    • Thank-you dx, What you have written is certainly helpful to my understanding. The only thing I would say, what I found to be most worrying and led me to start this discussion is, I believe the judge did not merely admonish the defendant in the case in question, but used that point to dismiss the case in the claimants favour. To me, and I don't have your experience or knowledge, that is somewhat troubling. Again, the caveat being that we don't know exactly what went on but I think we can infer the reason for the judgement. Thank-you for your feedback. EDIT: I guess that the case I refer to is only one case and it may never happen again and the strategy not to appeal is still the best strategy even in this event, but I really did find the outcome of that case, not only extremely annoying but also worrying. Let's hope other judges are not quite so narrow minded and don't get fixated on one particular issue as FTMDave alluded to.

    • the claimant in their WS can refer to whatever previous CC judgements they like, as we do in our WS's, but CC judgements do not set a legal precedence. however, they do often refer to judgements like Bevis, those cases do created a precedence as they were court of appeal rulings. as for if the defendant, prior to the raising of a claim, dobbed themselves in as the driver in writing during any appeal to the PPC, i don't think we've seen one case whereby the claimant referred to such in their WS.. ?? but they certainly typically include said appeal letters in their exhibits. i certainly dont think it's a good idea to 'remind' them of such at the defence stage, even if the defendant did admit such in a written appeal. i would further go as far to say, that could be even more damaging to the whole case than a judge admonishing a defendant for not appealing to the PPC in the 1st place. it sort of blows the defendant out the water before the judge reads anything else. dx  
    • Hi LFI, Your knowledge in this area is greater than I could possibly hope to have and as such I appreciate your feedback. I'm not sure that I agree the reason why a barrister would say that, only to get new customers, I'm sure he must have had professional experience in this area that qualifies him to make that point. 🙂 In your point 1 you mention: 1] there is a real danger that some part of the appeal will point out that the person appealing [the keeper ] is also the driver. I understand the point you are making but I was referring to when the keeper is also the driver and admits it later and only in this circumstance, but I understand what you are saying. I take on board the issues you raise in point 2. Is it possible that a PPC (claimant) could refer back to the case above as proof that the motorist should have appealed, like they refer back to other cases? Thanks once again for the feedback.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

i do not want to avoid paying my debts,

I simply want rid of them preferably without it leaving me even more brassic (ie by lowering my current montly payments) ..

preferably with an eventual half decent settlement figure (60% max if poss) and preferably with a clean credit file.

 

I have 5 debts totalling £16k from 2004/05 due to sudden big drop in my income. I have been in a dmplink3.gif since 2005 and pay each creditor between £5 and £45 per month. All the debts are with a DCAlink3.gif's, some have been sold on several times. All the debts have defaulted in either 2005, 06, 07 and 08. Not sure how they managed to default when i was on an agreed payment plan but suppose they can do what they want.

 

I am fed with it all and so my mum offered to lend me her savings of £9k to try to pay them off. I sent them all a full and final letter, ommiting any liability, and offered them all a pro rata amount. 3 have replied but wont accept and offered me a counter offer of 15%, 20% and 25% off. The other two have basically ignored me. My mum offered me this as i thought i may be able to re-mortgage (paying high interestlink3.gif at moment) if they were cleared, however just found out i wont be able to until the defaults have dropped off so I suppose its just as well they didnt accept.

 

Then.. i found this site and have spent the past week reading the posts but im still confused so I would be really grateful if you could help me.

 

From what i gather I should now send them all a cca request is this right? Should I send this to the dca or the owner (the owners are not the original creditors)? Again.. its not to avoid payment cos i would be useless in court.. its more to do with a bit of power to try to reduce the full and final settlement figure.

 

One of my defaults is a duplicate that has been put on by both the original creditor and the dca, both have the same default date. Does this matter?

 

Should I keep paying the dmplink3.gif or come out and pay the dca's reduced amounts? If i do this could they then get a ccj against me? Also what if i kept paying the same and just paid reduced amounts after the defaults come off.. would that make any difference.. could they then ccj me?

 

Ive got some payment statements from some creditors and there are loads of my payments missing, i have never missed a payment to the dmp so unsure where this money has gone, its in excess of £500 and i havnt got all the statements yet. Im wondering if some of these 'missing' payments have contributed to the defaults placed after i was in a dmp but how would i find out?

