  2. They have passed it on to their henchmen If they have passed on your phone number, write and complain again under the same complaint asking for compensation. If they don't pay and eight weeks has passed or you have recieved their final word on the matter, report the matter to the FOS and ask them to investigate. This will cost them £400. Good Luck Cas
  3. Whoa These people are professionals why would you be wanting to educate them as to what an enforceable agreement is. As I said earlier I would write and ask for a copy of their internal complaints procedure. and report them to their local trading standards for chasing a debt whilst in default. Totally agree with CB:) Keep all records the more demands you get when they are in default the better for you.:grin: Read up on the FOS with a debt like this it may be a good lever later on.   7. CCA proves they own the debt. SAR they have to provide all info they have on you. Bank statements only if they produce them i.e they are your bank. "Just one more question" It is probably a while before you will be able to say this before it is true. I learn something everyday on this site and get stronger for it, ask as many questions as you need the answers for. Start threads on each debt if you need advice. All the best. Cas

  9. Sorry I just read that it was 500 If you complain and they can't satisfy your request you can when the complaints procedure is exhuasted threaten that you will report them to the FOS this will cost them 400 so it can be used as a bargaining tool at a later date, Cas
  10. I would wait until they send the next demand for money before I told them, at the same time I would ask for a copy of their internal complaints procedure. Then report them to trading standards in your area and theirs for demanding money while in default of a CCA request. How much is the debt for?
  11. This is a typical bait letter to get you on the phone, ignore it and let the CCA default continue. They know what their responsibilities are. This is quite a positive indication that they don't have the CCA. Good Luck Cas

  16. Bracken Do not speak to these people on the phone. Ever again!!!!!!! You do not have to answer any security questions. "Can they just turn up? Can they just take what they want out of my wage?" No they can't, not without a court order, the court will enforce your rights to have a reasonable living. Good on you for sending telephone harrassment letter.   17. I think that it is best to wait until you get the next demand for payment before informing creditors, the longer the default the better. They know or should know the law. The only contact I have made is to ask for a copy of their internal complaints procedure so I can use it at the first opportunity. Some of the companies the debts are below 400 so if they dont satisfy my complaint I can threaten to report them to the FOS which will cost them 400 quid.   18. Request a CCA from them to see if they have an agreement. At the top make sure you put "I do not acknowledge any debt to you"

  20. I can not agree more strongly with Josie. No CCA No Pay, Divert any payments into a savings account and wait 6 years since your last payment, if they contact you just keep asking for your CCA which is your legal right. You may also ask for any defaults to be removed under section 10 (I Think) as they do not have your permission to process your data under the DPA 1998. There is plenty of scope here as they have admitted they do not have the documentation to persue you legally for the debt. Any letter to this sorry bunch should begin.   22. How much is the debt? Request their internal complaints procedure. ASAP do not complain at this stage. When they ask for money report them to TS. When they ask for money complain that they have not complied with your CCA request.
