  1. I wish I could remember who, but someone recently posted on this forum saying that their rate had gone up, a figure of over 30% I am sure.... I wish I had spare cash to invest in a credit card! presumably they would also pay interest if the account was in credit!
  2. I am going to re-read various threads now on the basis of the above.....AS you know I applied for my CCA and got a letter basically telling me they didnt have it.... But few other people have received a letter such as mine, They are just going into default with most people and we are presuming (understandably) that they cannot provide it.... I wonder how many other people are going to receive their CCA's months after the request? It seems appalling that they are doing this, they are in criminal default after the first couple weeks, then 30 days..... you cannot suddenly redeem yourself and not be a criminal can you? Either they have got this information, or they haven't surely... why would it take so long to retrieve it, and where is the justification for it.....?? I hope that other people in similar situations as you Ony, are aware that this could happen.....
  3. my counci is the same. They stipulate what date you have to pay the monthly amount by, and if you miss that date twice you have to pay the whole amount or they take you to court. I am up to date with mine now, but May and Junes payment were about a week late and they served me a liability order!

  5. Small update..... CCA request sent last Tuesday (4th September) today is the 12th..... No reply there yet..... SAR details still not received, posted recorded 21.7.07, so that is in default now since the end of August. Today a letter received, very stiff paper Pink and Red warning signs all over it, explaining they are preparing to take this matter to court so please phone this number and acknowledge, also have your debit card handy! Also letter stating that Debt collectors may get involved that will not be nearly as nice and helpful as MBNA, What should our next step be?
  6. How long have you had your account? I would be inclined to send them a CCA request before you actually file with MCOL...... If they havent got the CCA it is very unlikely they would want to go through the court process,,,,

  8. Personally I would just SAR MBNA, they can find the account number, send proof of ID (copy of driving licence) £10 and send it recorded... oh and if his address has changed something with the old address on it too..
  9. There are some companies that do not use those guidlines... I suppose they take it for granted that we are going to feel small and intimidated, that we don't know our rights and that we are not going to complain... I had a phone call last summer at about 9.50pm from Mercers, and my hubby was getting calls every sunday afternoon for ages, 16 times a day is certainly excessive, but not unusual. we were getting them on my mobile, on the hour practically from about 8.30am right through till 9ish, mind you that was MBNA (nuff said!!!) You should find the telephone harrasment letter and send it off, if it doesnt work when they phone you ask them of their complaints procedure, they dont like giving this information out, then if it continues, you can take it to the Trading Standards.... who apparantly are quite useful at times like this. Go for it................

  11. As I understand, it appears to be easier to claim back pre-6 years if some of your claim is pre and some is more current. I had an awful job myself getting statements off MBNA, They basically gave me about five and a half years worth, then after many emails and phone calls they advised me that the earlier stuff was still with Abbey National (who were the original owners of my card) eventually I received the last few statements from MBNA, after Abbey forwarded them on. I would be very interested in receiving the other statements myself, particularly as my debt with them is now paid off and I know the statements probaly go back to about 1995/6 and I would imagine the charges probably started in about 1997/8 when various things floated towards a very large fan!!
  12. How long has he the account with them? The charges have only been £12 for about a year or so, they were at least double that price before then? If you have been receiving these charges for a few years you will be suprised as to how much they add up to, including the interest you add on to it. And yes, they do refund the £12 charges back too,

  17. They are never predictable.... How old is your account? Is it still open?
  18. The original SAR was sent off for on 4th July, so they are well and truly in default now. A letter arrived from MBNA a day or so ago, stating that unless a payment was made immediatly the debt was to be passed on.

  20. I beleive some people have suceeded in going back pre-6 years. I would say its not impossible, just not easy. I personally only managed to get 6 years exactly worth of statements from them... wish I had kept the old ones..
