Hi I was defaulted in 2009 giving me just 14 days to remedy also terminated on the same day the account has recently been sold and i was wondering if the oc could now re issue any of the notices

Hi how are you getting on with Lowells as my case is exactly the same as yours.

Are they able to issue a new default and termination after an account has been sold?

Can a DCA who has purchased an account with no CCA default your credit file?

Hi Im the same as you very quiet and today had the same letter as you. I have a cca that is very poor and a default notice that was for 14 days only no allowance for postage I also have a termination notice issued the same day as the default.

Hi in the same position as you I wrote to Aktiv telling them this was in dispute with MBNA and Experto still waiting on reply.

I have CC account that was sold to a DCA before expiry of the DN and a letter from the OC received recently returning some charges and in that letter it states the account is closed,how can they issue another DN 2 years later when the account has been sold and in their words closed?

If a debt is terminated on the back of a faulty DN then sold what is the situation then?

My point was I would not have lost my job had it not been for the Governments unlawful action so if their decision is overturned I and many others lost their jobs for no reason.

I like many others was made redundant in December due to the Government reducing the FITS in the Solar Industry. Th e Solar industry decided to take the Government to court regarding this and in the High Court last week the Judge ruled that the Government acted unlawfully by bringing the cuts in before the end of the consultation period.If the Government cant get this decision overturned does this mean I and many others can take the Government to Court as we lost our jobs due to their unlawful action?

I think I will write to them an find out, mean while I have Experto on my back should I tell them MBNA say the account is closed and I have to do nothing?

An update I have not heard from MBNA since the sale to Experto until today I received a cheque for over 200.00 saying they found an error in the way credits were added to my account and I was due a refund I do not have to do anything as the account is closed. Whats that all about

I wish I knew, did your DN ask for just the arrears or the full balance as mine was for the full balance.

I am in same situation as you account sold before expiry of DN but have been told they are allowed to do this.

Hi Roy I am expecting another any day and from `what I can gather we dont have a leg to stand on I am going to try and come to an agreement with them.
