I think that if you send your rejection letter to them, stating that you only accept the said amount as part payment and it is your full intention to persue MBNA for the rest of the claim, then if they choose to send you the cheque you have stated clearly everything you should have done I had an account with MBNA and their first payment of goodwill arrived in my account, I wrote to them rejecting it, then saying they could remove it with my permission, but if they chose to leave it there it would be part payment only...... it stayed there, so did their second goodwill payment.... I personally cannot see a problem with cashing this cheque on those terms
  2. Just phoned Chichester, explained that I wanted to file against a bank, but I understood about the stays that the banks were allowed to ask for.... and what was happening at Chichester? The gentlemen told me that every case was individual and he was not allowed to comment on individual cases. I asked if there were any cases up and coming that were not subject to a stay? he also told me that every case was individual and he couldnt comment.......... The most I was able to assatain was that a number of cases had been stayed. I also phoned Portsmouth, a sweet lady there who couldn't really answer, other than read a statement encouraging me to wait until the test case was resolved

  4. I started to write my reply about 8.45 and then got excited because the post came! (nothing to report sadly) then while I was sorting that out Josie popped up with her information! We are peas from the same pod I think. AS for the Abbey charge. Phone them! YOu should be able to talk them out of it, my neighbour did last week.
  5. Hiya Chopper....You say you opened your account in 1994? Excellent! I would put money on the fact that MBNA will not be able to provide you with your true copy of your CCA. This has proven a (silent) excellent leverage point. Send off for your CCA whilst you are still waiting for your SAR information to come through. AS regards the DCA, I would write to them, stating that you are waiting for various information to be sent to you from MBNA, which they have 40 days to send to you from ** (the date you wrote to them) Tell them you have offered a token payment and sent in the income expenditure form, of which they have acknowledged and ask them to acknowledge in writing that they accept this amount. State in this letter that you only wish to communicate with MBNA/dca whoever in writing, as is your right. There are telephone harrasment letters in the templates, which should also be sent to them
  6. Ditto to the above. Only yesterday someone was in this site saying they had been offered a partial settlement from MBNA, so start the ball rolling regardless..................Good luck
  7. Oh Empowered, I feel told off........I did apologise! Going out in a minute to a pub quiz....... wish me luck, I am going with 2 mates, one who has a degree and the other who is half the way through her degree course......and they have come 2nd to last for the last 2 weeks........they must need my help!!!   11. Hopeful, Yes, accept the partial offer etc etc, they will leave it in your account anyway, which does make the whole debt thing feel better, keep going though..... I had two payments go in from them, before they made their final settlement. You're nearly there I think. xxx Don't know if I need a support act though, get the feeling we could do a double act much better!!!!!!

  13. After re-reading your thread Hopeful, I have decided to go to FOS with my Abbey Claim. I realise that I will loose out on the 8% but like you, I cannot afford to shell out the £120 in fees.

  19. They phoned a couple of hours ago..................... "Hello, may I speak to Mrs Standingupformyself" Yes, speaking? "This is Barclaycard, may I please have the year of your birth?" Why? "It's just security, I have the date and month, I just need to clarify your year of birth" I'm sorry, but I will not give out any personal information on the phone "We have the month being *** and the date being *** Can you confirm the year please as I need to speak to you about something quite important" No, I am sorry but I will not do that.......... If you give me the information that you have on me, I will confirm if you are correct" The operative then went quiet, I put my phone on "speaker" for a while, there was various background noise and then the line went dead. I do not actually have a problem with speaking to these guys, I have the computer loaded up with the facts and figures I wish to speak to them about... I wish to tell them that the PPI plus interest adds up to what I owe them at present, that the charges plus interest is an amount much the same, that they are in default as they have not conformed with my CCA request and I wish them to stop charging me interest each month on that basis. However, I got caught out by them before, about 12 months ago........ I owed them quite a bit in arrears, then when I had a backpay paid into my Barclays current account from Child Tax Credit, they managed to get £600 out from my current account on the same day that the payment went in. HOWEVER, where is it in writing to say that I have signed to agree that could happen?
  20. HIya Wednesday, sorry haven't been around for a few days. I am at stalemate at the moment myself... been thinking about my Barclaycard milarky too......... probably could do with some advice on that one from you if you get the time. I have LBA'd MBNA and in theory am ready to think about court, however to be truthful I cannot afford it at the moment, so am spending my time reading and re-reading everything to keep informed.
