Can you scan or photo the letter from them on May 23 and post it. Cover any identifying information. The way i see it is that you have CCA requested them and the have defaulted or are soon to default -

It will be a pleasure, the first one has replied. From what I have read here they should not have been collecting if they dont have a genuine CCA. It has only been 10 days since I sent the request when do I send "can I have all my payments back plus interest" and can it go back more than six years. All views appreciated Cas

Just seen this, have you CCA'd this yet. -
Capitalbeast have no right to send you anything if they have not conformed to a CCA after so many working days. If they do not comply with your request within the time limit report them to trading standards and any other body that is relevant OFT etc.

Suggest a cup of coffee then start the CCA procedure to the debt collector to establish whether they are legaly entitled to chase your debt.

Next time they phone do the following Ask who is calling, they usually refuse to tell you until you go through security. When they ask personal questions D,O,B etc refuse to answer until they give you full details of who is calling. Do not answer any security details at all, ask them to hold, go and make a cup of tea, drink it, pick up the phone and say 'can you call back later I am busy'

I might be wrong here but if you respond and your last acknowlegement was less than six years ago the limitation will be re-established. So be careful. Can a more experienced member comment on this. Good Luck

rory32 Is it not true that charge can be set against property like a pecking order as in a second mortgage with a different company ?

baja ady Hi Im new to the site but have nine years experience in paying off a spiraling debt. My advice is 1) contact Citizens Advice Bureau for debt management advice, part of which is to request your creditors to stop charging interest and set out a reasonable budget that enables you to exist. Don't be over generous on the money left for credit debts section. 2) When setting up payments to your creditors only do this using standing orders. 3) Under no circumstances accept any consolidation loans particularly if it would be attached to your property, The old advice is that when you are in a hole stop digging! 4) Start claiming all unreasonable charges back from anywhere you can using the advice and letters on this site. I am in the last year of paying of my debts and hope to get something knocked off by claiming back unfair charges. As I don't know your full circumstances I can only give a view but consider giving up the second job. You are entitled to a reasonable life and the circumstances you are in are almost certainly due to the banks being only too ready to lend money inappropriately.. get back to me if this is helpful If I say the wrong thing tell me Best of luck Cas

Advice Needed on 9 Year Old Debts

Hi All I May be doing what my name suggests and this feels complicated. History, nine years ago my finances crashed leaving me with debts in excess of 26,000 on credit cards and loans, after very good advice from the Citizens Advice Bureau I came to arrangements with each of my account holders (8) to pay back what I could afford on a monthly basis. All of which froze interest on the accounts although one started charging interest again after three years. I have 12 more payments to make to finish off paying these debts but came accross this site. I could moan and be bitter (which I do and am) so after reading the site I will be posting off a S.A.R - (Subject Access Request) to the one that started charging interest. Can any of you knowlegeable people advise me whether there is any chance of success based on this: ........................................................... The remainder of the monies you say I owe I genuinely believe to be made up of unfairly applied penalty charges and interest applied to those charges. It is my belief that the payment I will make in July 2007 will satisfy this debt in full and ask that my account be marked up as such and closed. In addition to this I require that you contact any debt collection agency or any other body that you may have registered the debt with be informed of this and advised to mark their records accordingly. .................................................................... Here's where advice is required 1) Although the limitation on the charges may have run out would I have the right to claim back the interest on those charges over the last six years? 2) If I stop paying what could be the outcome if I would only agree to pay arrears and start repayments when I am given access to the original credit agreement. (I am prepared to travel to any reasonable location to do this) The main one I am going for first is Barclaycard/wescot all eight run alongside each other on an equal percent of cash available for debts basis.
