    • Hi All, So brief outline. I have Natwest CC debt £8k last payment i made was 7th November 2018 Not a penny since. So coming up to the 6 year mark. Can't remember when i took out the  credit card would be a few years before everythign hit the fan. Moved house 2020 - updated NatWest as I still have a current account with them. Then Lowells took over from Moorcroft and were writing to me at my current address. I did get a family member to speak to them 3 years ago regarding the debt explained although it may be in my name I didn't rack it up then went contact again. 29th may received an email from overdales saying they were now managing the debt. I have not had any letter yet which i thought is odd?  Couple of questions 1. Does my family member speaking to lowell restart statute barred clock? 2. Do you think overdales aren't writing to me because they will back door CCJ to old address even though Lowells have contacted me at current address never at previous? ( have no proof though stupidly binned all letters  ) Should I write to them and confirm my address just incase? Does this restart statute barred clock? 3. what do you think best course of action is?   Any help/advice is appreciated I am aware they may ramp up the process now due to 7th December being the 6 year mark.   Many Thanks in advance!     • Hello all, just got this from my bank today.   ” Update on your payment refund As you know we temporarily refunded the amount(s) of £381.98 to your account pending investigation. We’re pleased to confirm that an additional amount of £359.99 has also been refunded to your account by the retailer on 18th March 2024. What will happen next To correct this situation, arrangements will be made on 6th June 2024 to reverse the original refund supplied from us.  Our file in respect of this matter will now be closed, which we trust is satisfactory.”   Not sure what to do as I was previously told if I hear nothing back after a certain date that would be the case closed now it’s been changed to the 6th of June. and as you see I’m not getting a full refund I don’t know wether to contact them again and try to get the £20, or if I even can at this point? Thanks again.

    • So even if they do repair it in time, you still need to get a marquee etc? If they don't repair it in time, you have to find a new venue? I'm confused?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Right, it's time to get on the bandwagon and get things moving. I've been reading the site all day and I think i've got the plan of attack in order...

 

Just phoned to request transactions and charges over the last six years. Paid £5 and was told they'd be put in the post straight away. I've got a majority of my statements but I'd rather have a complete list as I think it's going to be several thousand pounds...

 

Will keep you posted guys, but I think i'm going to need your support through this! It's all so exciting! :D

Moving on! Got my statements through this morning (all 97 pages worth, fantastic :rolleyes:), and worked out i'm owed £2174 in charges. Which is nice :D

 

Just writing out my prelim letter now, can I just check that the best address to sent it to is :-

trinity road

hx1 2rg

 

Obviously don't want it to go to the wrong place and get lost in an 'administrative error'.

That will be fine.

 

Keep your costs low and just take the letter to your post office - get a free certificate of postage rather than paying extra for recorded or special delivery etc.

Preliminary letter posted! I'll give them a day to receive it, so I make the deadline 14th July!

 

By the sound of things I'll be expecting a standard letter with a rubbish offer sooner mind...

Quick question. On the 6th July I got a standard letter saying that my letter had been forwarded to customer services. Does this mean I now have to wait 14 days from the 6th, or can I stick to my original timescale and send my lba today?

 

Also, i've had another charge since I sent off the preliminary letter. Can I state this is my lba and add it to the amount i'm claiming?

Wohoo! It's all going on... :D

 

Got a fairly standard letter with an offer of £200 as full and final payment, but I've read two different things at this point.

 

Do I accept the offer as partial payment, and say if they don't pay the full amount by my original deadline, i'll still take them to court. Or...

 

Do I just reject the offer flat and say I won't accept anything less than the full amount?

reply accepting as partial however you will proceed to court for the remainder.

Deadline is up! I'm now filling out the moneyclaim form, just got a quick question.

 

On the particulars of claim box, I've noticed people are claiming the 8% annual interest on the charges AND daily interest on them at 0.022%.

 

I get the first bit, but where does the daily interest come into it?

you have worked out the 8% interest already, yep

 

after the date of filing, that 8% continues, but so they can work it out you have to tell them what the daily rate is in pence.

 

i think it is 0.0022 x debt, someone else may be able to shed light on the exact daily amount. (i left 8% in)

they will acknowledge in about a week, stating they intend to defend. Northern rock submitted a defence which got me rather "hot under the collar" but the defence was "we have sent him a cheque".

 

expect a refund in about 3 weeks now.
