Yes it is worth going after your charges ghorsburgh I'd suggest you read the Frequently Asked Questions forum, in particular the Step-by-Step Instructions, the FAQs themselves, and the Rules of Engagement. You'd do well to read the other threads in there too Once you've got those under your belt, take a look at the Bank Templates Library. It contains all the letters you should need to see your claim through to the end.

More likely than not Pete, the judge will take option C. I obviously can't say for certain, but we already know that the bank charges stuff is the talk of the circuit - and many judges are getting rapidly p****** off with the banks over their behaviour. Fingers crossed for you.

Quite frankly Tracie, they're talking through their posterior in an effort to frighten you into not attempting leave them. First of all, every bank offers a type of 'free' account, often with no chequebook and only a cashcard (otherwise identical to a normal account), which in more cases than not they don't actually run a credit check for - one example is the Natwest "Step" account. You can even apply for this online through the Natwest website - I have one myself. They may require proof of name/address before they open an account, but you shouldn't have a single problem in getting an account like this opened. Secondly, for your credit history details: Check and improve your Credit Score | MoneySavingExpert.com should be of some help

Accept the judge's decision for the meantime. As the judge has ordered a stay to give them an opportunity to settle, you would be well within your rights to chase the solicitors until they do respond to your settlement conditions!

Ultimately, it's up to you Emma. As they have stated it's their final response, one argument is that they're not going to change their view so you can go ahead and file your claim. On the flip side, on the remote possibility the case does come to court the judge may deem you've not provided Lloyds enough time to 'change their mind'. Personally, I went ahead and filed straight after receiving their response to the LBA.

Have to echo GaryH here. I'd imagine a settlement by the end of the week may be the case on this one, as there is no way in hell Lloyds will even attempt to justify their 'pre-estimate of loss'.

Hi Molly, Yes, "defense" kinda implies they have submitted a defense The Court will send you a copy of Lloyd's defense along with an Allocation Questionnaire in the next few days. Nothing to particularly worry about, this is standard proceedure for Lloyds claims in every case to date. You can read up about filling in an Allocation Questionnaire in the FAQs and Bank Templates library. Lloyds solicitors, depending on which bunch you have, may also send you a copy of the defense.
