    i wasn't too sure as i allowed them to take it through their complaints procedure (which took 8 weeks) last time and my reward was them sending it to Debt Collectors! I'll go ahead and file the claim then, thanks.

    Hi, I'm confused, can anyone help? I've been to-ing and fro-ing with Abbey for about 6 months now. They've made me an offer which i have declined and given them 14days to respond before i file a claim against them. The 14 days is up today and i received a letter yesterday saying they need 4 weeks to investigate. They have already taken 8 weeks to investigate and make me the original offer ( and send it to Debt Collection Agency). Do i continue with filing a claim or do i have to wait until they have done their so-called investigation?
  3. Thanks for your advice. I've written to Abbey rejecting their offer and have given them the 14days etc. I have also written to the debt collection agency and enclosed a copy of my most recent correspondance with Abbey (showing that i haven't finished with them yet!) and am waiting to hear back. I intend to start court action if i do not hear before the end of the 14 days. is there anything i've missed?

I am currently trying to get my bank charges back from Abbey and have got to the point where they've made me an offer (paid direct into my account). they have given me 8 weeks to tell them whether i accept or not but have turned it over to debt collectors after about 1 1/2 - 2 weeks!(my account is overdrawn due to the charges they have applied) The debt collection agency are threatening legal action (ccjs etc) if i don't pay them. i explained the situation to them (i.e. that i intend to pursue Abbey in court) but they still say they will start legal proceedings against me. Can Abbey pass the 'so called' debt over before allowing the 8 weeks to reply? And what do i do now? help!
