  3. No. It would be down as a credit against the amount due. Can still be transfered to the HCEO.
  4. Westgarth, nothing you say on here will be anything new I can assure you. With regard to the County Court, unfortunatley they have little to no knowledge of HCEO procedures. The county court used by the company I work for regularly advise debtors that all High Court writs are issued at the RCJ, completely unaware that they are issued by their own colleagues in the same office! (District Registry)
  5. To transfer a judgment to the High Court for the purposes of enforcement, the judgment debt and court costs must be £600 or over. To explain: If the judgment is £510 and the court costs are £90 then this would qualify.
  6. Fork It, I sympathise with your experience. But I must advise that you're debtors are nearly impossible to collect from. If anybody can, it will be the HCEO, but I would be surpirised if they collected from 1 in 10. HCEO's have been flooded with debts like this over the last few years. A common one is college fees for foriegn students. Try getting £8k from a student sharing a tenth floor flat in Camden with 5 others. A waste of everybodies time!

Just face the fact that you got caught avoiding paying a debt you owed. What about the creditor you sticthed up, ever had a thought for them.... OK, so you won some money back on a technicality.   8. You clearly fall into the 'vulnerable' category but I would get onto the council again and not let them fob you off. What happens when this guy goes on holiday for two weeks, does that department shut down!!?? Demand to speak to the manager, take nothing less.

  10. Fair Parking. You pat yourself on the back if that's really what you need. Whether I agree with the process in which warrants are issued for parking violations is irrelevant. It is how it is at this time and is enforced when it is not complied with, like it or not. I'm not bothered enough to trawl through your pointless boring posts you continue to bleet on about either. Anyway, I must go, I have my bullying, lies, fraud, intimidation, theft, deceit and violence class tonight. PS - Don't forget to take advantage of the 50% reduction on your tickets if paid within 14 days.

  12. I am not personally aware of any HCEO that takes a fee up front from the creditor. Can you justify your claim and name the company concerned?
  13. The Notice of Seizure is a prescribed form the wording of which is not up for editing. All HCEO's should be using this form, the first paragraphs of which state: "A formal seizure of the goods at the above address has been made under a Writ of Execution directed to an Enforcement Officer by the High Court. The Enforcement Officer accordingly has conduct of the execution. The goods seized are now in the custody of the Enforcement Officer, authorised to enforce writs of execution from the High Court, and must not be removed, sold or otherwise disposed of. This will remain the position until the sum due under the execution has been paid in full".
  14. That's not right. Any money collected does have to be held for 14 days (1986 Insolvency Act) but they should split whatever is collected. I cant believe you havent received anything. Does the debtor have any grounds to take it back to court other than to apply for a variation order? If the details you said at the start of your thread are true, any HCEO worth their salt should have cleared this up long ago. I did say that some HCEOs are better than others....
  15. Those cases are unenforceable and are returned as such. Remember, HCEO's still get a fee from an aborted case. As I have stated in the post above, we regularly act for individuals against rogue traders and [problematic]. Only this week I have recovered just over £3k from a well known rogue trader recently featured on BBCs programme of the same name. The individuals had thier judgment for over 2 years and the rogue had even sent them emails telling them how they'd never see thier money. One visit, a locksmith, several Police and payment. Job done.
  16. Seanamarts, you have clearly had an awful experience and one that the perpetrators should be brought to task over, whoever they are. You state that to reclaim the money you are owed would cost to much. That need not be the case. But it does depend on whether your debtors have the assets or monies to pay. I constantly recieve thanks by phone, email and letter from individuals, like many on here, who have used my services when all else has failed. Often these people are on their knees with debt when we collect the money they're owed. We're not always successful, some cases are just unenforceable, but we do our best. Please remember that for every defendant successfully enforced against by an HCEO, there is a creditor who get's back the money they're owed. It's easy to lose sight of that sometimes.
  17. OK. So let me get this straight. You are happy for Bloggs Builders to take your hard earned (or benefits given!) money, not do the work you asked and keep it? You dont seem to understand that many creditors (I do not collect CT or Parking Fines) are individuals like yourself that have suffered at the hands of rogue traders etc. Are you also stating that it was the visit by bailiffs that is the reason you have to take the medication you do? Whilst the enforcement industry may have a few bad apples, I do not for one second believe it is anywhere near as much as you, or others, claim. BTW, Its a shame your still not in school SEANAMARTS, your grammar and spelling are terrible