 

Lastly, do you know if you can access 'dropped' off credit references from credit file? I settled an account with orange in 2009, its not showing on credit file but now ive got Mckenzie Hall chasing the debt for Capquest. First ive heard from them since 2009 when Moorcroft were dealing with it!

Hello Pookie,

I just stumbled upon your post as I am trying to find my way around the site.

I am, like yourself a newbie and like your self I have been paying a DMC alot of money to sort out my problems.

I have however, with the help of a CAGGER cancelled my agreement with the company and I am trying to go alone.

I to have realised (though I actually havent seen any paperwork ) that lots of accounts havent been paid etc. and that it is a right mess.

All I can say to you is drop them and either go to a free company or do it yourself.

I have spent hours on here, asking dim questions and getting very confused but at least I feel I am in control and that I know what is going on with MY debts!!

The help I have recieved has been just amazing so I am persevering.

I hope all goes well and sorry I cannot give you more technical help

Thank you Nancy, its a nightmare isnt it. Hopefully someone will be able to help me too. Im stuck with a high interest mortgage and cant change it till the defaults drop off, I did think I could re-mortgage if i paid them off but now I know thats not an option i may as well wait a bit and get the cca's etc in. Feel extremely stressed with it all to be honest.

Pookie I am in exactly the same position, stuck in a high mortgage until all the blooming things come of my credit file.

It is not helped by the fact that I seem to be losing my marbles and I have to keep re reading stuff haha ..I was clever at school but obviously time has taken it's toll. I am still trying to work out the difference between SARs and CCA's (just been reading a thread to learn)

All my problems started when I couldn't remortgage about 2 and half years ago (got quite lot of equity in the house and I had a good credit score) from then on it all went belly up and I just didn't know how to deal with it.

Like you I found this site and realised I had to do something, which at this point would mainly be scratching my head and getting stressed.

The great thing is that the site is full of lovely helpful people.

I do get a sense that the tide is turning and that the companies are more inclined to negotiate as more people are getting stuck.

I will follow this thread and hopefully see you eventually get out of your mess

I too have lots of equity, been with same mortgage company for 15 years yet they will do nothing for me because of my bad credit. My guaranteed overtime ended abrutly and my ex stopped paying maintenance and csa did nothing so i couldnt meet my commitments. I dont want to get out of paying my debts, Im not wanting to go down the cca route as a way of avoiding paying, i just kinda want to see what the dca's have etc in a hope of getitng a lower settlement than just 15% off.. especially in view of the age of the debt and the defaults. Hope someone has a look at my post and gives me some advice. Feeling pretty desolate about it all. I feel like im just stuck .. cant pay debts off till have some money, cant get money till i pay them off...

Yes like you also I feel very stressed and stuck..apart from coming into money or selling the house and then renting (no no no) it is a worry!!

I too want to pay but I get mad as the further down you go the more charges you pay and the deeper you go. Why don't they realise it is in their best interests (I would have thought) to help people pay.

I have been on here for about 6 hours today and have only written 4 letters haha and I am going crosseyed.

It doesnt sound like your DMC have done a very good job, when I actually looked at the charges on mine it was about half of the money I had paid in..they have become part of the problem.

It is really nice to speak with you and if you ever feel like a rant or shout just PM me and we can get stressed together haha

if you are paying some monkey firm - stop now - do it yourself.

 

pers i'd SAR everyone whom appears on your CRA file

 

then go from there.

 

yes a CCA might well twist arms on a low F&F

 

but i'd get reclaiming first!

Yes its a monkey firm... something gone wrong if the funds im paying them are not reaching the creditors.. or maybe they are and the creditors have lost it.

 

As for reclaiming. I defo didnt take any ppi with the loan, not sure about the credit cards but when i was offered it I always refused as my work pays full sick pay for 6 months. So... unless its been put on without my knowledge i wont have any. As for interest... it stopped shortly after joining dmp. I dont think there is much to pursue in the reclaiming dept. Would like to know how a dca can default me though when im on an agreed payment plan! Thing is, first time i ever checked my file was last year.. i stupidly didnt know about these things!
