  2. Hi Your POC should include references to both i.e. on what grounds you claim interest in restitution and if you are going back further than six years on what basis. When you have drafted your full POC you can post it up here for review. You probably already know that Cap1 can be difficult so good preparation is necessary. You should be doing a lot of reading in the Cap1 forum and in other bank forums about charges reclaims. ims

  3. What we agree with, the fairness or otherwise is not the issue. This site is about learning and being able to formulate a personal debt management strategy based on what is happening in the industry. Fortunately I am not hounded or chased by DCAs because I mange my debt in a particular way. If I change my tactics then I might well be and this site helps people based on individual circumstances.

It is over £5,000 so it won't be a small claims, so therefore he is in default, and you file the defence clearly stating On xxx date I sent a CPRxx request - the reply from the claimaint is attached. As the claim total is over £5,000 it will apply to this case and therefore their refusal is an abuse of court process. As I do not have the details I need to fully particularlise and properly defend this claim I am asking the court to strike this out completely due to the non compliance of a valid CPR request. I am reluctant to allow the claimaint to have additional time to provide documentation they should have had on filing th

  9. and you really need to stop talking to the fleecing DCA they have NO LEGAL POWERS to demand any thing from you. as for the misuse of the DD unless you received WRITTEN notification of the sums being taken by orange then contact the back and get it back under the DD guarantee. NEVER EVER pay a DCA anything!! and stay off the phone to them. dx
