

  21. If it is that debt, it's only time barred in relation of them being about to take you to court. That can recover it other ways such as though other benefits you might get from DWP.
