The vehicle in question in this thread is a 7 seater, therefore the lady who was not at fault would have had reason to aquire a like for like car, if there was no reason there, she would not of received a like for like car, unless the at fault insurance company agreed to pay for it. Any hire vehicle supplied under the ABI scheme need to have mitigating circumstancies, to be honest its not that hard to make up mitigating circumstancies and most of the time the insurers do not even check.
  3. I would not use Kwik Fit, thats speaking from personal experience. theres lots of other smaller firms out there that can do the job, personnaly i would use the main dealer, just incase if there is problems.

  5. Hey, i know its hard but try and stay calm, im pleased to hear your moving forward slighty with your matter, keep your voice been heard and things will happen in your favour !
  6. I deal with incidents like this every day, you know people are taking advantage of the situation, but there is little we can do. With regard to the hire car, this would of been aranged through the Insurance company or bodyshop, it will also be charged at ABI Associatation of British Insures rates, they would have also had to had mitigating circumstancies for a like for like vehicle, ie, carrier lots of people, prams, etc. At the end of the day and i know its hard, let the process take its toll, in a few months ask the insurance company for the details of whats been paid etc, then if you so wish question the matter. Hope you get things sorted, keep us updated when and if anything happens.

  8. This is an all to comman practice these days, after reading your comments, baring in mind i havnt seen the damage to the vehicles, i beleive this payout is over exagerated. Theres a possiblity this payout me include the cost of a hire car, whilst hers is in for repair or whilst her claim is settled, theres also the question of personnal injury, have they made a payment for this ? I would certanly ask some questions, exaust all the insurance company complaint channels and see how you get on. Hope you get things sorted.

  10. It was annoying when the machine went faulty, the customer service issues have only antagonised the situation. I feel releived now, but ive got my claim drafted up, just waiting for there letter and i will respond !
  11. Update - Rang the ATM dispute team today for update. I was informed that my account was credited with the missing money, 2 days ago, they also confirmed that the machine was faulty. I also enquired about my complaint as i have not heard anything to date, i was informed that a letter had been issued, as it was now a phase 2 complaint, they will reissue this letter. They also informed me that a letter was also in the post regarding the non despense and an explanation, they also offered to credit my account with £10, i declined this offer again. Just waiting for correspondence and i will decide my next course of action. Thanks for all your help and advice.
  12. Update - Sent off appeal form, received confirmation from Local Authority that my Appeal has been received and recovery action is on hold.
  13. Update - Received tribunal paperwork from Local Authority, now waiting to hear from the Tribunals Service with confirmation of date etc.
  14. Sounds good, perhaps a national day of contacting the mobile phone providers ! this should clog up there call centres too !

  17. Sorry to hear of your probs, ive been there, seen it etc, im constantly receiving overpayment notices, just at the tribunal stage with one of them now. Exaust all the complaint channels, your local MP might be of use too ! Hope you get things sorted.
  18. Sounds as though there is fault on the councils part, which will come under the critera of Offical Error, this shoud of resulted in a write off. I would certanly complain to your council in an attempt to get this resolved.

Great info, and you never know they might just get disbanded one day not to soon, my MP has asked a number of questions with regard to what Government Departments use Philips, with a view that there contracts be withdrawn ! With regard to your comment when you mention CAG, ive noticed a similar thing, you seem to be listened more and taken more seriously. I forgot to mention the Software issue with Philips, ive also contacted the BSA to inform them of my concerns with this DCA using unlicensed products ! Your doing great at pursuing your issue, continue to keep a log of all communication, take care.
  20. Pleased to hear the council have taken your debt back, keep exausting all the complaint avenues and continue to make your voice heard. The OFT response you have received is identical to the one i have received, ive posted the one i received in a different thread, i think this is just a bog standard reply, in any event ive posted the signed form back, ive alslo expressed my further concerns to the OFT, regarding my thoughts on the bog standard reply, ive also update my local MP of the OFT reply that i have recived.
  21. Keep up the great work harasing this DCA, its time for a taste of there own medicine, i was intersted to read that the Cheif Executive email has been disbanded, think there just trying to put you and other people off emailing him direct !
  22. Im certanley not expecting miracles, ive just done my bit, the more people that inform the OFT of problems, something will have to be done !
