  1. Agreed PT, but please remember that peaceful entry into residential property does not have to be by invitation and an HCEO would not have to leave a property if asked to do so.

  3. Because thousands of people fail to pay the taxes due and the rest of us suffer because of it. It's only through the threat of removal of goods that people decide to suddenly pay. God forbid they have to forgoe Sky TV, a holiday to Benidorm, a financed BMW or their 30 fags a day....

In all seriousness, if it is a mistake by SF then yes, a claim should be made and the innocent party should get everything he's owed, which will be substantial no doubt. I'm just aware that many solicitors authorise these kind of removals on the facts they have which whilst usually spot on, there is always the chance of error. If the writ was issued at that address and the solicitor has demanded a removal then SF have acted correctly and will be protected from prosecution. As I said before, it could well be the solicitor or claimant that is facing a huge bill. However, we dont know the full the story. Did Mr Goucher own the shop personally and their debt was against his limited co? There could be so many reasons why the solicitor/creditor/SF has reason to believe they were acting correctly. But again it could be an awful mistake. Who knows...???
  5. If it's over £600 get an HCEO involved ASAP. There are many aspects of law that the debtor will have to prove he has satisfied regarding assets even if he has technically transferred them into another company.... Google 'High Court Enforocement'
  6. If it is believed it is sold to defeat the distress the bailiff should still levy upon it. Your best bet is try and sort it out with the council or (shreak!) the bailiff.
  7. If they issue judgment against him it could affect your parents credit. You really need to prove he is abroad. Unfortunately, this is an excuse often used when it is not true.

  9. If they've been directed to the property by the cliamant or claimants solicitors then it will be them that are liable for this action. That could be why SF are looking protection...
  10. First to your other points: Laptops/PC are sold at auction without being checked. It would be for you to remove any personal information before the item is removed and sold. Yes, bailiffs only target defenseless old people protecting their life savings... yawn... Now to your quote above, based on targeting these frail old pensioners and thier feeble defenses, bailiffs wouldnt need body armour.... .....unless it was 2ltr16valve cos he's big and scary, but there wouldnt be anything removing from his house....
  11. If you've signed a walking possession agreement then yes, they can remove. However, I believe they'd accept an arrangement providing you contact them prior to another visit. If they visit again, they will add further charges. Try and sort something before this happens.
  12. But it's not law unfortunately so your laptop/PC is still available for seizure. Maybe this will change in 2012 but then hopefully so will the right to force entry.
  13. FYI, Marston (incl. Drakes) are the largest HCEOs in the country (though not always the best as per robtheplod's case) and had circa 26,000 writs issued to them in 2008.
  14. How much are the payments? If the defendant (or judgment debtor) had the assets you suggested this should have been cleared up in one go. Havent Marstons offered you online access to keep updated with your case?
  15. This is a forum which is full of peoples opinions. Mine is that John Galt is not worth the £125 he charges. You dont have to believe me, but it is my opinion. The OP will have to make there own mind up on whether they spend their £125 or take the free advice afforded by posters on CAG.
  16. FP, you really are talking rubbish. Are you aware that the ANPR vehicles work off of a computer database that the 'warrants' are loaded onto? The warrants are issued by the Bulk Centre in Northampton. So, are you really suggesting that all those companies you name operate without these?...
