Still they havent phoned back... Am actually wondering whether they were phoning me in respect of my claim rather than arrears??? They don't usually give up so easily, ONE MISSED CALL, that is not their style.... Will make sure my mobile is always in my pocket.. By the way Wednesday, your POC is damm good.... intersting to see if anyone adds anything to it. I am off work for a fortnight now (old school stuff, I am a secretary in an engineering factory, and they still close down every summer for a fortnight) so I will get everything up to date.. And if I suceed in not spending too much in the next fortnight I should be able to afford to start court proceedings with my Abbey current claim, then MBNA, then Barclaycard, then Interest on Barclaycard.............. THEN...... my mother in law wants me to have a look at her banking stuff, should be a busy month........

How did you get on Hannah? Are things feeling more optimistic today? -
No Wednesday they didn't !!! I knew exactly what I was going to say too....... I was not going to answer any security questions, ie refuse to give my date of birth etc.. I was going to tell them that I insist on communication only by letter and wish my telephone number to removed from their system I was also going to say that I did not believe that the CCA they sent me was in any way a true copy of my request, hense I would like to state that my account is in dispute. Also, they may say that I owe them £57, but I actually beleive that they owe me £900+ and they didn't phone..............typical

I have recently started another thread about this, but as I have a few friends/experts on this thread I thought I would post a question here in the hope of getting a quick answer or two BARCLAYCARD At the same time as requesting my CCA from MBNA I also requested one from Barclaycard (who I am also chasing charges back from, I am after about £900 including CI, which will clear my account.. they have already put two payments into my account, £288 and £66) They did not send me my CCA, but my application form, and 2 printed A4 pages stapled together of terms and conditions that were not personal to me in any size, shape or form. This account is in arrears at the moment, I owe the current bill and last months, to be truthful I simply forgot to pay the bill! I can afford to bring the account up to date this week but just not inclined.. although I know that I will. At about 8.50 this evening I received a call on my mobile (I did not hear it ring, so did not answer it) I beleive that it was from Barclaycard. I am sure they will phone again in the morning, and I will answer it rather than have them ringing on and off all weekend. Should I mention to them that I consider them to be in default of my CCA request? If I do it will be the first time I have discussed the matter with them, I was choosing to leave this matter until after I have taken them to court (yes Wednesday, you know where my train of thought is going with that!!) Any advice anyone as to what I should say to them tomorrow? Should I push the point about my charges and lack of true CCA?

It doesn't matter how you got yourself into this situation..... Look at this forum, no-one is here to judge you... Just take control Hannah !!!! You will be no good for your daughter if you are ill and stressed. First step tomorrow, phone benefits agency and ask/insist that they pay your benefit by giro because of bank problems and you and your daughter will not be able to survive the month! Be firm, positive and pleasant, Next step, go to the CAB, you may have to make an appointment or you may be seen there and then, either way then you are on the way. Third step, Open your new bank account so that you can give the details to the benfits agency, Now didnt I make that sound easy!!!!!!!!!!!!! I know it's no doddle getting things sorted, but think how you feel tomorrow evening if you at least have started to sort things out... You can do it hunny xxxx -

I presume that your child/working tax credits are going into your HSBC bank account? You obviously need to sort out your finances, and I would advise you to go to the CAB or something similar. However the one practical thing I would advise is to open a new basic bank account, I know that Barclays do a very basic one, you can open it easily, just with 2 or 3 forms of ID I think.... Ask Barclays for the account number whilst at the branch opening the account, and then phone up the benefits agency and get your benefits paid into there... meanwhile ask them to pay your benefits by Giro.. they don't always say yes to this, but they often do. Somehow you need to treat the overdraft facility you have with the other bank as a managable debt, with help from the CAB you can make a realistic monthly arrangement, also you should think about claiming against them for unfair bank charges. Good luck, and keep us posted -
They do seem to settle with some people without going to court. I have a theory on this though, I think they do it when we ask them for a true copy of our CCA, and they cannot produce it. Have you asked for a copy of yours? It gets a little interesting if they cannot provide it.

CCA's and Dave against the world !!!
standingupformyself replied to davefirewalker's topic in General Debt Issues
Hi Dave, MrFirewalker sir!!!! Things are getting interesting here aren't they! You have been a mine of information to me with my MBNA thread... can you have a look at this one for me . I am claiming charges back, plus CI which will wipe the balance...... Just wondering if I can use their pathetic attempt at sending a CCA to add weight to my claim case, thank you xx CCA or application form Please have a look - The Consumer Forums -
CCA or application form?? Please have a look
standingupformyself replied to standingupformyself's topic in General
The other issue I have with them is the PPI insurance. I know that I didnt ask for it, I never do............. the box that should be ticked has a smudge in it, but I am adamant that it is not is not a tick. When you blow up the photocopy it is still unclear.............. can anyone else put their opinion in on that matter? -

I am very interested in knowing what steps I should take next? I am claiming back charges and CI that amount to pretty much my debt with Barclaycard. would the lack of CCA shed any weight to this claim? -
I sent off for my CCA from Barclaycard, and received this in return. I am chasing charges and CI back from them at the moment. Is this a true copy of my CCA....... Can anyone help me? Thanks.

Hopeful, we have met before on other threads......... Just wanted to lend my support to you and give you a hug xx -
Last month I sent off for a true copy of my CCA, all I receievd in the post was a copy of the application form... I have not got scanning facilities at home, but will try and upload it at work and post it on this thread. If this is not a copy of my CCA, has anyone any advice as to what steps I can take now?
-
No you don't have to wait for them at all...... Presume you you have sent the two letters (from this site) when the 14 days are up from the second letter then you can file with the court..... The worm has turned here! You are now setting down the timescales to them..
-
We've come a long way really haven't we? Amazing how much you learn as you go on.......... I will read and read everything tonight and tomorrow morning, then the letter will be enveloped up and ready to go for Wednesday morning..... I will post it on my thread first............. I am proud and impressed of you
