  1. Can I ask who should I approach for the SAR as the loan was sold by Citi Financial and was taken over by Moneyway? also who should my complaint be addressed to? (do Citi still exist or did Moneyway buy the loan book and therefore accountable for the mis-selling?)
  2. I have recently paid off a loan which had Credit care insurance attached, The loan was taken over by a company called Moneyway a couple of years back and they have sent me a closing statement showing PPI. I have looked through my original application and the cover show is worse than I get through my work and worse still I was ill several years ago for 4 months and didn't realise I had this cover (I took life assurance out at the same time which means I got a huge folder of documents, but luckily I kept every document and booklet). I need help with a couple of things. Who do I complaint to (Citi or Moneyway) as both have had money for the PPI. The original loan was changed a few times and PPI was added each time so calculating the amount paid is near impossible. And I guess my claim is mis-selling as my work benefits were/are superior to what I was sold by Citi? Does that sound correct or Is it not as simple as that?
  3. Well after hsbc decided not to give me an "informal overdraft" my charges have halved this month!!!! rather than £150 they are taking £75 for the same overlimit ammount!!! bizzarre..... I am going to wait for the oft case as i didn't get my court claim in on time but will be writing to the complaint's department to make sure they don't forget me ... and i am complaining to the ombudsman regarding them taking far too long (well over the 8 weeks rule) and the lack of correspondance...
  4. A great read and it shows the judges are getting fed up of all the banks time wasting....
  5. I have an mbna credit card that I have never signed an agreement on and was wondering where i stand legal wise...the story is about 10 years ago I had another banks card and the type of card was taken over by the mbna recently (allthough I never had any new term's issued by the mbna and never signed any document's). the mbna has just wrote to me stating that due to periodic review of my account I am not entitled to the card and have withdrawn it.. (they have said If i continue paying this will be within terms of the agreement????) ...if I haven't signed an agreement is this enforcable??? and should i accept that they have reviewed my account a month after they opened it??
  6. At work when we transfered funds to the wrong account (held with the bank i worked for!!!) we remove them as soon as we are aware and we don't need to ask for permission (as long as they haven't being spent all ready...and this happens lot's...).. with other banks we speak to the bank and request they return (allthough some banks are useless and don't seem barclay bothered) and should this occur we have to pay this from our own account and then try to reclaim from the wrong payee, we use court action if they don't agree:eek: . ooop's did I name the worst offender!!!! oh not quite:D
  7. I have just recieved a letter today saying my request for an informal overdraft was declined (another i didn't ask for!!) and they have also added £25 worth of extra charges without informing me (and i thought they had to give 14day's notice cefore adding charges???)... and they also called me asking when I was going to repay the overdrawn ammount and replied when they refund my illegal charges...then the phone went dead... I will call them myself monday and ask why they didn't reply to a simple question:rolleyes:
  8. I have just recieved a default on some rental equipment I had 3 years ago. They are saying that nothing was returned and I cannot prove otherwise, its a long story but when I split with my ex partner i left everything at her house and arranged collection, now they are saying i never asked and nothing was ever collected. I hadn't heard from them for 2+ years (as I was behind on the payments due to illness so i did call after they would/should of being collected to arrange to pay outstanding rental) and when i checked my credit report this came up and i contacted them and that's why they issued the default. My problem is that my ex partner and i do not commmunicate and i have no evidence and I guess that charges have being applied to the debt. can anybody help with what course of action i should start.... thanks
  9. Well the hsbc have done it agian by adding yet more charges...the have declined a couple of dd's on friday and charged me for the priveledge... strange that they have taken there charges from my account today making me overdrawn again, and no doubt i will be charged for that too??? at least i haven't applied to court yet as i will add these on
  10. At work the only notification the banks give when people cancel a dd is electronically....bascially we get a dd cancelled against the mandate. All dd's are set up with a mandate (which has all the dd details logged) and for us to set up a new mandate it takes 16 working day's as we use a dd gaurantee that states we will allways give at least 10days notice should the dd change and that includes setting a new dd up. lloyds do have trouble cancelling dd's for some reason and then whack you with charges. Claim the charges back.....oh and if you cancel any dd's get them to give you a print out to confirm and then they can't say you didn't cancel some and not other's... and regarding 0845 number's... we use 0845 or 01/02 number's for different department's and we get complaint's about both (it's no win for me at work!!!) because some people call 01/02 number's free and pay for 0845 and some say calling our 01/02 number's are national rate (which is correct if non local) and want an 0845 local rate number sorry if that seems me having a dig but I get moaned at daily for this!!!:-|
  11. Great news all round.... but i do feel the banks will settle rather than revealing their cost's (hopefully not:) but have they got the ball's??)
  12. I have recieved a letter from the leeds service center asking for a breakdown of charges i am requesting a refund on... I have used the template without interest and have included this month's "arrangement fee" charge... Freakyleaky I don't know if you can answer this but these new charges are not listed on my original terms and condition's which I signed when I opened the account, Are they allowed to change/add new fee's charges etc???
  13. Hi maggie...keep up the great work and fight to the end!! (look's a clear cut case to me) I know what it's like to be ill and then have stress of these debt companies to deal with.. I have dealt with wescot and i.j before and they used to hang up on me when I advised them i was recording my call's
  14. i have looked through my statements and have found the following "Overdraft arrangement fee's" These fees relate to one or more informal overdraft request you have made, which have being considered and approved. "Fair fee policy" We do not apply arrangement fees for overdraft requests (either formal or informal) unless they are made frequently. the arrange fee you are being advised of today is payable because you have made more than one request over the last 6 month's. These fees range from £46 to £146 according to my statement's. I have never asked them for an overdraft and don't understand how they state I have???? How do I stand on these charges?? and how can they charge me for something they have done without my knowledge or do they class because my account goes overdrawn as a request?
  15. I've given up with the tax credit people....They have now informed me that because you did not return your annual declaration we will continue to recover the over payment... I am going to do an access request on the details they have.. as the form was sent when I was not living with my partner (and they were notified by phone and writing) and see who they wrote to (and I know it wasn't me!!)
